MINUTES
March 24, 1993
Committee Members Present: Rick Brandau, Mike Hollibaugh, and Dave Cunningham, DOCD;
Randy Powell and Dick Hill, City Engineer's Office; John Duffy, Cannel Utilities; Jeff Autry,
Indiana Gas Co.; LuAnne Stephens, Cannel-Clay Communications Center; John South, Hamilton
County Soil & Water Conservation Department; and Jerry Liston, Hamilton County Surveyors.
WILLIAMS CREEK POINT SECONDARY PLAT - SECTIONS 1, 2, 3, & 4
Jeff Kennelly of Dart Development II and Bruce Hagan of MSE appeared before the Committee
and gave a brief overview of the project. Williams Creek Point is on the west side of Springmill
Road between 146th and 141st Streets. The petitioner is asking for approval of Sections 1
through 4 which is primarily everything east of Williams Creek. The plans are substantially the
same as the primary plat with the minor change in the reduction of lots from 166 to 164.
COMMENTS:
- City Engineer's Office, Randy Powell, No Comment.
- Utilities, John Duffy, No Comment.
- Communication, LuAnne Stephens stated that the project name would have to be
changed as well as the names of Willowview and Willowchase streets. Project name of
Ponds West would be OK. There are too many sound-alike names with Williams Creek
from 116th to Springmill Road. This direction came from a joint discussion among the
Sheriffs dept., Fire dept., and Communications Center.
- Cannel Fire Department, Stan Puckett, No Comment.
- Soil & Water, John South stated that no revised plans have been received. Comments
made in South's letter of 2-19 have not been addressed--when done so, South will
respond. In regard to roadside swale & subsurface drain, a filter strip is recommended
next to Williams Creek. It should be seeded in the spring. Detention basin outlet needs
to be covered. Inlet discharges directly into Williams Creek--needs some kind of
protection.
- Hamilton County Surveyor, Jerry Liston stated that there are some minor things that
need to be shown on plans. The County is aware of negative drain--it will be taken care
of.
- DOCD, Dave Cunningham stated the highway dept. had faxed a letter of six items of
major concern that need to be addressed. Need a letter from the school system in regard
to the cul-de-sac size. Variance was approved for passing blister.

Williamson Run Secondary - Sections 8, 9 & 10
The petitioner is seeking approval to plat a total of 60 lots on 51.3 acres of land located on the
south side of Carmel Creek, just south of the existing Williamson Run Subdivision.
Richard Henderson appeared before the Committee on behalf of Williamson Run and presented
a brief overview. The second set of street names was approved by Communications; however
the County requested they be changed.
COMMENTS:
- Communications, LuAnne Stephens stated that a list of the new street names had not
been received--delivered to LuAnne today. Randall Drive should dead end--eliminate
Moffitt Drive.
- City Engineer's office, Randy Powell stated that the sanitary sewer easement was to be
submitted today. Need additional information on storm sewer on Section 8 from structure
110 through 101. Randy needs up-dated easement to Carmel--not Fishers. Engineer's
office intended from beginning that channel would be regulated.
Surveyor's Office, Jerry Liston stated that drain needs to be regulated.
- Indpls. Water, No Comment.
- Carmel Fire Department, Stan Puckett received street names just now. Letter sent
yesterday in regard to fire hydrants and water mains now shown on plans. Will review
and comment later.
- Soil & Water, John South stated he had received plans but had not yet had a chance to
review. John South is requesting seeding in the area prior to construction; seeding could
define the area between pond and creek. Detention pond is being used as sediment traps.
- DOCD, Dave Cunningham asked for copy of covenants, landscaping, and additional
signage. Cul-de-sac needs to be to school specs (comment from school). Henderson to
call Roger Harper and explain length.
ASHBROOKE SECONDARY - SECTIONS 3 & 4.
Dave Sexton gave a brief overview of Ashbrooke, Sections 3 and 4. The Petitioner seeks
Secondary Plat approval to plat a total of 56 lots on 22.5 acres of land located on the west side
of Shelbourne Road, just south of 106th Street. Filed by Brenwick Development Co. Petitioner
will be constructing the second of two lakes.
- Chief Engineer's Office, Randy Powell, No comment.
- Carmel Fire Dept., Stan Puckett, No fire hydrant or water mains shown.
- Communications, LuAne Stephens, Street names OK. Comments have been addressed.
- Soil & Water Conservation, John South stated that common areas need to be labeled;
charts for seeding somewhat overworked, can do better; would like to see it changed.

