Re: BZA Docket No. PZ-2022-00178 V: Harlan Pool Setback Variance.
Dear Mr. Harlan:
At the meeting held on Monday, September 26, 2022, the Carmel Board of Zoning Appeals Hearing Officer took
the following action regarding the Development Standards Variance (V) request filed by you for the property
located at 13970 Sand Cherry Court:
APPROVED with CONDITION: Harlan Pool Setback Variance - DSV approval for:
• PZ-2022-00178 V: Pools & their decking must be located at least 3-ft away from any easement; 8-ft
encroachment into easement granted.
• CONDITION: The Petitioner receives Consent to Encroach approval from the Carmel Board of Public
Works and Safety (BPW).
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is September 26,
2025.
Please include a copy of this letter with any permit application.
