Our previous recommendation regarding the pavement radius was made relative to bus service for any Carmel Schools' students residing along Carwinion Way. With the smaller radius, our large bus may not be able to make a turn-around at the cul-de-sac. Our recommendation was made because of the length of the cul-de-sac and our desire to limit the walk distance to bus stops. It is likely that students will need to walk out of the cul-de-sac to the intersecting street. Allowing buses to enter the cul-de-sac and then have to do a turn-around involving backing up presents an unsafe condition. If you have any further questions, please feel free to contact me. I took the lib- erty of writing you rather than calling you, which I am sure you appreciate. I am positive you will be diligent in your discussion and debate on this issue and I am sure you have feelings on whether this road should be closed or not. I am sure there are issues like com- munity planning, safety, traffic flow and security that need to be dealt with, but I think all of those issues are mute at this point. The proposed road is a county road and the county commissioners voted 3 to 0 to close this road. They discussed all the same issues and their highway engineer didn't like closing the road either, but they voted to do it anyway. Closure of this road was part of a deal which was struck between the Ashbrooke Homeowners and the commercial developers, with the knowledge of the administration and the county commissioners. The commercial prop- erty is now built up and the other half of the deal is still in limbo. I am asking you to complete the deal. While it is always best to discuss and debate these issues with consideration of the big picture, we all know that sometimes zoning and development becomes more of a quilt and less of a bed- spread. If you had the opportunity to consider the development of the platted subdivision (Ashbrooke) at the same time you were looking at the commercial property along Michigan Road, you could have come up with a plan that could have prevented this problem. As you know the residential development was there first and the commercial development was the result of changes and negotiations on a myriad of issues. I am asking you to vote in favor of this proposal to close the road because we need to protect the integrity of the residential neighborhood. Keep commer-ecial traffic commercial and residential traffic residential. Thank you for your consideration. Regardless of the way you vote, I am 100% sure that you will do what you think is best for our community. Mike Hollibaugh 06/13/2001 at 3:03:54 PM From: Pages: Mark Rattermann 2 (including Cover) Mark APRIL 17,2001 Carmel/Clay Plan Commission Agenda u u Docket N. 58-01 PP Amend (Primary Plat Amendment) West Carmel Center - Block G The site is located southeast of West l06th Street and North Michigan Road. The site is zoned B-3/Business and is located within the US 42l/Michigan Road Overlay Zone. The petitioner also seeks approval of the following Subdivision Waivers: 58-01a SW SCO 6.3.7 >600' cul-de-sac 58-01b SW SCO 6.3.5 connection of stub street Filed by Kevin D. McKasson of Glendale Partners. Please find attached a letter from Mark Rattermann attached. In response to the letter the Department has the following observations: 1. The letter indicates that the closing the street off was part of a deal struck between the Ashbrook Homeowners and the commercial developers. He asks that the plan commission complete the deal. The Department is not aware of a "deal" that was struck between the residents of Ashbrook and the developers of the commercial portion of this development. Regardless, the Plan Commission is not bound by any such agreement between third parties. 2. Mr. Ratterman indicates that if the Plan Commission had the opportunity to consider the development of the platted subdivision (Ashbrook) at the same time as the commercial area they could have prevented this problem. He states that the residential area was there first and that the commercial development was the result of negotiations on a myriad of issues. In fact, as the Department has shown through researching this request, the Plan Commission did consider this very issue in 1990 when the development was proposed. Both commercial and residential portions were filed as one petition (please see information contained n the Department Report). Over the last ten years the Plan Commission has take action on over a dozen petitions within this development. All were designed based on the layout of the original development including the connection. In addition, the Ashbrook development would not have been permitted to develop in the manner that it has without the connection of the two streets in question. 