Need detail grading structure lot 124; concern that it is set fairly deep in ground from
lipo to property line--need more detail.
- Hamilton County Surveyor, Jerry Liston stated petitioner needs regulated drain status;
otherwise, no problem with plans.
- DOCD, David Cunningham questioned cul-de-sac lengths.
VILLAGE AT MILLBROOK SECONDARY - SECTION 1
The petitioner is seeking approval (Secondary Plat) to plat a total of 41 lots on 15.4 acres of land
located on the north side of 98th Street,just west of Keystone Avenue. Filed by Estridge Group.
Overview of Section 1 project given by Richard Henderson.
COMMENTS:
- Henderson stated that comments had been received from Hamilton County Highway
Department today. All street names should be approved. Comments have not been
addressed.
- Soil & Water Conservation & Surveyor now have revised plans.
- City Engineer, Randy Powell stated that all concerns have been addressed. County
Surveyor needs to say whether or not they want jurisdiction over drains--no concern to
City Engineer because it is discharging into regulated drain.
- Utilities, John Duffy stated he would talk with his coordinator to review.
- Communications, LuAnne Stephens had No Comments.
- Carmel Fire Department, Stan Puckett stated plans do not show water mains or fire
hydrants. Letter to petitioner went out yesterday expressing concerns.
- Soil & Water Conservation, John South stated he has received revised plans but has not
had a chance to review; aesthetics need work, meets current ordinance. Henderson says
project falls within DNR requirements. South says will approve, but wants restriction on
lake outlet to provide for sediment basin; requests temporary restriction on lake until
erosion control established.
- Hamilton County Surveyor, Jerry Liston stated Section I calculations found--need to
show pond cross-section; safety ledge recommended; needs size of culvert at Carmel
Creek on Keystone.
- City Engineer, Randy Powell stated all concerns have been addressed with exception of
authority over approval of drainage facilities.
- State Highway Dept., refer to letter with points until annexation. Henderson to meet with
Les Locke re annexation.
- DOCD, Dave Cunningham expressed concern regarding lots 7 & 8, no minimum lot
width established; need covenants addressing street lighting, fencing, common area, etc.
Subdivider agreement forms to be submitted. Landscape & signage need to be reviewed
by the Dept. Henderson to furnish set of landscape plans for Mike Hollibaugh's review.

KROGER ADLS
The petitioner is seeking approval (ADLS) to construct at 64,275 square foot grocer store to be
located at 1217 South Rangeline Road, Carmel. The site is located on the east side of Rangeline
Road just north of the existing Pizza Hut. Filed by Jim Nelson for The Kroger Company.
Jim Nelson gave the overview for Kroger. Also in attendance was Nick Alm of Kroger, as well
as Tom Ford and Jim Klausmeier of Pflum, Klausmeier & Gehrum, Consultants.
Kroger agreed to purchase a 5 acre parcel of real estate that is zoned B-8. Kroger will need
approval of the Plan Commission for architectural design, lighting, signage, and landscaping for
a new Kroger store. The request for approval of points of access need to be submitted to BPW
along with new street from Rangeline to existing street. Dave Collaba of Paul Cripe's Office
answered questions regarding landscaping and lighting. Lighting provided by 7 pole-mounts, 40
feet high, single and double lamps, and wall mount on north and south edges of building and rear
of building. Sign on wall will be internally lit letters, variance to be required for size of letters.
There will be a ground sign located at Rangeline ROW. Brian Waltz with Paul Cripe, Inc. stated
that drainage runoff is from north side of roadway with no on site retention.
COMMENTS:
- City Engineer's Office, Randy Powell stated that in regard to utilities, the south tap of
8" line on Rangeline Road to Executive Drive should be eliminated; there should be one
tap off Rangeline and waterline on north side should be an 8" line to Executive Drive to
provide water service. Sanitary Sewer line should run on north side of drive to facilitate
tying multiple lines and separate sewer and water.
- Soil & Water Conservation, John South asked about design detail, perimeter drainage,
standing water, and utility easement.
- Hamilton County Surveyors, Jerry Liston had No Comments.
- Carmel Police Department stated they had reviewed plans and request that currently
planned ingress and egress not exist for safety of citizens.
- Jim Pflum of Pflum, Klausmeier & Gehrum stated that there would be a series of right
turns for delivery trucks to enter parking lot and exit at traffic light.
- Carmel Police Dept. stated they would need further detail for channelling right turns.
Roger Conn to review. Jim Nelson will meet with Roger Conn to be sure of drawing for
right in and right out and will return to TAC on 4-23 for final review.
- Carmel Utilities, John Duffy said that current plans show an outside meter. Utilities is
requesting an inside meter for accessibility. Incoming service line request RP device for
overflow and backflow device for potable water and sprinkler. Sprinkler and water
knocksbox comment letter to be sent to Jim Nelson.
- Indiana Gas, Jeff Autry asked if Kroger was aware of gas easement.
- Communications, LuAnne Stephens, No Comments.
- DOCD, Dave Cunningham stated that the name of proposed street is to be approved by
Mayor's office. Kroger should contact Mayor Johnson. Dave is awaiting landscaping

