This permit or any of the conditions which it contains may be appealed by applying for administrative review. Such review is governed by the Administrative Orders and Procedures Act, IC 4-21.5, and by the Department's rules relating to adjudicative proceedings, 310 IAC 0.6. ( 2) If any archaeological artifacts or human remains are uncovered during construction, federal law and regulations (16 USC 470, et seq.; 36 CFR 800.11, et al) and state law (IC 14-3-3.4) require that work must stop and that the discovery must be reported to the Division of Historic Preservation and Archaeology within two (2) business days. ( 3) This permit should not be construed as a waiver of any local ordinance or other state or federal laws. ( 4) This permit does not relieve the permittee of the responsibility of obtaining additional permits, approvals, easements, etc. as required by other federal, state, and local agencies. These agencies include, but are not limited to: U.S. Army Corps of Engineers, Louisville District Hamilton County Drainage Board Local city or county planning and zoning commission ( 5) This permit does not relieve the permittee of any liability for the effects which the project may have upon the safety of life and property of others. ( 6) This permit may be revoked by the Department for violation by the applicant of any condition, or applicable statute or rule. ( 7) This permit shall not be assignable or transferable without the prior, written consent of the Department. ( 8) The Department shall have the right to enter upon the site of the permitted activity for the purpose of inspecting the authorized work. ( 9) The receipt and acceptance of this permit by the applicant shall be considered as acceptance of all "General" and "Specific" conditions contained therein. The Covenants, Conditions and Restrictions are amended to provide that no fence shall be permitted in the part of the Common Area adjacent to Springmill Road; 2. No fence may be installed in the rear yard of any lot adjacent to Springmill Road unless first approved by the Association as to architectural design and building materials; 3. The part of the Common Area located at the east end of the lake will be available for the use and enjoyment of the residents of the development and access to such area is to be provided by Pedestrian Access Easements located between Lots 27 and 28 and Lots 11 and 12. Pursuant to previous correspondence, t have included the petition form for making the storm sewers in this subdivision regulated drain. 2. Because of the logistical problems associated with inspecting and maintain- ing submerged storm sewers, the Surveyor has a policy against underwater discharge pipes. Per our telephone conversation, this may be revised on the construction drawings. 3. Our current standard detail for SSD connection to individual lots shows the SSD stubbed above ground with a metal fence post marker. Clay Township Dear Mr. Little: After reviewing the above referenced project, the Hamilton County Highway Department has the following concerns: 1) During our initial review, we failed to note that passing blisters will be required for both entrances. Your revision to the two entrances without the full 12' lane between them is acceptable. The Hamilton County Highway Department needs the right-of-way far your decel lane at Mallard Court in recordable form before the construction plans can be approved. 2) A variance for the cul-de-sac lengths will be required from the Hamilton County Commissioners, too. 3) The casting note was prompted by your note /10 on Sheet /501. The Hamilton County Highway Department does not want any casting above grade in R/W. 4) The "Agreement to Improve Roadway Adjacent to New Development" needs to be executed before or at the time the secondary plat is presented to the Commissioners. The appropriate performance bonds will be required also. 5) The Hamilton County Highway Department requires three full sets of revised plans and an executed inspection agreement before the plans can be stamped approved. Per your request, I hereby certify that the proposed development will be in compliance with the following individual section requirements: • 6.3.10 Intersections of streets shall be rounded by arcs not less than 20'radii at the ent- rance. The revised primary plat indicates that the two entrances from Springmill Road have 40 ft. radii and all interior street intersections have 25 ft. radii. • 6.3.15 Curvature of streets less than 150 feet. Cunningham,AICP, Assistant Director REPORT DESCRIBING PROPOSED WATER, SANITARY, AND STORM DRAINAGE SYSTEMS FOR SPRINGMILL LAKE PRIMARY PLAT WATER & FIRE PROTECTION SYSTEM Potable water and fire protection mains will be provided by the Indianapolis Water Company (IWC) under the "Standard Conditions for New Customer Mains" as approved by the Indiana Utility Regulatory Commission. IWC will coordinate final line sizing and location of proposed mains and hydrants with the Cannel Fire Department prior to installation. There currently exists a twenty (20") inch diameter water main located parallel to and east of Springmill Road. It is proposed to tap into this main in two locations near the entrances of Pintail Court and Mallard Court and install eight(8") inch diameter ductile iron pipe along the north side of said streets. Eight inch diameter ductile iron pipe will be installed along the east side of Teal Lane thus creating a"loop" with the two 8" diameter lines described in the previous sentence. The cul-de- sacs of both Pintail Court and Mallard Court will have six (6") inch diameter ductile iron pipe installed along the