3. Mr. Rattermann asks that the Plan Commission to vote in favor of the proposal to close the road and protect the integrity of the residential neighborhood. The Department assumes that Mr. Rattermann bases this request on the statements made in his letter. The Plan Commission should be aware that the facts of this matter vary greatly from the statements made by Mr. Rattermann (please refer to the meeting minutes and information contained in the Department Report). The Plan Commission has maintained the integrity of the Ashbrook neighborhood and there own over the last ten years in the decisions made concerning this development. Fot the past year. the Ashbtooke HOA has been working with Kevin McKasson of Glendale Partners with respect to the development of the real estate ditectly west of Ashbrooke. Throughout theSe discussions (6%St with the Meijer project and now with Tas:get) agreements were reached with Mr. Mc:Kasson regarding the treatment of the bolder with Ashbrooke. These were agreements and commitments tegmJing landscaping, building/~oading positioning and lighting an of which were incorporated into the development plans approved by CaDDeL Igj 002 u "0 October 27. 2000 Deu Ashbtooke Resident Mr. McKasson made another commitment related to the development of the property tegmJing ttaffic. The Ashbrooke HOA ~ a deep concem fot safety and heavy ttaffic should Canvinion Way be connected to Commerce Drive. Commerce Drive is the road which connects with 1()6Ch. the existing retail center and with Tuget (and Home Depot if it is approved). The amount of "cut tJu:ougb" traffic generated by the existing retail center. Tuget, Marsh and the other retail north of 106lh (and possibly Home Depot) would have a negative effect on OUt community. Consequently. the Ashbrooke HOA requested Mr. McKasson not connect with Cuwinion, but' rather, make Carwinion Way a cul-de-sac (with the cul-de-sac on 1\1&. McI<asson's property). Mr. McKasson agreed that he would pursue approV'lll for modifying Catwinion Way to a cul-de-sac. Further. he agreed that he would pay for all the improvements and maintenance associated therewith including the insullation of au emergency access (crash gate with pavers) way for .fire. police and ambulance; and, pedestrian and bike access for the residents of Ashbtooke. Well, Mr. McKasson did petition the Hamilton County Commissioners for approval to create a cul-de-sac at the end of Carwinion Way. The issue was heard October ,nod. The commissioneIS tabled the request until their November 141b meeting at which time they will resume discussions on the matter. They tabled the matter W2S pending submission of some additional information. Mr. McKasson will provide the commissioners with documentation showing the support of the public safety and school co:cpomtions. The commissioners also asked to have documentation showing the support of the Ashbrooke homeowners who will be most direcdy affected by the creation of the cul-de-sac, those homeowners living on west Cuwinion Way Qots 91 -122 and lots 81 - 90). This would solve the problem if !here is a need to trevelliam Commerce Drive to Sbelbome Road by the appropriate commercial route soulb of aUf development, nat on a residential street. Dr. Dugan stated to the south oC our neighbarllood Is a development called Spring Arbor, which was not originaJly planned when OUf neighborhood was platted. There Ia secondary egress amIable to Shelborne Road through Spring Arbor. Tho only reason this back entrance existed was 10 provide sccess when there was a plan Cor this to be one subdivision. Thet changed when Bstridge purchased the land liam Brenwick. The back en~ is DO longer desired or required. For safety concems on Carwinion Way, Cor the children whD play in the neighborbaod, for tile excessive speeds cutrerltly being seen and echoed in the Westin development to the DOrth, we are liking to consider this request. Mr. McKasson stated they bave worked extensively with the neighborhood groups and they are committed to pay for the cul- de-sac on Carwinion and to make sure it is designed Cor ac:cessability to emergency vehicles. Mr. Locke stated