plans. Dave questioned 40" versus 30" light fixture. Kroger responded that typical
fixture tied to wattage for even amount of light. Dave is requesting research of 30' poles.
Signage to be done at later date. Timing set for May Plan Commission approval.
Construction to commence later this year. Concern on entrance right in--right out;
concern with first entrance off Rangeline. There will be a raised median in front of
Kroger making a left turn impossible.
- Jim Nelson stated Kroger would like to present plan to BPW on May 5 for
informational purposes only.
- City Engineer, Randy Powell suggested going to BPW to present plans, give reasoning,
get BPW input, then return to Board for approval of curb cuts, dedication of roadway and
signalization. Conceptual plans to be given to Jim Nelson who will then request to be
put on BPW agenda for 4-21 for review and comments.
- DOCD, Dave Cunningham stated that plans show trash area uncovered; cart corral needs
to be landscaped, outside storage for seasonal sales products needs to be defined. Front
sign needs to be set back 5' from ROW.
- Paul Cripe, Engineers, Dave Callaba stated that the B-8 zoning has no landscaping
requirement.
- DOCD, Concern of staff is that the amount of plant material taken out does not equal
what it being put back in new landscaping. Staff has addressed an alternative plan to the
petitioner in regard to landscaping, the result of which is the loss of a few parking spaces
and the gain of much needed trees. Staff suggested trees be retained along south and
east edges. Perimeter treatment of trees along roadway needs to be addressed. Mike
Hollibaugh suggested that street trees be included along ROW of Rangeline--who would
maintain, City or Kroger? Mike and Dave both agreed that trees would very definitely
be an issue on this proposed project and would likely be turned without some needed
landscaping.
- City Engineer's Office, Randy Powell stated that there is presently a code in existence
for street trees.
Kroger will return to TAC on 4-28-93.
CAITO POND
The petitioner is seeking approval (Special Use) to construct a pond located on the east side of
West Road, north of 121st Street, Clay Township. Filed by Jim Caito.
COMMENTS:
- No Comment from City/County Agencies
- DOCD, Tac approves as submitted. The well will be used as auxiliary for irrigation
system. A conceptual landscape plan will be formulated and presented at the hearing; the

