FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1 . The approval of this variance will not be injurious to the public
health, safety, morals and general welfare of the community because:
The current use poses no such injury, and there is no change
contemplated by the granting of the variance. The facility will ,
in fact, allow the school corporation to better serve the educational
needs of the community.
2 . The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner because:
The property will be screened and the setback will be such that
the height of the stadium will not adversely affect any of the
adjacent areas .
3 . The strict application of the terms of the Zoning Ordinance to the
property will result in the practical difficulties in the use of the
property because:
Educational facilities are typically located in resdential areas
to best meet the needs of the population they are intended to serve.
The stadium, which will seat 6 , 000 people and include a press box,
cannot be constructed within a 25 foot height restriction.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that
Variance Docket No. is granted , subject to any conditions
stated in the minutes of this Board, which are incorporated herein by
reference and made a part hereof.

The property will be well screened and the setback will be such
that the height of the lights will have minimal effects on the
adjacent areas . Since this will replace an existing athletic facility
to the south, the effects will not be new to this area .
3 . The strict application of the terms of the Zoning Ordinance to the
property will result in the practical difficulties in the use of the
property because:
The lighting elements of this facility are necessary for the
night time operation of this facility. The stadium lights cannot be
constructed within a 25 foot height restriction.

IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that

Since there is an existing athletic facility to the south of the
site, the people in the surrounding area are familiar with the effects
of stadium lighting. The use of the lights is seasonal and they are
not used at odd hours in the evening. Property values will not be
affected in a substantially adverse manner .
3 . The strict application of the terms of the Zoning Ordinance to the
property will result in the practical difficulties in the use of the
property because:
The lighting elements of this facility are necessary for the
night time operation of this facility and have been planned with
minimal impact to the surrounding area as a priority . The stadium
lights cannot operate with a 0 . 1 foot-candle intensity at the
boundaries .
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that
Variance Docket No. is granted , subject to any conditions
stated in the minutes of this Board, which are incorporated herein by
reference and made a part hereof.
