FINDINGS OF FACT -DEVELOPMENT STANDARDS VARIANCE
1. The approval of the requested variances will not be injurious to the public health, safety, morals and
general welfare of the community because:
The approval of the requested variances will not be injurious to the public health, safety, morals and
general welfare of the community because the size and appearance of the proposed ground sign is
otherwise consistent with what would be permitted, however, due to the street configuration and the
location of the main entrance, the sign would otherwise be required to face the street frontage and
not be visible.
2. The use and value of the area adjacent to the property included in the variance will not be affected in
a substantially adverse manner because:
The use and value of the area adjacent to the real estate that is the subject of the requested variances
will not be affected in a substantially adverse manner because the size and appearance of the
proposed ground sign is consistent with permitted signs on what would otherwise be a lot with two
(2) street frontages. However, due to the street configuration and the location of the main entrance,
the subject property only has one (1) street frontage and the location of the sign would otherwise not
be visible.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
Strict application of the Zoning Ordinance results in practical difficulties in the use of the
Applicant's site because absent relocating ground sign for this site, the Applicant will be unable to
properly and adequately identify the new dealership to the general public. The location of the
permitted ground sign will assist in providing proper identification which shall assist in efficient and
safe wayfinding to the site.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. PZ-2022-00138 V is granted, subject to any conditions stated in the minutes of this
meeting, which are incorporated herein by reference and made a part hereof.