north side of the respective streets and shall "wrap" around the bulbs of the cul-de- sacs. Two existing fire hydrants located along Springmill Road must be relocated further east to avoid conflict with the proposed acceleration and deceleration lanes for this project. The developer shall execute the necessary agreements with and pay the required amounts directly to IWC for the design, installation and testing of the water supply system. Street crossings shall be backfilled with granular material, SANITARY SEWER SYSTEM Page 2 Sanitary sewer design, installation, and testing shall be subject to the approval of the Clay Township Regional Waste District (CTRWD) and the Indiana Department of Environmental Management (IDEM). CTRWD has future plans to install a proposed eighteen (18") inch diameter sanitary sewer interceptor along the east side of Springmill Road; accordingly, CTRWD has imposed a surcharge fee assessed to areas that will benefit from this future interceptor installation. To our knowledge, no date has been given when this proposed interceptor will be installed. Consequently, we propose to install a temporary sanitary lift station near the north west corner of our site and lay approximately 1,832 linear feet of four(4") inch diameter PVC force main(conforming to ASTM D-2241, SDR 21 specifications) along the north property line of Springmill Lake subdivision running eastward and connect into existing sanitary manhole MC-28 that is located along the east side of the Meridian Street frontage road and slightly north of the Ritz Charles' restaurant. A ten (10") diameter sanitary sewer conveys the effluent in a northeast direction from manhole MC-28 across US 31. The developers will obtain necessary permanent and temporary easements for the installation of said force main across properties owned by others. A ten(10")inch diameter sewer shall be "stubbed" out of the wet well of the lift station to provide for future connection to said 18" diameter future sewer interceptor. The temporary lift station shall be designed as if it were in fact for permanent use because of the uncertainty of the timing of the 18" interceptor project. The lift station shall be comprised of two submersible five horsepower pumps, station piping, necessary switch gear, control panel, and related appurtenances. The lift station shall be secured with chain link security fencing with locks,per CTRWD requirements. Upon recommendation by CTRWD, the following gravity sanitary sewer lines will be designed as ten (10")diameter PVC pipe (conforming to ASTM D-3034, SDR 35) and installed at a slope of 0.33% in order to better facilitate the future connection of the project's gravity sewers to said proposed 18" diameter interceptor: From lift station (Str 400)to 401, 401-402, 402-403, 403-404, and 404-405. These are essentially the lines that lie along the west side of Teal Lane and discharge into the lift station. The project's remaining gravity sanitary mains will be eight(8") inch diameter PVC pipe and will be installed at 0.45% slope. Each lot shall be served by a six (6") diameter PVC lateral pipe connected to the mains with appropriate manufactured pipe fittings. The costs associated with the payment of all related application fees, availability fees (including Meridian Corridor and Subsystem "F" surcharges), construction inspection fees, obtaining offsite force main easements, construction installation, testing, and bond procurements shall be paid by the developer. CTRWD will provide construction inspection and will witness sewer testing operations. Maintenance of the sanitary sewer system after acceptance and termination of maintenance bonds shall be provided by CTRWD. Street crossings shall be backfilled with granular material. STORM DRAINAGE SYSTEM Approval for the project's storm drainage system will be by the Hamilton County Surveyor's Office and the Soil Conservation Service. The US Army Corps of Engineers has reviewed the proposed work for this site regarding potential wetlands impact and has issued a letter stating that a Page 3 Department of Army(DA)permit is not required for this project. Work may proceed under the Corps Nationwide Permit process without notification. IDEM has issued a "Waiver of Section 401 Water Quality Certification" for this site and the conditions set forth by IDEM have been incorporated into construction plans via Sheet 901 - Standard Specifications, Section 02725 - Water Quality. The developers will accept the recommendation by the Hamilton County Surveyor's Office and will execute the necessary documents in order that the drainage facilities for this site become regulated drain. The only significant offsite drainage coming onto this parcel is conveyed by an existing 24" diameter RCP(installed at 0.45% slope)draining water from the Ritz Charles' restaurant and other areas east of the project and. has a submerged outlet entering into our lake along the east shoreline. According to the design engineer who performed the drainage calculations for the Ritz Charles'project, the total offsite drainage acreage into this pipe is 18.34 acres (the parking lot of the Ritz Charles = 6.3 acres). This calculates to be a ten year discharge rate, Q10, of 25.2 cfs. In order to comply with current S-2 zoning, and other governmental agency requirements, the existing lake must be altered in shape. The north and south banks will be filled in and the east and west banks will be expanded as indicated on the Primary Plat resulting in a normal pool area remains roughly the same as the existing shoreline area. The normal pool elevation will be lowered approximately 