The applicant also seeks the following Subdivision Waivers: Docket No. 06020019 SW: SCO Chapter 6.05.01 Lots - request to permit lots with less than 50 feet of right of way frontage Docket No. 06020020 SW: SCO Chapter 6.05.07 Orientation of Home - request to allow dwellings to face internal street Docket No. 06020021 SW: SCO Chapter 6.03.07 Cul-de-sac Length - request to have cuI de sac in excess of 600 feet in length Docket No. 06020022 SW: SCO Chapter 6.03.21 Stub Streets - Request to have onll one point of access (no stub streets) The site is located at 4343 W. 138 Street and is zoned SI Residential Filed by Allen Weihe of Weihe Engineering for JC Developers, LLC. The applicant is requesting approval of a Primary Plat to allow the construction of single family detached homes. Please see the updated informational packet prepared by the applicant for an overview of this project. This project is proposed to have private, gated streets, and requires the above listed waivers. This item was heard at the March 21 st Plan Commission Meeting. At the March 30th Subdivision Committee it was forwarded back to the Plan Commission with a 4-1 positive recommendation, with the condition that all outstanding issues must be resolved prior to this meeting. The outstanding issues and their current status include the following: 1. Update on landscape plan approval: Plan has yet to be approved. The landscape plan was submitted on April 12th. a. Plan does not show separation of utility easements and plantings. Plan should have utility information overlaid so that conflicts can be identified. b. Plan does not have additional screening along West Road right of way (as requested to mitigate the waiver). 2. Justification for the requested waivers and information on how the waived standards will be mitigated: Applicant has made some architectural commitments (see packet). Staff has proposed some alterations to these commitments. 3. Petitioner has not addressed Engineering comments made in the Feb. 15th T AC review letter. Staff has not received full approval from Engineering. o o Staff recommends the following additions and alterations to the proposed commitments (from the updated packet). Note that all commitments MUST be recorded: 1. Item 5: Windows for All Homes - should be amended to say "All homes in The Woods shall have windows on all occupiable floors, on each elevation." 2. Item 8: Lots Adjacent to West Road - typical landscape mitigation for views from the right of way require a higher level of bufferyard planning (from the bufferyard standards outlined in Chapter 26 of the ZQ). This additional landscape bufferyard requirement should be reviewed and approved by the Urban Forrester. 3. Please add the following: The petitioner is responsible for required upgrades to West Road along the project frontage as identified by the City of Carmel Thoroughfare and Alternative Transportation Plans. These improvements must be constructed or funded (for future construction). City Engineering is responsible in determining these improvements (or cost thereof). As requested by the Subdivision Committee, the petitioner will present views into the site from West Road at the meeting. This item should be considered with the entire Woods at Lions Creek .t>etition. This additional required subdivision waiver was identified at the March 30 Subdivision Committee meeting. The petitioner has met the State required notification deadline (10 days), but did not meet the Plan Commission requirement of 25 days. This item will require a suspension of the Plan Commission rules to be heard this evening. The department recommends making a decision on this item after the next agenda item has been discussed. This waiver should not be considered by itself, in that it intrinsically tied to the primary plat request.