the Highway Department has expressed it's apposilian to this requeBlliam the first lime Ihey attended T AC. The Highway Department feels it is important to keep this opening to the subdivision. We would have not allowed the subdivision to go In if Carwinlon Way was to be a c:uJ.dHac. It is not only because it Is a second entranc:e, but It is so Cu back to these houses. We have not seen a position Crom the school corporation or the fire departmellt. It is Important to keep the Inner connectivity between the subdivisions and our collector, primary and secondary roadL Speed Ihrough the subdivisions is a concem, but we bave found that it Is nol from people traveling through the subdivisions II much as it is residents of the subdivision who bave to travel so far to get out oC the subdivision: Dr. Dugan slated we can nol draw comparisons to people thet are connecting between subdivisions In the middle of residential communities surrounding golf courses. Bveryone would agree thet lraftic generated in lhase areas would be substantially different liam tile type of COIIIIIlCICiaI we are talking about at the back side of Ashbrook. The people that want this most are the people who live on the westem portion ofCarwlnion Way, who are !he most affected. They will have the most trBvellssues wi!hln the nelghbamood. There are 120 lolll in the neighbarllood and Ihere is one Individual in the neighborlload that Ceels this should not " happen. The neighbors are concerned about safety and the lraffic generated by Tqet and Honia Depot. Mr. Locka sl8ted we often stub streets out, which are very herd to get those conilected aner the fact. This Is one Df those c:ases that we had It stubbed out and connected through prior to people pun:haslng homes In the subdivision. It has been 2.Oned commercial Cor a long time and they were very aware of what It was connected to. Everyone bad substantial notice end If !hey thought It would be a problem !hey would have taken It into consideration when they purchased their properties. Holt slated on prior instances when the Board ofCommiaianers have considered cuJ.do.sacs, we have always had thO CODCurrellce of the schaDI district and fire department. Have Ihose concurrences been requested? Dr. Dugan stated he was not aware that there was a school issue. He does not see file 8S a substantive issue because the new fiI8 station will be on the norCbwest comer of 106!h Street and Shelbome. He could not imagine a fiI8 truck going Dver to Commerce and coml1l& io the back side of the neighborhood rather than coming atreight down Shelborne. Halt stated the woe is whether the rue truck can set In and out of the cul- de-sac. IClt can't" get in and out, then are the hoses long enDugh to park at the end aC the" street? Dr. Dugan stated Ihere is not enough real estate within Ashbrooke to db the cul-de-sac. The actuaJ cul-de-sac will be beyond the Ashbrooke limit in the commen:iaJ area. Mr. McKasson staled they have agreed to work with the fire department and all other safely agencies to deslgIi'the cul-de-sac so It can be accessed by emeIllency vehicles. It will be paved and win hava a crash gate. Holt asked ICthe fiI8 department has agreed to work 2 1aJ00l .;-" 'i 15:07 FAX HAMILTON CO HWY. 1aI002 u u HAMILTON COUNTY BOARD OF COMMISSIONERS OCTOBER 23,2000 with you? Mr. McKasson 8l8l1ld the fin: department was at the TAC meeting when it was dlseussecl, we don'l have their ap:emcnt, bul we lIIll planning on working with them and this would be contingenl upon their IIJIproval. Holl asked what about the schools? Mr. McKesson stated we have DOl met with CannellClay Schools. If you would liM us 10 do that we will. Dr. Dugan ItalIld the school bus does DOt currently use the street IIOW. Dillinger uked how do you mpond 10 Mr. Locke's point that the subdivision was approved this way and you knew it was there when you bought it? Dr. Dugan statcd be can ooIy speak to his own lot purchuas, when be bouaht his two lots he looked ClIIll1Wly into the zoning. Then: Is a difl'cJencc in zoning cast and west of Commcrca and there hu been confusion to homeowners about that. Then: was not a reaJlty of this size of dewlopment to people until we saw Marsh being buill on the northeast comer and Village Pantry and the first part of West Cannel Center being developed. The traffic generated by Blockbuster, Village Pantry and Marsh is what got tha neighbor'l8Itention. We lllUllelllateIy entenld into a productive dialogue