petitioner does not want to commit at this time. The petitioner has agreed to install
sidewalks when a sidewalk plan has been implemented on adjacent properties. The
petitioner has agreed to dedicate a 40' ROW on West Road. The petitioner has also
agreed to a non-opposition annexation.
R & D SUBDIVISION PRIMARY PLAT
The petitioner seeks approval (Primary Plat) to plat 3 lots on 1.17 acres of land located at 108th
and McPherson, Clay Township. The site is zoned R-3. Filed by Dan Chapman.
COMMENTS:
- Dan Chapman submitted letters from County Highway and Surveyor stating that all
comments have been addressed.
- Soil & Water, John South recommended a central access easement to service all three
lots (as opposed to three separate driveways). This measure would prevent unnecessary
earth disturbance and construction expense.
SOWN BY HAND
The petitioner is seeking approval to construct a roadside sales stand for farm and non-farm
produce located on the west side of Rangeline Road, across from 126th Street intersection. Filed
by Ken Mix.
Sid Fields appeared before the Committee on behalf of Ken Mix.
COMMENTS:
- DOCD, Rick Brandau stated that access is of prime concern, however, from zoning
standpoint, if a property owner has five acres or more, they are permitted a roadside
stand, and essentially are exempt from the ordinance. The DOCD will be looking at this
as a standard, temporary use.
- City Engineer, Randy Powell stated curb cut exists; no documentation found of
dedication of ROW along Rangeline; ingress/egress easement will need to be obtained
from Harry Elliott.
- Carmel Police, (Officer Meeks), City Engineer and DOCD all suggested looking into
access in the parcel from the south i.e. Kroger plaza. If access cannot be obtained, the
submitted, proposed scheme will be acceptable, a copy of the recorded, signed easement
from Harry Elliott will need to be submitted. Also, a right turn only will need to be
posted to prevent cross-lane, north bound turning movements.
-DOCD, this proposal may only market produce which is grown on this property.
Otherwise, they will need to apply for a special use from the BZA for a commercial
stand. NOTE: No water and sewer are planned, water can be obtained from the hydrant

shown on site plan (part of file) only the 10X20' stand will be constructed at this time.
Special use approval will need to be obtained for the 20X20' temporary
greenhouses..signage permit will need to be submitted to DOCD.
CARMEL CHURCH OF CHRIST - SCIENTIST
The petitioner is seeking approval (Special Use) to construct phase I of a church facility located
on the south west corner of 116th and Haverstick. Filed by Virginia Kerr.
Fred Parker, Virginia Kerr, and Wendel Tucker appeared before the committee on behalf of the
Church.
All TAC members have not received copies of the plans--this will be a preliminary review;
petitioner will need to appear at the next TAC meeting of April 26.
COMMENTS:
- DOCD, questioned the lot lines. Depending on the record of the property, this may be
a subdivision which would require plan commission's approval.
- City Engineer, concern regarding sewer access within the Haverstick ROW, also the
lateral will need to be placed within a 15' easement (if adjacent to the ROW). Board of
Public Works approval required for two commercial curb cuts along Haverstick as well
as sewer and water availability. Approval can be in form of letter from BPW to City
Engineer's office. Water service line needs to be placed with a 15' easement from 116th
Street to the property in question. Randy Powell requested copy of storm calculations and
recommended that PVC not be used within the conveyance system--show depth of 100
year storage within the basin on the plan. Permission will be needed to tie storm sewer
into the school's system.
- Soil & Water Conservation, John South stated more erosion control needs to be shown;
need to protect inlets; need to show stabilized construction entrance on the plan; sprinkler
will be needed for the basement if over 1500 sf.
SPRINGMILL LAKE
Appearing for Springmill Lake were Don, Elmer & Denny Botammiller; Mike Little and Mike
Terry, ASLA, and Jim Nelson, attorney.
Springmill Lake project will be located at 12121 Springmill Road. Both existing and future
homes will be maintained and incorporated into the project which will include 44 single family
homesites on 25 acres; two road cuts required and 2 variances 6.3.3 length of cul-de-sac and stub
street requirement.
COMMENT:

- Gas Company, Jeff Autry needs full set of plans; will highlight where conduits will be
needed and work with petitioner.
- Communications, LuAnne Stephens stated street names are OK--addition's name will
need to change as per communications and fire dept. Petitioner to contact Jerry Lowe and
Dan Stevens for final division name approval.
- Soil & Water Conservation, John South stated that drainage calculations did not appear
to include offsite from the East -- DOCD requests that this be addressed in writing.
- Hamilton County Highway, the petitioner has received comment letter dated March 19,
1993; petitioner is short on dimension for the decel lane. South additional land not
become available, a variance will be required. Notice will need to be made, etc.; the
petitioner will make a commitment to install passing blister, written agreement to follow.
- County Surveyor, has not received further comments beyond letter last fall.
- DOCD, what is the status of the comments from the surveyor?DOCD Needs an up-date.