2.5 feet. Proposed lake banks shall have a maximum 4: 1 slope (i.e. 4 horizontal feet of run to one vertical foot of fall). The discharge rate for the proposed lake is designed for 3.0 cfs. and is controlled by a proposed 12" diameter RCP installed at 0.60% slope with an upstream invert elevation of 852.00 ft.NGVD. The 100 year elevation of the proposed lake will be 854.10 ft NGVD, which allows for the 5.12 acre-feet of required storm water storage. Six inch diameter underdrains are designed to be installed along the front edge of street curbs and shall be connected into storm structures. All lots that are not located on the lake shall be provided with a 4 inch diameter sub surface drain connection for sump pumps. No downspouts are to be connected into these underdrains. All surface swales are designed to be constructed with a 1.00% minimum slope. Erosion control plans have been submitted to SCS and the Hamilton Co. Surveyor's Office for approval and/or comments. Prior to earthwork and utility construction on this project, "Rule 5" procedures will be followed regarding permit fees, plan submittals, and public notification. The contractor(s) shall be required to comply with the erosion control plans and to perform work operations in a manner that minimizes soil erosion impacts. All proposed storm sewers shall be reinforced concrete pipe installed to the lines and grades shown on the construction plans. For the majority of the site, storm event water travels overland by drainage swales into storm structures and is discharged into the project's lake. The lake serves as the manager of the storm water and controls the release rate via said 12" diameter pipe at Str. 608. The storm water accumulating at the north west corner of the site is discharged directly into storm sewers that Page 4 ultimately discharge into Williams' Creek within the existing Hamilton County Highway Department's right-of-way along Springmill Road. The location of the project's outfall (Str. 601) is located east of the existing bridge along Springmill Road over Williams Creek and north of Creekwood Lane. The discharge rate from the project at Str. 601 into Willams Creek is 10.33 cfs (this includes the 3.0 cfs discharge rate from the detention lake). The developer shall be responsible for paying all costs associated with the restoration of areas disturbed by the installation of the offsite storm sewer line (Str. 601 to Str. 602), and shall pay all costs related to the procurement of required bonds, construction installation of the storm drainage system, obtaining "as-built" record drawings, and maintaining the installed system until the time of formal acceptance of said system by the County and/or the expiration of the maintenance bonds. The Department of the Army Regulations concerning the effects on wetlands relative to Permit procedures are stated in 33 CFR Section 320.4(b), as published in the Federal Register, Volume 47, No. 141, on 22 July 1982. 2. These regulations are applicable to the following wetland types: a. Those serving as natural biological functions including food chain production, general habitat, nesting, spawning, rearing, and resting sites for aquatic or land species. b. Those serving as sanctuaries, refuges, or aquatic environment study areas. c. Those effecting natural drainage characteristics, sedimentation patterns, salinity distribution, flushing characteristics, current patterns or other environmental characteristics. d. Those shielding other areas from wave action, erosion, or storm drainage. e. Those serving as storage areas for storm and flood waters. f. Those being prime natural recharge areas (prime recharge areas are locations where surface and ground water are directly interconnected). g. No permit will be granted to work in wetlands as identified above, unless the review indicates that the benefits of the proposed alteration outweigh the damage to the wetlands resources, and the proposed alteration is necessary to realize those benefits. The review of such areas will include the following: a. The effect on the individual wetland area under consideration, and the cumulative effect when combined with other filled areas on the complete and interrelated wetland area. b. The necessity of the proposal when located in or close proximity to the wetland area. c. Whether feasible alternatives are available. 4. The initial information necessary to constitute a complete application involving fill in wetland areas is as follows: a. A site plan labeling and delineating the total wetland area and the portion thereof to be filled. Should also show adjacent water bodies such as rivers, channels, or lakes. b. The District will accept the installation of the lift station, so long as it is only temporary in nature and the proposed sewers are constructed at a depth to be served by gravity through the future 18-inch interceptor sewer. In order for the development to be served by gravity in the future, the sewer line along Teal Lane needs to be changed to 10- inch diameter with a slope of 0. 33%. With regard to the lift station, we offer the following comments: 1. Provide a copy of the head loss calculations and a pump curve of the selected pump. 2 . You need to show the electrical design on the plans to include wire size, conduit size, starter size, etc. 3 . The site will need to be secured with chain link security fencing with locks. 4 . There will need to be a 3-way transfer switch and generator connector compatible with the District ' s generator. The applicant proposes to make minor modifications to the shoreline of a borrow pit in Hamilton County, Indiana.
