The applicant seeks the following development standards variance approval for three duplexes: 3. Docket No. PZ-2022-00183 V UDO Section 2.12 Minimum 800 sq. ft. ground floor area for Two Family Dwellings (All Other Uses) required; 525 sq. ft. requested. The site is located at 1040 E. 108th Street (Home Place Subdivision, Section 1, Lots 221-223) It is zoned R3/Residence. Filed by David Klain of DB Klain Construction, LLC on behalf of Brason Properties LLC. General Info & Analysis: The Petitioner seeks approval to construct three two-story tall two-family dwellings (duplexes) on three lots. A variance is requested for a reduced ground floor area. Surrounding land uses are single family homes and two family homes. Please see the Petitioner’s info packet for more detail on the variance request. Three duplex buildings are proposed. They will be two-stories tall and will each have an attached garage. 3 bedrooms and 2.5 bathrooms are proposed for each dwelling unit. A minimum of 800 sq. ft. ground floor area for Two Family Dwellings (All Other Uses) is required. And, 525 sq. ft. per dwelling unit is requested. This is a variance of 275 sq. ft. or 35%. The Carmel Building & Code Safety Dept. researched this proposal against the residential building code and found that there would be no conflicts with the proposed ground floor square footage. Even though the subject property is three separate platted lots, 1040 E. 108th Street is shown as one big tax parcel. The Petitioner is working with the Hamilton County Real Property Dept. to get the one tax parcel split into three, so that it reflects the 3 currently platted lots. This needs to be done before building permits can be pulled. (The Petitioner stated that they will have this completed prior to applying for building permits. Their title company will take care of this when they get their financing for the project.) The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance request. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00183 V, with the understanding that the tax parcel needs to be amended to reflect the shapes of the three currently platted lots, and with adoption of the Findings of Fact submitted by the Petitioner.
