This letter is in response to your Amended Secondary Plat filings for the following:

2. Add addresses and phone numbers to all "Owners" notations, sheet one.
3. Add addresses and phone numbers to the "Subdivider" notation, sheet one.

Please submit revised Secondary Plats with the above-mentioned changes. Once these changes have
been made and comments addressed, please produce a mylar copy for signature by this Department. Two
paper copies of each plat must be filed with the mylar prior to recording. I will return the signed mylar to
you for signature by the County Commissioners. Once recorded, our Department needs three paper
copies and a mylar of each recorded plat. Our approval of the secondary plat (signature) will be
forthcoming upon revision of the plans according to the items listed above.

We have received your comments dated October 15, 2001, and have revised the
Secondary Plat For Block G accordingly. Below is a list of your comments followed
by the action taken on each comment.
1. Revise Legend to add length of markers as required under Section 8.2 of the
SCO.
The legend has been revised as requested.
2. Provide address and phone numbers for Owners.
The address and phone numbers for the owners have been added to the
plat.
3. Label Carwinion Way on Plat.
Carwinion Way has been labeled on the plat.
4. Change "Adopted by the Plan Commission on ..." in commission certificate
to read as follows: Granted Administrative approval by the Department of
Community Services pursuant to Article XI of the Carmel/Clay Plan
Commission's Rules of Procedure on
The text in the commission certificate as been revised as requested.
5. Add Subdivision Waiver Docket Numbers 58-0Ia SW and 58-0Ib SW next to
PP Amend docket number.
The Subdivision Waiver Docket Numbers have been added to the plat.

The technical review and comments are intended to evaluate the completeness of the erosion and sediment control plan for the
project, The erosion and sediment control plan submitted was not reviewedfor the adequacy of the engineering design. All
practices included in the plan, as well as those recommended in the comments should be evaluated as to their feasibility by a
qualified individual with structural practices designed by a qualified engineer. The plan has not been reviewedfor local, state,
or federal permits that may be required to proceed with this project. Additional information, including design calculations may
be requested to further evaluate the erosion and sediment control plan.
The erosion and sediment control plan has been reviewed and it has been determined that the plan:
X Satisfies the minimum requirements and intent of 327IAC 15-5 (Rule 5). Notification will be forwarded to the
Indiana Department of Environmental Management.

Proper implementation of the erosion and sediment control plan and inspections of the construction site by the developer or a
representative are necessary to minimize off-site sedimentation. The developer should be aware that unforeseen construction
activities and weather conditions may effect the performance of a practice or the erosion and sediment control plan. The plan
must be a flexible document, with provisions to modify or substitute practices as necessary.

Dear Jon,
The Panhandle Eastern Pipeline has expressed a concern regarding the proximity of
the proposed cul-de-sac and 15-foot drainage and utility easement to the existing
pipeline. Therefore, the proposed cul-de-sac (including the 15-foot drainage and utility
easement) has been moved approximately 25 feet towards southeast to avoid
encroachment within the existing Panhandle Eastern Pipeline's easement. Equilon
(former Shell Pipeline) has already approved this revised layout (see the attached
letter).
We are sending you one (1) set of the revised primary plat! construction plans for your
review and approval.

Dear Mr. Fetahagic,
I have received and reviewed the revised drawings for the project referenced above.
Our previous recommendation regarding the pavement radius was made relative to
bus service for any Carmel Schools' students residing along Carwinion Way. With the
smaller radius, our large bus may not be able to make a turn-around at the cul-de-sac.
Our recommendation was made because of the length of the cul-de-sac and our desire
to limit the walk distance to bus stops. It is likely that students will need to walk out of
the cul-de-sac to the intersecting street. Allowing buses to enter the cul-de-sac and
then have to do a turn-around involving backing up presents an unsafe condition.

