Per your request, enclosed is a letter regarding ~ road improvements. It was necessary to
indi~ that the road improvements were dependent uPon the usual condidoDS, such as zoning,
annexation, acquisition of the land, etc. It was also nea$u'yto indicate that the road improvements
were dependent upon the square footage or office space ~eveloped. As such. the letter indicates that
it'the level or development is substantially reduced belo'f that assumed by the traffic reports, it win
be necessary to re-evaluate the road improvements. e:.:tt of the cost of the real estate, however,

We have reviewed the documents submitted for tillS plat vacation and offer the following comments:
1. What is the status of the annexation of the property? Is there adequate contiguity to annex the entire
property? The annexation should include the right of way of 96th Street north of the HamiltonIMarion
County line, from tile east boundary of the site to College Avenue. If the property is not to be re-
platted, the additional right of way requirements for tile office complex, above and beyond the existing
right of way, will require formal dedication through our Board of Public Works and Safety.
2. Is Plan Commission approval anticipated?
3. We assume the office project will not be re-platted?
4. What is the small area at the southeast comer of the site? It appears this is not a part of the College

Dear Mr. Frankenberger:
This letter serves to acknowledge receipt ot ra transmittal contalnlng the request to vacate the plat of the
property mentioned above. After reviewing the enclosed documents. the Highway Department has the
following comments:
The Highway Department has no objection to the vacaDon of the plat, however, the following condltlons will
bl!ll a condition of the vacation. These items were first listed In a letter dated February 22, 2001, pertaining to
the l'EOne of the property.
1. In Option a, the east entrance Is offset from the apartment complex entrance located on the south
side of 961ft Street. This will not be pennitted, the entrances must align with each other.
2. The Traffic Impact Analysis indicates that a traffic signal is needed 8t the east entrance. While the
Highway Department is not opposed to the installation of this signal, an agreement will need to be
reached with the understanding tl'l8t the signal will be removed after one year, at the owners cost, if
the signalls not warranted.
3. There are several areas along 961ft street where drainage Issues will need to be addressed.
4. 98'" Street will need to be reconstructed to match the existing conditions west of College Avenue.
This Includes 2 - 12' travel lanes with a 16' center turn lene. The Improvement would begin at
College Avenue and continue to the eastern entrance to the Ave Seasons.
5. The full aoceVdecellanes will need to be Included at the entrances.
8. In accordance with the Hamilton County Thol'DUghfal8 Plan. the following right of way will be
required along 961n Street, from the intersection of College Avenue to a point 600' to the east, the
half right of way is BO', from that point to the eastern prope~ line a 75' half right of way Is required.
7. Any additional right of way required at the intersection of 96 Street and COllege Avenue for the
Improvements to 98'" Street, will be purchased at the expense of the developer.
8. Please contact Mr. Mike Howard, Hamilton County Attorney, for the necessary dates and
information relating to the vacation process.

Following are CTRWD comments on the agenda items in our service area for Wednesday's
meeting. Please feel free to copy and distribute this email or attach it to your meeting
minutes.
Hayden Run Subdivision (Centex)
The District is working with Centex on plans for the project which will include an offsite
lift station to be constructed by the District. A lift station site on the Carmel Clay
School Corporation property has been proposed by the District and an interceptor extension
through the project will be necessary per the District's master plan. Many details remain
to be worked out and plans are not ready to go to IDEM for State permit approval as yet.
Mayflower Park, Block 3, Lots 2a-2c (Secondary Plat)
We have received plans and have no comments relative to platting unless changes to the
sanitary sewers result. If the project involves any alterations to existing sanitary
sewers, the District must be contacted for a pre-construction meeting to coordinate
District inspection of the work. Building permits should NOT be issued without the
District's connection permit.
hOllege Hills (Plat Vacation)
The District is aware of the petitioner's plans and will not comment on the plat vacation
.. per se other than to say that the petitioner has been advised that a number of issues
relative to accommodating the project will need to be addressed at the appropriate time.
Among these issues are: the sewer lines in the area are not presently sized to accommodate
the increased flow from a commercial development and may need to be upsized or otherwise
modified; existing residential sewer connections will need to be appropriately capped off
or removed; any remnants of the original residential septic systems will need to be
addressed during site work; and, any water wells on the site will need to be capped and
properly abandoned.
~illage of West Clay - Section 9006 (Secondary Plat)
The District has received plans and the District's consulting engineers have completed
their review. The plans are ready to be submitted by the District to IDEM for State
approval.
~ridian Mark-Residence Inn and Springhill Suites
The District's connection permit has previously been issued and the revised plans are
being reviewed to determine if any changes to the sewers are contemplated. The petitioner
should be reminded that the District should be contacted to schedule inspections for any
work on the lateral or trunk sewers before it is covered up; inspection is required by the
District for all extensions outside three (3) feet of the building foundation.
Household International Generator Building
This project does not appear to have any effect on the District's sewer system. Please
have the petitioner contact us if this is incorrect.

Re: College Hills PUD
This PUD project due to its zoning change and site construction will remove 20.5 acres of urban forest
within our community. The trees that now exist on this site are large, mature specimens that provide
multiple values including many natural infrastructure functions. Landscaping that will "be reprant~d Qn
site in parking lot islands and around commercial buildings will not survive to reach thE(size and
maturity of that now on site, due to constraints caused by limited root development under pavement
and other urban stresses. This represents a collective loss to the urban forest and green space of the
community.
Due to the complete disturbance of this site by construction of the project, I would recommend an off-
site reforestation project be included in this PUD to help compensate for this loss. Such projects have
been worked in cooperation with the Carmel/Clay Parks & Recreation Department in the past. Though
any site held in public trust where future development would not threaten the trees would be suitable.
For a planned unit development of office/retail space with large areas of surface parking a 20%
reforestation threshold minimum is recommended. The current site has approximately 35% tree
coverage (or 7.175 acres out of the 20.5 acre site). The PUD ordinance proposes 15% as the
minimum to be landscaped. Additionally, an area equal to 5-10% of the site (1-2 acres) should be
proposed as an off-site reforestation project.
For mixed size planting sites, tree stock should meet the standard of 352" caliper trees, 60 1" caliper
trees, and 115 seedlings planted per acre.

According to Indiana Code Chapter 36-7-3, the Plan Commission shall approve or deny a petition for vacation
of all or an amendment of part of a plat only upon a determination that:

1. conditions in the platted area have changed so as to defeat the original purpose of the plat;

The Indiana Code says also that the Plan Commission must give all owners of land within the plat an
opportunity to comment on the petition; the plan commission must make written findings of fact regarding its
decision; the plan commission may impose reasonable conditions as part of its approval.

1. What is the status of the annexation of the property? Is tIlere adequate contiguity to annex tlle entire
property? The annexation should include the right of way of 96th Street nortll of tlle HamiltonIMarion
County line, from tile east boundary of tlle site to College A venue. If tlle property is not to be re-
platted, tlle additional right of way requirements for tlle office complex, above and beyond tlle existing
right of way, will require formal dedication tlrrough our Board of Public Works and Safety.
2. Is Plan Commission approval anticipated?
3. We assume the office project will not be re-platted?
4. What is tlle small area at tile southeast comer of tlle site? It appears this is not a part of the College
