5i. Docket No. 50-01 CA: 1437 Keystone Way Victory Beauty Systems
Petitioner seeks Commitment Amendment approval to permit an additional sign. The site
is located at 1437 Keystone Way, northwest of the intersection of North Keystone
Avenue (US 431) and East 1 16th Street. The site is zoned B-8/Business.

Petitioner seeks ADLS approval for a sign. The site is located at 1437 Keystone Way
East, northwest of the intersection of East 1 16th Street and North Keystone Avenue (SR
431). The site is zoned B-8/Business.
Filed by Kevin Miller of Action Sign Company for Victory Beauty Systems.
The applicant is requesting a commitment amendment to allow a sign to be located on the east
fayade of the subject building (see attached building elevation and landscape plan). When
originally approved, the applicant committed to forego signage in the proposed location to permit
another tenant space, without frontage on that side of the building, a sign located on the existing
extended wall of their space.
The proposal now includes landscape and fayade improvements (see attached) as well as a
commitment to upgrade the fayade of the western tenant space at a future date (see attached
commitments).
The committee forwards these items back to the full plan commISSIOn with a favorable
recommendation conditioned upon a maximum 24" sign, black reverse-channel letters, and a
maximum sign area as permitted under the Ordinance.
The Department is requesting that the applicant distribute revised color elevations of the facades
to the Plan Commission members at the meeting. These elevations should reflect the modified
sign height.
The Department recommends that the Plan Commission approve these two requests
conditioned upon the sign modifications recommended by the committee and the recording
of the attached commitment.

Commitments Attendant to
Commitment Amendment and ADLS Amendment Approval of
Docket Nos. 50-01 CA & 51-01 ADLS Amend
(1437 Keystone Way East, Carmel, IN 46032)
James F. Singleton (hereafter, "Applicant"), owner of the Real Property located at 1437 Keystone
Way East, Carmel, Indiana, makes the following Commitments to the City of Carmel & Clay
Township Plan Commission:
Description of Real Estate:
See attached Exhibit A (hereafter "Real Property").
Statement of Commitments:
1. At such time as either
a) the current Tenant (Car-X Muffler & Brakes) renews its existing lease and
consents to the exterior remodeling, or
b) a new Tenant and/or Tenants enters into a lease
for all or part of the 7200-square-foot western section of the Principal Building
located on the Real Property, the Applicant shall submit an ADLS Amendment
application to the Director of the Department of Community Services for approval
by a committee of the Carmel/Clay Plan Commission.
2. The Architectural Design of the aforementioned western section of the Principal
Building shall be in compliance with the ADLS Amendment approval granted by the
Carmel/Clay Plan Commission per Docket Nos. 50-01 CA & 51-01 ADLS Amend.
3. The Applicant understands that the representations made above will survive the
ownership of the Real Property. The Applicant will make the requirements above an
integral part of any agreement to sell the Real Property.
Binding on Heirs, Successors and Assigns. These commitments are binding on the owner of the
Real Property, each subsequent owner of the Real Property, and each person acquiring interest in the
Real Property, unless modified or terminated by the governmental authority authorized to modify.
Recording. The undersigned agrees to record these commitments in the Office of the Recorder of
Hamilton County, Indiana, upon granting ofthe approval of the project.
Enforcement. These commitments may be enforced by the Carmel/Clay Plan Commission, the
Department of Community Services, and/or the City of Carmel, Indiana.