I will be in Minnesota next week when you will be debating and voting on 1he closure of a road in
Ashbrooke Subdivision, 1herefore I will not be able to speak to you at 1he hearing. I took the lib-
erty of writing you rather than calling you, which I am sure you appreciate.
I am positive you will be diligent in your discussion and debate on this issue and I am sure you
have feelings on whether this road should be closed or not. I am sure there are issues like com-
munity planning, safety, traffic flow and security that need to be dealt with, but I think all of those
issues are mute at this point. The proposed road is a county road and the county commissioners
voted 3 to 0 to close this road. They discussed all the same issues and their highway engineer
didn't like closing the road either, but they voted to do it anyway. Closure of this road was part
of a deal which was struck between the Ashbrooke Homeowners and the commercial developers,
with the knowledge of the administration and the county commissioners. The commercial prop-
erty is now built up and the other half of the deal is still in limbo. I am asking you to complete the
deal.
While it is always best to discuss and debate these issues with consideration of the big picture, we
all know that sometimes zoning and development becomes more of a quilt and less of a bed-
spread. If you had the opportunity to consider the development of the platted subdivision
(Ashbrooke) at the same time you were looking at the commercial property along Michigan Road,
you could have come up with a plan that could have prevented this problem. As you know the
residential development was there first and the commercial development was the result of changes
and negotiations on a myriad of issues. I am asking you to vote in favor of this proposal to close
the road because we need to protect the integrity of the residential neighborhood. Keep commer-ecial traffic commercial and residential traffic residential.
Thank you for your consideration. Regardless of the way you vote, I am 100% sure that you will
do what you think is best for our community.

The petitioner also seeks approval of the following Subdivision Waivers:

Please find attached a letter from Mark Rattermann attached. In response to the letter the
Department has the following observations:
1. The letter indicates that the closing the street off was part of a deal struck between the
Ashbrook Homeowners and the commercial developers. He asks that the plan
commission complete the deal. The Department is not aware of a "deal" that was
struck between the residents of Ashbrook and the developers of the commercial
portion of this development. Regardless, the Plan Commission is not bound by any
such agreement between third parties.
2. Mr. Ratterman indicates that if the Plan Commission had the opportunity to consider
the development of the platted subdivision (Ashbrook) at the same time as the
commercial area they could have prevented this problem. He states that the
residential area was there first and that the commercial development was the result of
negotiations on a myriad of issues. In fact, as the Department has shown through
researching this request, the Plan Commission did consider this very issue in 1990
when the development was proposed. Both commercial and residential portions were
filed as one petition (please see information contained n the Department Report).
Over the last ten years the Plan Commission has take action on over a dozen petitions
within this development. All were designed based on the layout of the original
development including the connection. In addition, the Ashbrook development would
not have been permitted to develop in the manner that it has without the connection of
the two streets in question.
3. Mr. Rattermann asks that the Plan Commission to vote in favor of the proposal to
close the road and protect the integrity of the residential neighborhood. The
Department assumes that Mr. Rattermann bases this request on the statements made
in his letter. The Plan Commission should be aware that the facts of this matter vary
greatly from the statements made by Mr. Rattermann (please refer to the meeting
minutes and information contained in the Department Report). The Plan Commission
has maintained the integrity of the Ashbrook neighborhood and there own over the
last ten years in the decisions made concerning this development.

Fot the past year. the Ashbtooke HOA has been working with Kevin McKasson of Glendale Partners with
respect to the development of the real estate ditectly west of Ashbrooke. Throughout theSe discussions (6%St

Mr. McKasson made another commitment related to the development of the property tegmJing ttaffic. The
Ashbrooke HOA ~ a deep concem fot safety and heavy ttaffic should Canvinion Way be connected
to Commerce Drive. Commerce Drive is the road which connects with 1()6Ch. the existing retail center and
with Tuget (and Home Depot if it is approved). The amount of "cut tJu:ougb" traffic generated by the
existing retail center. Tuget, Marsh and the other retail north of 106lh (and possibly Home Depot) would
have a negative effect on OUt community.
Consequently. the Ashbrooke HOA requested Mr. McKasson not connect with Cuwinion, but' rather, make
Carwinion Way a cul-de-sac (with the cul-de-sac on 1\1&. McI<asson's property). Mr. McKasson agreed that
he would pursue approV'lll for modifying Catwinion Way to a cul-de-sac. Further. he agreed that he would
pay for all the improvements and maintenance associated therewith including the insullation of au emergency
access (crash gate with pavers) way for .fire. police and ambulance; and, pedestrian and bike access for the
residents of Ashbtooke.
Well, Mr. McKasson did petition the Hamilton County Commissioners for approval to create a cul-de-sac at
the end of Carwinion Way. The issue was heard October ,nod. The commissioneIS tabled the request until
their November 141b meeting at which time they will resume discussions on the matter. They tabled the
matter W2S pending submission of some additional information.
Mr. McKasson will provide the commissioners with documentation showing the support of the public safety
and school co:cpomtions. The commissioners also asked to have documentation showing the support of the
Ashbrooke homeowners who will be most direcdy affected by the creation of the cul-de-sac, those
homeowners living on west Cuwinion Way Qots 91 -122 and lots 81 - 90). However. we ue gathering and
dO~)n1f'nti1lg the support of all Ashbrooke residents.
Consequently, accompanying is a. form for your signature. 'This Conn shows your knowledge and support of
creating a cul-de-sac at the end of Carwinion Way. Also included is a development plan for Target showing
where the cul-de-sac would be consttucted. Please retum the acknowledgment fom1 in to Dr. Michael

