Items 5g, 6g and 7g. may be heard together, however voted upon separately. 5g. 7 : 00 P .M. , Public Hearing on Docket No . V 82-90 a Developmental Standards Variance Application for Carmel/Clay School Corporation and their recently approved athletic stadium located on the northwest corner of 136th Street and Keystone Ave . , Carmel . Petitioners are requesting a variance from section 7 . 4 . 1 of the Carmel/Clay Zoning Ordinance to exceed the 25 foot height limit, the visitors bleachers structure will be 39 feet above grade and the home bleachers and press boxes will be 57 feet above grade . Parcel is zoned R-1 . Filed by Tim Stevens for the Carmel/Clay School Corporation. The public hearing was opened at 8 : 35 P.M. Mr. Tim Stevens , Land Consultant with Campbell Kyle Proffitt, 198 S . 9th St . , Noblesville, made the presentation , a copy of which is on file at the Carmel Department of Community Development . An aerial view, elevation drawings of the homes side of the • , stadium height , a site development plan including parking lighting and stadium lighting, lighting photometrics were shown . Packets were passed out to all board members . Dr. Eskew and Sharon Terry from the school board, Dr. Hartman and Roger Harper from the school administration, Bill Duke and Eric Clark from the high school and Bob Campbell and Frank Campbell from Campbell Kyle Proffitt and Ralph Power and Don Quorto and Bernie Schneider from Everett I . Brown were present . Mr. Steve Harlow, Attorney, 4609 Sommerset Way South, representing Debbie Burkhard, 2515 Smokey Row Rd. . Mrs . Burkhard ' s principle concern is the lighting, the light spillage and have it screened. The petitioner has stated that they would put in writing what they will do to correct this . At this time the resident has not received in writing. Mr. Bill Mathews , 222 Beechmont Dr. , was not speaking against the CARMEL BOARD OF ZONING APPEALS MINUTES - SEPTEMBER 24, 1990 5 served. It is not a blanket variance , it is only those lots that • • we think are necessary to do . If it is precedent setting whereby over 20% of your land is unused then so be it . Perhaps anyone with that kind of thing should be able to receive some treatment . Mr. Sweet does not believe personally that it is a financial hardship on them whether they get this or not , they are attempting to serve a market . They have the right to petition, so they exercise that right . Mr. Sweet is very concerned that often these proceedings get into innuendos and peoples intent and it seems that those who are in the development community and attempt to create homes that some of these people live in. Mr. Hansen lives on a 100 ft . lot . They are very proud of them and they feel that, as Mr. Hansen has chose this area and his lot size , there are others that might like to do that too . Others have had the opportunity in the past, they don ' t think that others in the future should be precluded. Their intent here tonight is not to somehow make more dollars , but in fact to offer a product for many people his age or older who are not looking forward to spending their weekends mowing acres of grass , and yet would like to spend a pretty reasonable amount for housing. The public hearing was closed at 8 : 14 P .M. Mr. Klar asked how many of the 52 lots that are left will be over 16 , 000 sq. ft . ? Mr. Sweet stated that he could not answer that because they have not submitted a primary plat at this time . There will be in excess of 10 acres in parks and meadows . Mr. Klar asked Mr. Brandau what the regulations were on the • • number of curb cuts? Mr. Brandau stated that primarily the lot width dimension dictates the regulation . Our ordinance does not say how many curb cuts you can have per linear feet, however, we do have the 120 ft or the 100 ft . lot width requirement that would dictate that or influence the number of curb cuts that you would have along the linear stretch of street . The public hearing closed at 8 : 22 P .M. Mr. Klar moved to approve Docket No . V 81-90 developmental standards application for Brenwick Development . Mr. Thompson seconded. Findings of Facts were completed by all board members . Unanimously approved 3-0 . There were no comments from the public at this time . The public hearing was closed at 8 : 24 P .M. Mr. Klar moved to approve Docket No . V 81-90 with the condition that the primary plat would be filed for this parcel within two ( 2) years from the date of the variance approval and that the CARMEL BOARD OF ZONING APPEALS MINUTES - SEPTEMBER 24, 1990 7 project . He presented a brochure, explaining that there is a sports lighting system which would not require a variance . (Brochure and letter were submitted - which is a part of the official minutes and attached to the Master Copy) . The public hearing was closed at 9 : 02 P.M. Mr. Brandau stated that all affidavits and proofs of notification to the adjacent and abutting property owners were received by the Department of Community Development . Mr. Thompson moved to approve Docket V 82-90 as presented. Mr. Klar seconded. Findings of Facts were completed by all board members . Unanimously approved 3-0 . 6g. 7 : 00 P .M. , Public Hearing on Docket No . V 83-90 a Developmental Standards Variance Application for Carmel/Clay School Corporation and their recently approved athletic stadium located on the northwest corner of 136th Street and Keystone Ave . , Carmel . Petitioners are requesting a variance from section 7 . 4 . 1 of the Carmel/Clay Zoning Ordinance to allow the stadium and parking lot light standards to exceed the 25 foot height limit , the stadium light standards will be approximately 120 feet and the parking lot light standards will be between 30 and 35 feet in height . Parcel is zoned R-1 . Filed by Tim Stevens for the Carmel/Clay School Corporation. Mr. Klar moved to approved Docket No. V 83-90 as presented. OP Mr. Thompson seconded. Findings of Facts were completed by all board members . Unanimously approved 3-0 . 7g. 7 : 00 P.M. , Public Hearing on Docket No . V 84-90 a Developmental Standards Variance Application for Carmel/Clay School Corporation and their recently approved athletic stadium located on the northwest corner of 136th Street and Keystone Ave . , Carmel . Petitioners are requesting a variance from section 7 . 3 . 6 of the Carmel/Clay Zoning Ordinance to exceed the minimum 0 . 1 foot/candle of light at or beyond a lot line . Parcel is zoned R-1 . Filed by Tim Stevens for the Carmel/Clay School Corporation . Mr. Thompson moved to approve Docket No . V 84-90 as presented. Mr. Klar seconded.
