CARMEL BOARD OF ZONING APPEALS | REGULAR MEETING
DEPARTMENT REPORT
MONDAY, SEPTEMBER 26, 2022
(V) Napleton Genesis of Carmel Sign Variances.
The applicant seeks the following development standards variance approval:
1. Docket No. PZ-2022-00123 V UDO Section 5.39.H.2 - 1 sign allowed, 4 signs requested.
2. Docket No. PZ-2022-00138 V UDO Section 5.39.H - Signs must face a street frontage
(east); Signs facing south requested. The site is located at 4240 E. 96th Street. It is zoned B3/Business
and is partially in the SFHA/Special Flood Hazard Area. Filed by Rick Lawrence of Nelson &
Frankenberger LLP on behalf of EFN Crossroads Property, LLC.
General Info & Analysis:
The Petitioner proposes to construct a new auto dealership on a pad ready site previously approved. All parcels
to the west, south, and east are also zoned B3/Business and are not in an overlay zone. To the north is the
Williamson Run subdivision, zoned S2/Residential. Two BZA variances for signage are being sought, for total
number and for sign orientation. Please see the Petitioner’s info packet for more detail on the variance
requests.
The Plan Commission approved Docket No. PZ-2022-00073 ADLS: Genesis Auto Dealership at their June 21,
2022 Carmel Plan Commission meeting. The site plan, landscape plan, lighting, architecture, signage design,
and more were reviewed and approved.
This site has one public street frontage, which is Randall Drive to the east; therefore, only one sign is allowed.
Three wall signs are proposed to face south towards Randall Drive (and 96th Street further south). These are a
logo sign, the name “Genesis of Carmel,” and a “Service” sign. A ground sign is also proposed at the entry from
the connection to the other dealerships to the south. Four proposed signs require variance approval for
exceeding the number of signs allowed. And signs facing south (rather than east) also requires variance
approval.
The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports the
variance requests.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket Nos. PZ-2022-00123
V and PZ-2022-00138 V, with adoption of the findings of fact submitted by the Petitioner.