construction yet this fan. It is also Important to taxpayers in Hamillon County, because this development resides In the overlay district
an Michigan Road. Taxes generated In thet district go into a TIF fund which go back to directly support road Improvements in West
Clay. These funds will go specifically to 96!h Street road Improvements, which is relevant because the Thoroughfare Plan calls Cor
Comrneree Drive to connect to 96th Street and Shelbourne Road. This would solve the problem if !here is a need to trevelliam
Commerce Drive to Sbelbome Road by the appropriate commercial route soulb of aUf development, nat on a residential street. Dr.
Dugan stated to the south oC our neighbarllood Is a development called Spring Arbor, which was not originaJly planned when OUf
neighborhood was platted. There Ia secondary egress amIable to Shelborne Road through Spring Arbor. Tho only reason this back

are liking to consider this request.
Mr. McKasson stated they bave worked extensively with the neighborhood groups and they are committed to pay for the cul-
de-sac on Carwinion and to make sure it is designed Cor ac:cessability to emergency vehicles.
Mr. Locke stated the Highway Department has expressed it's apposilian to this requeBlliam the first lime Ihey attended T AC.
The Highway Department feels it is important to keep this opening to the subdivision. We would have not allowed the subdivision to
go In if Carwinlon Way was to be a c:uJ.dHac. It is not only because it Is a second entranc:e, but It is so Cu back to these houses. We
have not seen a position Crom the school corporation or the fire departmellt. It is Important to keep the Inner connectivity between the
subdivisions and our collector, primary and secondary roadL Speed Ihrough the subdivisions is a concem, but we bave found that it Is
nol from people traveling through the subdivisions II much as it is residents of the subdivision who bave to travel so far to get out oC
the subdivision:
Dr. Dugan slated we can nol draw comparisons to people thet are connecting between subdivisions In the middle of residential
communities surrounding golf courses. Bveryone would agree thet lraftic generated in lhase areas would be substantially different

live on the westem portion ofCarwlnion Way, who are !he most affected. They will have the most trBvellssues wi!hln the

happen. The neighbors are concerned about safety and the lraffic generated by Tqet and Honia Depot. Mr. Locka sl8ted we often
stub streets out, which are very herd to get those conilected aner the fact. This Is one Df those c:ases that we had It stubbed out and
connected through prior to people pun:haslng homes In the subdivision. It has been 2.Oned commercial Cor a long time and they were
very aware of what It was connected to. Everyone bad substantial notice end If !hey thought It would be a problem !hey would have
taken It into consideration when they purchased their properties.
Holt slated on prior instances when the Board ofCommiaianers have considered cuJ.do.sacs, we have always had thO
CODCurrellce of the schaDI district and fire department. Have Ihose concurrences been requested? Dr. Dugan stated he was not aware
that there was a school issue. He does not see file 8S a substantive issue because the new fiI8 station will be on the norCbwest comer of
106!h Street and Shelbome. He could not imagine a fiI8 truck going Dver to Commerce and coml1l& io the back side of the
neighborhood rather than coming atreight down Shelborne. Halt stated the woe is whether the rue truck can set In and out of the cul-
de-sac. IClt can't" get in and out, then are the hoses long enDugh to park at the end aC the" street? Dr. Dugan stated Ihere is not enough
real estate within Ashbrooke to db the cul-de-sac. The actuaJ cul-de-sac will be beyond the Ashbrooke limit in the commen:iaJ area.
Mr. McKasson staled they have agreed to work with the fire department and all other safely agencies to deslgIi'the cul-de-sac so It can

