The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The current use poses no such injury, and there is no change contemplated by the granting of the variance. The facility will , in fact, allow the school corporation to better serve the educational needs of the community. 2 . The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The property will be screened and the setback will be such that the height of the stadium will not adversely affect any of the adjacent areas . 3 . The strict application of the terms of the Zoning Ordinance to the property will result in the practical difficulties in the use of the property because: Educational facilities are typically located in resdential areas to best meet the needs of the population they are intended to serve. The stadium, which will seat 6 , 000 people and include a press box, cannot be constructed within a 25 foot height restriction. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Variance Docket No. is granted , subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. The strict application of the terms of the Zoning Ordinance to the property will result in the practical difficulties in the use of the property because: The lighting elements of this facility are necessary for the night time operation of this facility. The stadium lights cannot be constructed within a 25 foot height restriction. The use of the lights is seasonal and they are not used at odd hours in the evening. Property values will not be affected in a substantially adverse manner . 3 . The strict application of the terms of the Zoning Ordinance to the property will result in the practical difficulties in the use of the property because: The lighting elements of this facility are necessary for the night time operation of this facility and have been planned with minimal impact to the surrounding area as a priority . The stadium lights cannot operate with a 0 . 1 foot-candle intensity at the boundaries .
