Beauty Systems
Petitioner seeks Commitment Amendment approval to permit an additional sign. The site
is located at 1437 Keystone Way, northwest of the intersection of Keystone Avenue (US
431) and 116th Street. The site is zoned B-8.

Petitioner seeks ADLS approval for a sign. The site is located at 1437 Keystone Way,
northwest of the intersection of Keystone Avenue (US 431) and 116th Street. The site is
zoned B-8.

The applicant did not submit an informational packets for distribution to the Plan Commission on
Friday, June 8th as instructed. The Department has included a copy of the original commitment
(see attached). In addition the file contains a copy of the proposed sign elevations. The applicant
has been directed to supply a photo of the east face of the building. This will provide the
Commission a point of reference from which to proceed.
The applicant is requesting a commitment amendment to allow a sign to be located on the east
fa<;ade of the subject building. When originally approved the applicant committed to forego
signage in the proposed location to permit another tenant space without frontage on that side of
the building a sign located on the existing extended wall of there space (applicant shold have
photo. If they do not the Department will make efforts to obtain a photo for distribution at the
meeting.)
The Department is not in favor of this request. At this point the applicant is requesting to go
back on his word and have the commitment removed from the property. The commitment
allowed his primary tenant signage to face Keystone A venue that it otherwise would not have
been allowed to do.
However, if the applicant were to commit to the removal of the existing tenant sign that would
not be permitted under today's ordinance anyway, the Department would support the request to
allow a sign for the comer tenant on the east fa<;ade of the building.
The Department recommends that this Item be forwarded to the Special Studies
Committee on July 3, 2001.

WITNESSETH
WHEREAS, Covenantor owns the following described real estate
located in Carmel" Hamilton County, Indiana:
Parcel 3: Part of the South Half of Section 31,
Township 18 North, Range 4 East, Hamilton County,
Indiana, more particularly described as follows:
Commencing at th~ Southwest corner of said Section,
thence North 89 degrees 50 minutes 15 seconds East
(assumed bearing) along the South line of said Sec-

WHEREAS, Covenantor desires to restrict signage allowable to
structures placed on the above-described real estate and that
such covenant regarding the signage continue to encumber the real
estate.
NOW THEREFORE, Covenantor unilaterally covenants to Carmel
as follows:
1.. Covenantor has agreed to construct an 11,400 square foot
retail structure on the above-described real estate divided into
a westerly 7,200 square foot segment and two 2,100 square foot
segments located to the east.

2. Covenantor relinquishes signage permitted by the Carmel
sign ordinance, as it may be amended from time to time, as such
ordinance permits the location of signage on the eastern wall of
the eastern portion of the most eastern 2,100 square foot struc-
ture and in its place covenants to the placement of such signage
on the split faced concrete block wall extended above the separa-
tion wall between the westerly 7,200 square foot segment and the
remaining 4,200 square foot segment of the building located on
the above-described real estate.
3. It is the purpose of this covenant to permit signage
allowed by the ordinance, as amended, to be utilized by the
larger segment of the structure and to restrict signage of the
easterly smaller segment of the structure to its south elevation
only and prohibiting signage on the east elevation of such small-
er structure.
IN WITNESS WHEREOF, Covenantor has executed the foregoing
real estate covenant on the date and year first above written.
