Carmel Drive Carmel, IN 46032 (317) 844-4693 email: dcoots@chwlaw.com STATEMENT OF VARIANCE REQUEST The Petitioner seeks a Development Standards Variance approval for 80% lot cover coverage. 70% lot coverage is allowed for the real estate located at 220 2nd Street SW, Carmel, Indiana. The legal description of the real estate and location map are attached as Exhibit A. The parcel is zoned B-2 by the Carmel City Council by Ordinance No. Z-673-22 adopted by the Common Council of the City of Carmel on March 7, 2022. The Ordinance included commitments to restrict permitted uses in the B-2 zone and to present structural modifications to the Carmel Plan Commission. A copy of Ordinance Z-673-22 with the commitments is attached hereto as Exhibit B. The architectural plans add 2,940 square feet to the existing building that measures 2,300 square feet. The development plan and architectural and landscaping plans have been reviewed and approved by the Commercial Committee at its meeting held on September 6, 2022. STATEMENT OF SUPPORT At the request of the Carmel Council (Ordinance D-673-22) the applicant agreed to enclose the outdoor entertainment venue with the new structure. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Adjoining properties are screened and will not be impacted by any drainage. 3.