with Mr. McKasson. We reaJiD that there was a lot of reaJ estate and it was going to be developed. It Is being developed In a first nte way, but it does DOl a1ll1Yiate the safety conccms. We have been pro-ective about this. We have been working with the dewlopen to solve a nelgbbozhood plVblem. Mr. McKasson stated there will be a tnff'1C lighl at SR 421. Mr. McKesson slated their concern is that thay do not want to create traffic through the nelghborbood. People going cast may use the neighborhood u a shortcut, which we feel il inappropriate. Holl stated assuming you complete tha road to the south you would sel to 96th Street with a light? Mr. McKassoca SIaIed that is beyond their control. They are DOt dewloplng to thaI poinl, other developerll will at some point. When il gets 10 Ihat point, il is questionable when thaI can happen. II will require tha counly to condemn existing houses. Mr. Locke recommended that it would be best at this time to lcave il cormectcd end see whal happens once il opens up with a. commltmenl ftom tha developer 10 Distall the cuI-dc-SIIC if it does nol work out. Ript ~w we wanl to do a replal to IlUIb sure we have the riaht-of-way to in8l811 the cul-de-sac because il will not filin tha existing right'Of.way. No one knows for lure if il wllllncreue traffic or be a safety issue. He would nol wanllO limll mobility, eapeclally for tha neighbors on tha far inside of the cul-de-sac. Clark stated she fails to see tha maybe's. It is a definite, having just deall with Brighton and Dorset. That is snother exsmpJe where you are tying COIIIII1etCiaIIO residential and il is IOlally different scenario than tying residential to residentisl. Clark 8l8ted for her to actively support an opportunity for commerciallnffic to move Ihrough s residentiallllll8 is unthinkable. Mr. Locke stated it is different, Brighton and Dorset had the main anerial RI8lI coming dinct1y into lhe enlnnce oftbe subdivision, lined up with It. There was no jog. Clark SIaIed to her it ilan anaIogill situation, Meridian Corridon Boulevard was not finished, II was 10 be finished when tha commercial development camc in, which Is a similar situation to what we have done here. Once tha RI8lIIs In then the co_IaI traffic hu someplace to go. Mr. Steve Van'Soulen; stated he currently lives In the WestIns, which is a mirror Image of this situation 10 the north. The Westin's hu a simiJar road to Ashbmoke thaI runs li'om 106th Street to Shelbome. Then: have been traffic studies done of over 1,000 can, using th&t southern exll of the West1ns. The Carmel Police Departmenl hu clocked speeds at 45 mph and 55 mph going through there. It is not an isSue of maybe, it is an issue of when and how many. The Westins' Homeowners AssocIation has worked with the county highway department to get crosswslks and puk signlinstslled to slow people-down. Mr. Locke stated even in subdivisions Ihal don'l have this kind ofsccess, we still clock speeds at 45 mph to 50 mph. To think putting In a cuI-dHac is going 10 reduce speeds does nol happen. Holl uked what docs non action today do? Mr. McKasson stated we will continue 10 develop the Target store, which will open next swnmer. We will continue to lry and get approval for Home Dc/lOt. There Is an additional six _ between Target and our other clevelopment, where the actual cul-cle-sac will be. We don'l want to come back to the commissioners and 88Y il is necessary because someone hss been Il\Iured li'om someone cuIIlng through a neighborhood. We are committed on following up on this 1S8IIC. Holl818ted It is inconc:elvable that a scbool bus would pull aU the way In and back all the way oul or a fire truck would wanl to pull slJ tha way in and back all Ihe way out. II is critical that you gel a sign-off' fiom the scbool district and the fue dcpsrtment. Mr. McKuson 8l8ted the design of the cul-de-sac will allow' for school buses to turn and emergency vehicles to access through the crash gate and we would maintain those facllltles. Mr. Van SouIen 8l8ted one RlI80n the reaJ estate is tighl is that there are four or live different pipeline euements that are cutting through here. The cul-dwsc will be designed u big es he can within the limits ofthe pipeline agreements. Mr. Loc:ke asked If the commissionen 8Ie considering this he would request thay provide the county with a dl'llWing ofwhal they are pllllllling and the essemenls and what can be constructecL We don'l wanllO approve something thaI can'l