DEPARTMENT REPORT

(V) Cooper Lot Cover Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2022-00196 V UDO Section 2.08 Maximum 35% lot coverage allowed; 44%
requested. The site is located at 12111 Castle Row Overlook (Brookshire Subdivision, Lot 92.) It is zoned
R1/Residence. Filed by Mark Cooper, owner.
General Info & Analysis:
The Petitioner recently gained approval to construct a swimming pool in the back yard. Now, they want to
expand and add a concrete patio area. The maximum allowed lot cover is 35%, and 44% is requested. This is an
increase of 9%. Please see the Petitioner’s info packet for more detail on the variance requests.
The Brookshire Homeowners Association approved the plans, as well as the surrounding adjacent neighbors.
The Carmel Engineering Dept. has no comments or concerns about the increased lot coverage.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00196
V, and with adoption of the Findings of Fact submitted by the Petitioner.
