(V) Cooper Pool Equipment Setback Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2022-00174 V UDO Section 5.02.C.7 Minimum 10-ft side yard setback for
pool pump equipment; 6-ft requested.
The site is located at 12111 Castle Row Overlook (Brookshire Subdivision, Lot 92.) It is zoned
R1/Residence. Filed by Mark Cooper, owner.
General Info & Analysis:
The Petitioner seeks approval to install a swimming pool and decking in the backyard of their lot. The Petitioner
would also like to place the pool equipment at the side of the house, which will make it located 6-ft from the
side property line rather than the required minimum 10 feet. This is a variance of 4 feet or 40%. Please see the
Petitioner’s info packet for more detail on the variance requests.
The Brookshire Subdivision Homeowners Association is supportive of the project. The neighbor closest to the
pool equipment has signed a statement that they do not oppose its proposed location.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00174
V, and with adoption of the Findings of Fact submitted by the Petitioner.