be builL Mr. Locke stated you.may want to uk for the people living in tha back section to sign off. Mr. McKasson 8l8ted they would meel with tha school district and safety agencies u well u a sign off fiom tha m:Ighbors. Mr. VanSoulen 8l8ted we have supported slJ this developmenl with lhis condition, !be longer this decision gets put off, il will be too late once Homc Depol is builL This is his one chance to get this done. Holt statcd it would be helpJ\ll for tha school S)'Sk:III and the fire . departmenl if you can show them the cul-de-sac design. Mr. Locke SIaIed typieally there are pJans that show exsct1y what will go in and they normally send the highway department a letter ltatiog thaI cIon't object or !bey ap:e with tha plan u drawn sO everyone is sware of what il is. If all of those things can be taken care of, II would be helpJ\11. II would also be helplW that each resldenl sign something stsling that they are aware that this Is being built and the school corpontion will nol send a bus back there and they understand the fire Issues. Mr. Locke asked Mr. McKesson to get the design to the highway clepsrtmenl first so we can review il. Bunoughs &: Associates met with the atTocted property owners in Village Farms subdivision on Monday, November 6, 2000. We presented three options for a ocmc:n:te screening wail along 146lb Street. The unanimous decision was for Option 113, which builds the waIl higher with sections of the waU varying between 7 and 9 feel Drainage fiom the yards will continue to flow towards 146lb Street. Option ##1 is approximalely $49,000 to regrade everything back from curb. We would get inlo some landscaping thaI Wll had previously said Wll would avoid. The prices were nol on the sheets thai were shown the homeowners. Clark asked how close does this come 10 whal the homeowners originally expected? Mr. Neal staled with Option 113 Wll will be at the IoWllst point, leas than I' below 8'. AU oftheae measurements are fiom the road at II's hlghesl point. All of ihe homes will have at least 7', some will have in the area of 7' 10 9'. HoII asked what i. the difference bet_ Option #/1 and Optioo i#2, what iJ Option 1#2 accdmpJishing? Mr. Gray stated bls original thoughl was Option 1#3, when we saw Ihe costs WI decided 10 pUlllUll oIher options. Option III Is a good design because It would be easy to construct and have a regular height wall aU the way Ihrough. Option 112 was developed as a combination of Option '1 and 113, where if we could provide at least 7' of the wall-we would aalislY Ihe homeowners. The difference between Option III and 112 Is thai tho grading work will be more difficult with Option 112. Holl asked if there Is room for landscaping between the wall and the recreation path? Mr. Gray stated yea. If the conunlssloners want to do thallI could be IICCOmpJished. Indianapolis, IN 46205-2998 bear Ms. Buckley, ThIs letter is In response to the meeting we had on Friday November 31d regarding the placement of the cul- de-sac at the end on Carwinlon Way in the Ashbrook Subdivision. Although this wUl greatly increase the overall length of the cul-de-saC well beyond allowable standards, It has been agreed upon that It would be acceptable with the following provisions. The Installation of a surface or slib-surface weight bearing system capable of supporting fire fighting apparatus for emergency access connecting to Commerce Drive. We also would require that any means of barricading this emergency access from Commerce Drive to Carwlnion Way be removable In nature, allowing the .fire department access and that no permanent fence, wall.or other . barricade be erected that would not allow for .emergency access. It .is also understood that this access portion between Commerce Drive and Carwlnion Way must be maintained as a passable emergency entrance point at all times. - With the above noted requirements met, It Is the opinion of our office that the creation of a cul-de-sac at the end of Carwinlon Way would meet with our approval. J ett American Consulting, Inc. 4165 Millersville Road Indianapolis, IN 46205 RE: West Carmel Center - Block G, Primary Plat Amendment & Subdivision Waivers Dear Mr. Jett: This letter is in response to your Primary Plat Amendment and Subdivision Waiver filings for West Carmel Center - Block G. I have reviewed the Primary Plat Amendment and Secondary Plat applications. The following comments need to be addressed and plans updated accordingly: Comments on Primary Plat, Subdivision Waivers & Construction Plans: 1. The Department would like to see the size of the cul-de-sac reduced to a right-of-way radius of 50 feet and pavement diameter of76 feet. I believe this will also help to satisfy Panhandle Pipeline Company and their concern of the pavement being over their easement. 