Docket No. 50-01 CA (Commitment Amendment): 1437 Keystone Way - Victory Beauty Systems Petitioner seeks Commitment Amendment approval to permit an additional sign. The site is located at 1437 Keystone Way, northwest of the intersection of Keystone Avenue (SR 431) and East 116th Street. Docket No. 51-01 ADLS: 1437 Keystone Way - Victory Beauty Systems Petitioner seeks ADLS approval for a sign. The site is located at 1437 Keystone Way, northwest of the intersection of North Keystone Avenue (SR 431) and East 116th Street. The site is zoned B-8/Business and is located partially within the SR 431/Keystone Avenue Overlay Zone. Filed by Kevin Miller of Action Sign Company for Victory Beauty Systems. The applicant is requesting a commitment amendment to allow a sign to be located on the east fal(ade of the subject building (see attached building elevation). When originally approved, the applicant committed to forego signage in the proposed location to permit another tenant space, without frontage on that side of the building, a sign located on the existing extended wall of their space (see attached photo). The Special Studies Committee continued these two items last month requesting that the applicant provide the following: 1. A written commitment regarding future ADLS approval for the remainder of the building. 2. A revised landscape plan reflecting the proposed elevation drawings. The applicant has provided these documents. However the Department feels that the commitment should be revised (see attached commitment prepared by the department). The Department recommends that the Special Studies Committee forward this item back to the full Plan Commission with a favorable recommendation based on the commitment as prepared by the Department Committee Report 2001-11-6.rtf "" ,-' A CROSS REF: INST. #If. D.R. ##, PAGE ## Commitments Attendant to Commitment Amendment and ADLS Amendment Approval of Docket Nos. 50-01 CA & 51-01 ADLS Amend (1437 Keystone Way East, Carmel, IN 46032) James F. Singleton (hereafter, "Applicant"), owner of the Real Property located at 1437 Keystone Way East, Carmel, Indiana, makes the following Commitments. to the City of Carmel & Clay Township Plan Commission: Description of Real Estate: See attached Exhibit A (hereafter "Real Property"). Statement of Commitments: 1. At such time as either a) the current Tenant (Car-X Muffler & Brakes) renews the lease, or , b) a new Tenant and/or Tenants enters into a lease for all or part of the 7200-square-foot western section of the Principal Building located on the Real Property, the Applicant shall submit an ADLS Amendment application to the Director of the Department of Community Services for approval by the Carmel/Clay Plan Commission. 2. The Architectural Design of the aforementioned western section of the Principal Buildirig shall be in compliance with the ADLS Amendment approval granted by the Carmel/Clay Plan Commission per Docket Nos. 50-01 CA & 51-01 ADLS Amend. 3. The Applicant understands that the representations made above will survive the ownership of the Real Property. The Applicant will make the requirements above an integral part of any agreement to sell the Real Property. Binding on Heirs, Successors and Assigns. These commitments are binding on the owner of the Real Property, each subsequent owner of the Real Property, and each person acquiring interest in the Real Property, unless modified or terminated by the governmental authority authorized to modify. Recording. The undersigned agrees to record these commitments in the Office of the Recorder of Hamilton County, Indiana, upon granting of the approval of the project.
