CERTIFICATE OF PLAN COMMISSION ACTION
Ramona Hancock, upon being first duly sworn, deposes and says:
That she is the Secretary of the Carmel/Clay Plan Commission and the keeper of its
books and records.
That the Carmel/Clay Plan Commission on the 17th day of July, 2001, approved the
vacation of the part of the plat of College Hills hereinafter described by rendition of the
following decision:
"IT IS THEREFORE the decision of the Carmel/Clay Plan Commission that
the Petitioner's request under Docket No. 65-01-PV is granted and that,
therefore, the plat of (i) Lots 27 through 35, inclusive, Lots 123 through 130,
inclusive, Lots 70 through 87, inclusive, and the part of Lots 36, 69, 88, and
122 lying south of the right-of-way of 1-465 in College Hills as recorded in the
Office of the Recorder of Hamilton County, Indiana, in Plat Book 119, Page
30, and (ii) all public rights-of-way and streets and utility easements contained
within or adjacent to the part of College Hills created by the above-described
lots and (iii) the covenants and plat restrictions of College Hills as applicable
to the above-described lots and public rights-of-way and streets are and shall
be vacated. . . ("Decision")."
That to her best knowledge and belief, the real estate above described and vacated
pursuant to the Decision shall in the aggregate hereinafter be legally described as set forth on
Exhibit "A", hereto.

pages 30 an 31 by the Recorder of Hamilton County, Indiana: 27 through 35, 70 through
87 and 123 through 130, including a portion of each of the following lots in said College
Hills: 36,69,88 and 122 and a portion of both Carrollton Avenue and Guilford Avenue
as platted in said College Hills being bounded as follows:
Commencing at the Southwest Comer of the Southwest Quarter of Section 12, Township
17 North, Range 3 East; thence South 89 degrees 13 minutes 14 seconds East (assumed
bearing) 82.50 feet along the South Line of said Southwest Quarter to the point of
beginning of the perimeter land description of College Hills as per plat thereof recorded
as instrument #25018 in Deed Record 119, pages 30 an 31 by the Recorder of Hamilton
County, Indiana; thence South 89 degrees 13 minutes 14 seconds East 1,118.45 feet along
the South Line of said Southwest Quarter to the southeastern comer of said subdivision;