1,000 can, using th&t southern exll of the West1ns. The Carmel Police Departmenl hu clocked speeds at 45 mph and 55 mph going
through there. It is not an isSue of maybe, it is an issue of when and how many. The Westins' Homeowners AssocIation has worked
with the county highway department to get crosswslks and puk signlinstslled to slow people-down. Mr. Locke stated even in
subdivisions Ihal don'l have this kind ofsccess, we still clock speeds at 45 mph to 50 mph. To think putting In a cuI-dHac is going 10
reduce speeds does nol happen. Holl uked what docs non action today do? Mr. McKasson stated we will continue 10 develop the

ThIs letter is In response to the meeting we had on Friday November 31d regarding the placement of the cul-
de-sac at the end on Carwinlon Way in the Ashbrook Subdivision. Although this wUl greatly increase the
overall length of the cul-de-saC well beyond allowable standards, It has been agreed upon that It would be
acceptable with the following provisions. The Installation of a surface or slib-surface weight bearing system
capable of supporting fire fighting apparatus for emergency access connecting to Commerce Drive. We also
would require that any means of barricading this emergency access from Commerce Drive to Carwlnion Way
be removable In nature, allowing the .fire department access and that no permanent fence, wall.or other .
barricade be erected that would not allow for .emergency access. It .is also understood that this access
portion between Commerce Drive and Carwlnion Way must be maintained as a passable emergency
entrance point at all times. -
With the above noted requirements met, It Is the opinion of our office that the creation of a cul-de-sac at the
end of Carwinlon Way would meet with our approval.

In response to your comment letter dated May 18, 2001, concerning your review of
the Construction Plans for the above-referenced project these comments have been
reviewed and addressed as follows:
Comments on Primary Plat, Subdivision Waivers & Construction Plans:
Comment 1: The Department would like to see the size of the cul-de-sac reduced
to a right-of-way radius of 50 feet and pavement diameter of 76 feet.
I believe this will also help to satisfy Panhandle Pipeline Company
and their concern of the pavement being over their easement.
The Construction Plans have been revised to show a right-of-way
radius of 50 feet and pavement diameter of76 feet.
Comment 2: Show continuation of sidewalk, both sides of drive.
The proposed sidewalk on both sides of drive has been shown on
sheet C2.1.
Comment 3: Please provide a Traffic Impact Analysis to display the distribution of
traffic through the subdivision, with and without the cal-de-sac. This
is necessary to verify or substantiate any claims regarding additional
traffic in residential area.

Thank you for the opportunity to review the proposed development referenced above.
Per our discussion regarding the proposed cul-de-sac at the west end of Carwinion
Way, our department recommends a minimum radius of5011-O".. This allows buses to
make a turn around without doing any back up procedures and also not hit any curbside
improvements with the rear sweep of the bus. This number would need to be increased
if parking is allowed at the curb.

Dear Mr. Fetahagic:
This letter serves to acknowledge receipt of a transmittal containing the plans for the Carwinion Way
reconstruction. After reviewing the plans, the Highway Department has the following comments:
1. An Application for Project Review needs to be completed and the appropriate review fees for
a Construction Plan paid, before any approvals will be granted from this office.
2. A 15' Drainage and Utility Easement is needed behind the right of way of Carwinion Way.
3. A plan sheet detailing the Maintenance of Traffic will need to be included.
4. Please show additional curb elevations and flow lines on the plans.
5. The curb on Commerce Drive across the front of the emergency access lane will need to be roll
curb.
6. The asphalt path along Commerce Drive will need to be extended to the north right of way line of
Carwinion Way.
7. Some type of barrier is required across the emergency access point, to prohibit cut through
traffic.
8. Please note on the plans that all damaged SSD under the curb will need to be replaced.
9. Please show the existing right of way on Carwinion Way in the Ashbrooke Subdivision.
10. The pavement cut on Carwinion Way at the property line must be perpendicular to the curb.
11. The curb on Commerce Drive must be saw cut at the point of removal.
12. The street name sign and stop sign at the intersection of Commerce Drive and Carwinion Way
must be removed.
13. A NO OUTLET sign will need to be installed in Ashbrooke Subdivision at the west side of
Terwithen Lane and Carwinion Way.
14. A Maintenance of Traffic Plan is needed for the construction of the cul~de-sac and removal of
the existing pavement.
15. Any utilities that need to be relocated will be done so at the developers expense.
16. Plans will need to be submitted to the Hamilton County Surveyor's Office for review.
17. Please note that further comments may apply at a later date.

