HomeMy WebLinkAboutDepartment Report 09-26-221 of 12 CARMEL BOARD OF ZONING APPEALS | HEARING OFFICER DEPARTMENT REPORT MONDAY, SEPTEMBER 26, 2022 (V) College Park Church Pavilion Height Variance. The applicant seeks the following development standards variance approval: 1. Docket No. PZ-2022-00133 V UDO Section 2.04 Maximum 18-ft accessory structure height allowed, 19’ 8-3/4” requested. The site is located at 2606 W. 96th Street and is zoned S1/Residence. Filed by Marcos Rodriguez of Aspen Group on behalf Bruce Smith & College Park Church. General Info & Analysis: The Petitioner seeks approval of new 5,200 square foot semiprivate outdoor pavilion on the north side of the property for the church. It will be located more than 600-ft away from Towne Rd. Variance approval for the height of the accessory structure is requested. The maximum allowed building height for an accessory structure is 18 feet. The height proposed is 19-foot and 8-3/4 inches. This is a variance of 1-foot and 7-1/4 inches. (Special Use Amendment approval is not needed for this project, as it falls under the 10% expansion threshold.) Please see the Petitioner’s info packet for more detail on the variance request. Lubavitch of Indiana place of worship is located to the west, single family homes are located to the east and north, and North Pointe Bay residential community is located to the south. The pavilion exterior will be comprised of a stone veneer base, horizontal cedar wood lap siding, glass windows and doors, and an architectural shingles roof. The pavilion will be located in the northern quadrant of the site. This project is also being reviewed by the Technical Advisory Committee (TAC) for technical aspects of the site, such as for utilities, grading, drainage, fire/safety, etc. The project is still being reviewed by the TAC Members, and if the variance is approved a condition of approval should be added that the Petitioner addresses any remaining review comments before a building permit is granted. The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance request with condition listed below. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00133 V, with the condition of the Petitioner addressing all remaining TAC review comments before a building permit is approved, and with adoption of the Findings of Fact submitted by the Petitioner.
