The applicant seeks to rezone 4 parcels from the B5 Business, R2 Residential and R3 Residential Districts within
the Old Town Overlay Character Subarea to the C-2 Mixed Use District. The site is generally located on the west
side of 1st Avenue SE, between 1st Street SE and Supply Street. Filed by the Department of Community Services
on behalf of the Carmel Plan Commission.

Project Overview:
The site is generally located on the west side of 1st Avenue SE, between 1st Street SE and Supply Street
(former 2nd Street SE). This eastern half of the block, the subject of this rezone, is comprised of 3 different
zoning districts (R2, R3, B5) and the Old Town Overlay zone. The purpose of this proposal is to extend the C2
district, which exists on the western half of the block, to include the entire block between Range Line Road and
1st Avenue SE. This rezoning would allow for a redevelopment proposal encompassing the block to be
reviewed under a singular zoning district and process.
While no site or building plans have been filed with the Department, the City Council recently passed
Resolution CC-08-01-22-02 to allow the Carmel Redevelopment Commission to use redevelopment bond funds
to acquire the parcels in this entire block for a proposed redevelopment project.
C2 District:
The approval process in the C2 District includes review by TAC, the CRC Architectu ral Committee, and a
DP/ADLS public hearing by the Plan Commission Hearing Officer. This public hearing includes all the same
methods of public notice (publication, signs, letters) as public hearings held by the full Plan Commission.
The standards of the C2/Mixed Use District are established in Article 2, Sections 2.35 & 2.36 of the Carmel
Unified Development Ordinance. You may view the Unified Development Ordinance online by clicking on

Plan Commission Overview:
The Department gave an overview of the site and discussed the known site information and a previous Council
approval to acquire the parcels in this block. A few citizens shared potential site plan concerns such as setbacks,
vehicle circulation, parking, building height and landscape buffering. Questions were also raised about the C2
approval process. DOCS and Redevelopment staff reiterated that while a conceptual plan was shown for the
previous Council approval, the site design has not been completed and that these comments would be
considered when design work progresses with the developer. Staff also outlined the various steps in the C2
approval process, including the required public hearing and public notice requirements for the Development
Plan and ADLS approval. The project was sent to the Commercial Committee meeting where it was agreed that
the Redevelopment Department would arrange for a meeting between the developer and neighbors once the site
design is under way. The Commercial Committee (with final voting authority on behalf of the Plan
Commission) voted to send this proposal to City Council with a favorable recommendation.

The Cannel Plan Commission offers you the following report on the application Docket
No. PZ-2022-00167 Z - petitioning to rezone four parcels located on the west side of Pt
Avenue SE,between 1St Street SE and Supply Street, from B-5Business, R-2/Residential,
and R-3/Residential within the Old Town Overlay Character Subarea to C-2/Mixed Use.
The Cannel Plan Commission Commercial Committee's recommendation on the petition
of the applicant is "Favorable."
At its regularly scheduled meeting on October 6, 2022, the Cannel Plan Commission
Commercial Committee voted Three (3) in Favor, Zero (0) Opposed, One (1) Absent, to
forward to the Common Council the proposed Ordinance No. Z-677-22 with a
Favorable Recommendation".
Please be advised that by virtue of the Plan Commission's Favorable Recommendation,
pursuant to IC 36-7-4-608(f), the Council has ninety (90) days to act on this petition
before it becomes effective as Certified by the Commission. Ninety days from the date of
the Certification is Thursday,January 5, 2022.

Synopsis: 9
This ordinance rezones 4 parcels located along the west side of 1st Avenue SE, between 1st Street SE and 10
Supply Street to the C2/Mixed Use District for the purpose of facilitating redevelopment. 11

WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted a unified 14
development ordinance, the terms of which are applicable to the geographic area consisting of the incorporated 15
area of the City of Carmel, Indiana, which unified development ordinance has been codified in Chapter 10 of 16
the Carmel City Code; and 17

WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the 19
map that is part of the unified development ordinance; and 20

WHEREAS, the Carmel Advisory Plan Commission, on Thursday, October 6, 2022, voted to 22
favorably recommend Docket No. PZ 2022-00167 Z, rezoning the Parcels illustrated and described in Exhibit 23
A, which is incorporated herein (the “Real Property”). 24

NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, 27
that: 28
Section I: That the Official Zoning Map accompanying and made part of the Unified Development 29
Ordinance is hereby changed to designate the Real Property Parcels from the B5 30
Business, R2 Residential and R3 Residential Districts within the Old Town Overlay 31
Character Subarea to the C2/Mixed Use District. 32
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance 33
are hereby repealed. 34

Section III: This Ordinance shall be in full force and effect from and after its passage and signing 36
by the Mayor. 37