1. This project involves the reconstruction of the Crooked Creek Regulated Drain,
therefore, a Petition for Relocation and Reconstruction is required. A petition Conn
has been included.
2. A Non-enforcement for Subdivision is required.
3. Please provide ,an engineers estimate or copy of the contract for 100% of the
construction costs for reconstruction of the SSD under the curbs and the associated
erosion control.
4. A bond or letter of credit is required for the above amounts.

Dear Mr. Jett:
This letter is in response to your Primary Plat Amendment and Subdivision Waiver filings for West Carmel Center -
Block G. I have reviewed the Primary Plat Amendment and Secondary Plat applications. The following comments
need to be addressed and plans updated accordingly:
Comments on Primary Plat, Subdivision Waivers & Construction Plans:
1. The Department would like to see the size of the cul-de-sac reduced to a right-of-way radius of 50
feet and pavement diameter of76 feet. I believe this will also help to satisfy Panhandle Pipeline
Company and their concern of the pavement being over their easement.
2. Show continuation of sidewalk, both sides of drive.
3. Please provide a Traffic Impact Analysis to display the distribution of traffic through the
subdivision, with and without the cul-de-sac. This is necessary to verify or substantiate any claims
regarding additional traffic in the residential area.
4. Identify both pipeline easements on the plans.
Secondary Plat:
1. Revise Legend to add length of markers on legend, as required under Section 8.2 of the SCO.2.
3. Provide a key Map on the face of the plat.
4. Provide Primary Plat, Primary Plat Amendment and Secondary Plat Docket Numbers on the plat.
5. Change Name of Director of Community Services to Michael P. Hollibaugh.
6. Place Commission Certificate on opening page.
7. Submit a copy of the covenants and restrictions.
8. Provide Name, address and phone number of Owner, subdividor, and Surveyor
Please submit a revised Primary Plat with the above-mentioned changes/additional information. Once these changes
have been made, comments addressed, and additional information provided the Primary Plat will be placed on the
next available Plan Commission Agenda. It has been tentatively placed on the June 19,2001 agenda. If you have
any additional questions please do not hesitate to call.

This letter serves to acknowledge receipt of a transmittal containing the plans for the Carwinion Way
reconstruction. After reviewing the plans, the Highway Department has the following comments:
1. An Application for Project Review needs to be completed and the appropriate review fees for
a Construction Plan paid, before any approvals will be granted from this office.
2. A 15' Drainage and Utility Easement is needed behind the right of way of Carwinion Way.
3. A plan sheet detailing the Maintenance of Traffic will need to be included.
4. Please show additional curb elevations and flow lines on the plans.
5. The curb on Commerce Drive across the front of the emergency access lane will need to be roll
curb. .
6. The asphalt path along Commerce Drive will need to be extended to the north right of way line of
Carwinion Way.
7. Some type of barrier is required across the emergency access point, to prohibit cut through
traffic.
8. Please note on the plans that all damaged SSD under the curb will need to be replaced.
9. Please show the existing right of way on Carwinion Way in the Ashbrooke Subdivision.
10. The pavement cut on Carwinion Way at the property line must be perpendicular to the curb.
11. The curb on Commerce Drive must be saw cut at the point of removal.
12. The street name sign and stop sign at the intersection of Commerce Drive and Carwinion Way
must be removed.
13. A NO OUTLET sign will need to be installed in Ashbrooke Subdivision at the west side of
Terwithen Lane and Carwinion Way.
14. A Maintenance of Traffic Plan is needed for the construction of the cul-de-sac and removal of
the existing pavement.
15. Any utilities that need to be relocated will be done so at the developers expense.
16. Plans will need to be submitted to the Hamilton County Surveyor's Office for review.
17. Please note that further comments may apply at a later date.