2. Show continuation of sidewalk, both sides of drive. 3. Please provide a Traffic Impact Analysis to display the distribution of traffic through the subdivision, with and without the cul-de-sac. This is necessary to verify or substantiate any claims regarding additional traffic in the residential area. 4. Identify both pipeline easements on the plans. Secondary Plat: 1. Revise Legend to add length of markers on legend, as required under Section 8.2 of the SCO.2. 3. Provide a key Map on the face of the plat. 4. Provide Primary Plat, Primary Plat Amendment and Secondary Plat Docket Numbers on the plat. 5. Change Name of Director of Community Services to Michael P. Hollibaugh. 6. Place Commission Certificate on opening page. 7. Submit a copy of the covenants and restrictions. 8. Provide Name, address and phone number of Owner, subdividor, and Surveyor Please submit a revised Primary Plat with the above-mentioned changes/additional information. Once these changes have been made, comments addressed, and additional information provided the Primary Plat will be placed on the next available Plan Commission Agenda. It has been tentatively placed on the June 19,2001 agenda. If you have any additional questions please do not hesitate to call. 2.=; L · .~ /i~: C. Jett "\ 1,2001 Carmel/Clay Plan Commission Agenda u Q Docket N. 58-01 PP Amend (Primary Plat Amendment) West Carmel Center - Block G The site is located southeast of West l06th Street and North Michigan Road. The site is zoned B-3/Business and is located within the US 421/Michigan Road Overlay Zone. The petitioner also seeks approval of the following Subdivision Waivers: 58-01 a SW SCO 6.3.7 >600' cul-de-sac 58-01b SW SCO 6.3.5 connection of stub street Filed by Kevin D. McKasson of Glendale Partners. Please fmd attached a letter from Mark Rattermann attached. If you had the opportunity to consider the development of the platted subdivision (Ashbrooke) at the same time you were looking at the commercial property along Michigan Road, you could have come up wi1h a plan that could have prevented this problem. As you know the residential development was there first and the commercial development was the result of changes and negotiations on a myriad of issues. I am asking you to vote in favor of this proposal to close 1he road because we need to protect 1he integrity of 1he residential neighborhood. Keep commer- cial traffic commercial and residential traffic residential. Thank you for your consideration. Regardless of the way you vote, I am 100% sure that you will do what you think is best for our community. Kerry Buckley, EI American Consulting Engineers, Inc. 4165 Millersville Rd. Indianapolis, IN 46205-2998 Dear Ms. Buckley, This letter is in response to the meeting we had on Friday November 3rd regarding the placement of the cul- de-sac at the end on Carwinion Way in the Ashbrook Subdivision. Although this will greatly increase the overall length of the cul-de-sac well beyond allowable standards, it has been agreed upon that it would be acceptable with the following provisions. The installation of a surface or sub-surface weight bearing system capable of supporting fire fighting apparatus for emergency access connecting to Commerce Drive. We also would require that any means of barricading this emergency access from Commerce Drive to Carwinion Way be removable in nature, allowing the fire department access and that no permanent fence, wall or other barricade be erected that would not allow for emergency access. It is also understood that this access portion between Commerce Drive and Carwinion Way must be maintained as a passable emergency entrance point at all times. With the above noted requirements met, it is the opinion of our office that the creation of a cul-de-sac at the end of Carwinion Way would meet with our approval. Should you have any further questions or concern, please contact our office. hPeclfullY, Hf ~~ Fire Marshal Carmel Fire Prevention Bureau Cc: Steve Broermann, Hamilton County Highway Department Lawrence Lillig, Department of Community Services file (2) Fire Prevention Saves Lives and Property