Please fmd attached a letter from Mark Rattermann attached. In response to the letter the
Department has the following observations:
1. The letter indicates that the closing the street off was part of a deal struck between the
Ashbrook Homeowners and the commercial developers. He asks that the plan
commission complete the deal. The Department is not aware of a "deal" that was
struck between the residents of Ashbrook and the developers of the commercial
portion of this development. Regardless, the Plan Commission is not bound by any
such agreement between third parties.
2. Mr. Ratterman indicates that if the Plan Commission had the opportunity to consider
the development of the platted subdivision (Ashbrook) at the same time as the
commercial area they could have prevented this problem. He states that the
residential area was there first and that the commercial development was the result of
negotiations on a myriad of issues. In fact, as the Department has shown through
researching this request, the Plan Commission did consider this very issue in 1990
when the development was proposed. Both commercial and residential portions were
filed as one petition (please see information contained n the Department Report).
Over the last ten years the Plan Commission has take action on over a dozen petitions
within this development. All were designed based on the layout of the original
development including the connection. In addition, the Ashbrook development would
not have been permitted to develop in the manner that it has without the connection of
the two streets in question.
3. Mr. Rattermann asks that the Plan Commission to vote in favor of the proposal to
close the road and protect the integrity of the residential neighborhood. The
Department assumes that Mr. Rattermann bases this request on the statements made
in his letter. The Plan Commission should be aware that the facts of this matter vary
greatly from the statements made by Mr. Rattermann (please refer to the meeting
minutes and information contained in the Department Report). The Plan Commission
has maintained the integrity of the Ashbrook neighborhood and there own over the
last ten years in the decisions made concerning this development.

I will be in Minnesota next week when you will be debating and voting on the closure of a road in
Ashbrooke Subdivision, therefore I will not be able to speak to you at the hearing. I took the lib-
erty of writing you rather than calling you, which I am sure you appreciate.
I am positive you will be diligent in your discussion and debate on this issue and I am sure you
have feelings on whether this road should be closed or not. I am sure there are issues like com-
munity planning, safety, traffic flow and security that need to be dealt with, but I think all of those
issues are mute at this point. The proposed road is a county road and the county commissioners
voted 3 to 0 to close this road. They discussed all the same issues and their highway engineer
didn't like closing the road either, but they voted to do it anyway. Closure of this road was part
of a deal which was struck between the Ashbrooke Homeowners and the commercial developers,
with the knowledge of the administration and the county commissioners. The commercial prop-
erty is now built up and the other half of the deal is still in limbo. I am asking you to complete the
deal.
While it is always best to discuss and debate these issues with consideration of the big picture, we
all know that sometimes zoning and development becomes more of a quilt and less of a bed-
spread. If you had the opportunity to consider the development of the platted subdivision
(Ashbrooke) at the same time you were looking at the commercial property along Michigan Road,
you could have come up wi1h a plan that could have prevented this problem. As you know the
residential development was there first and the commercial development was the result of changes
and negotiations on a myriad of issues. I am asking you to vote in favor of this proposal to close
1he road because we need to protect 1he integrity of 1he residential neighborhood. Keep commer-
cial traffic commercial and residential traffic residential.

do what you think is best for our community.

Dear Ms. Buckley,
This letter is in response to the meeting we had on Friday November 3rd regarding the placement of the cul-
de-sac at the end on Carwinion Way in the Ashbrook Subdivision. Although this will greatly increase the
overall length of the cul-de-sac well beyond allowable standards, it has been agreed upon that it would be
acceptable with the following provisions. The installation of a surface or sub-surface weight bearing system
capable of supporting fire fighting apparatus for emergency access connecting to Commerce Drive. We also
would require that any means of barricading this emergency access from Commerce Drive to Carwinion Way
be removable in nature, allowing the fire department access and that no permanent fence, wall or other
barricade be erected that would not allow for emergency access. It is also understood that this access
portion between Commerce Drive and Carwinion Way must be maintained as a passable emergency
entrance point at all times.
With the above noted requirements met, it is the opinion of our office that the creation of a cul-de-sac at the
end of Carwinion Way would meet with our approval.
