It is the following: (SE) Elliott Short Term Residential Rental. The applicant seeks the following special exception approval: Docket No. PZ-2022-00213 SE UDO Section 2.05 Residential Special Exception. The site is located at 10828 Timber Ln. (Jordan Woods Subdivision Lot 95). It is zoned S2/Residence. Filed by Thomas & Karyn Elliott, owners. FILING FEES: Initial Special Exception, STRR $107.00 Total Due: $107.00 Filing Dates & Deadlines - Petitioner, please note the following: 1. This item does not need to be on any meeting agenda of the Technical Advisory Committee (TAC). However, please email all TAC Members your proposal, for review comments or concerns. 2. All Mailed, Posted, and Published Public Notice needs to occur by Friday, Nov. 18 (but may occur earlier). Due to the site’s area zip code, the published notice (legal ad) is required within The Current in Carmel*; please contact them at least 14 days prior to that in order for them to publish it on time (317-489-4444 or legals@youarecurrent.com). The mailing of letters to adjoining property owners & placement of public hearing sign on the subject property is also required by the BZA Rules of Procedure, Article VI, Section 6 (see Handout/Application and see Calendar). Make sure the public notice meeting time in the newspaper, on the sign, and in letters to neighbors read 5:15 PM nd and that the location on the legal ad and mailings read: Carmel City Hall Caucus Rooms, 2 Flr, Carmel, IN 46032. And, the location on the sign can just read Carmel City Hall. 3. The Filing Fee , 1 digital copy of the BZA Info Packet, and 3 paper copies of the BZA Info Packet must be delivered to BZA administrative assistant Joe Shestak no later than Noon, Friday Nov. 18. (Failure to submit the Fee and Informational Packet by this time will result in the automatic tabling of the petition.) Please include the following in your Info Packet: 1 a) Short memo/letter introducing the project b) Statement of Special Exception request (short paragraph explaining what you are asking for) c) Statement of Support (short paragraph explaining reasons supporting the request, including analysis and comparisons of what is allowed vs. what is proposed) d) Location Map e) Reductions of all plans (location map, site plan, parking plan, aerial photo of site, photos of site and house exterior, etc. on 8.5”x11” or 11”x17” paper. f) Page 7 of Handout/App. – Findings of Fact sheet (question sheet filled out, statements completed) g) Any other pertinent information for the Board to explain this request (such as neighbor letters of support, HOA approval, etc.). 4. The Proof of Notice needs to be received by this Department no later than Noon, Wednesday Nov. 23. Failure to submit Proof of Notice by this time will result in the tabling of the petition. 5. This item will appear on the Monday Nov. 28 agenda of the Board of Zoning Appeals Hearing Officer under Public Hearings, at 5:15 PM. 6. Either the Petitioner or someone representing the Petitioner must attend the meeting to present the item to be heard. If no one appears, it will be tabled. 7. Please refer to your application’s instruction sheet for more detail. Preliminary Review Comments - Petitioner, please respond in writing to the following by noon, Friday Nov. 18: a) Please make checks payable to City of Carmel. b) Provide a copy of the Official List of Adjacent Property Owners from the Hamilton County Auditor’s Office. (Make sure to check ‘Carmel BZA’ on their form.) c) *The Current in Carmel only prints on Tuesdays, and their filing deadline is usually 14 days prior to their printing date. Please submit your Word file of the legal ad to them by Noon, Friday Nov. 4 so that it prints on time. Their contact info is 317-489-4444 or legals@youarecurrent.com. (Use the Notice of Public Hearing form in the Handout as a template for what to have published in the newspaper and what to mail out to the neighbors.) d) The mailings/notices to the neighbors should be done by first class mail with Certificate of Mailing (not Certified Mail). (Please provide us with the certificate of mailings for the file before Noon Wednesday, Nov. 23.) e) Please provide the filled out & notarized Placement of Public Notice Sign Placement Affidavit form (found in Handout) once the sign is placed. f) Please provide the filled out & notarized Petitioner’s Affidavit of Notice of Public Hearing form (found in Handout). g) Please provide the filled out Notice of the Public Hearing form/template (found in Handout). h) Please provide proof of notice, such as Publisher’s Affidavit from the newspaper, once you receive them. i) Please submit a parking plan for the site. j) How many rooms do you want to rent out? k) Will you be renting out the home through AirBNB, VRBO, HomeAway, or similar platform? l) Will you be renting out the entire house and not be on-site while renters stay there, or will you be on-site while there are renters staying? m) Please view UDO sections 9.08.C and 9.08.D regarding the criteria that are the basis for review, and make sure you address those, too. n) Please note that the City Council passed a resolution to allow for 30 specific dates to be exempt from the Short Term Residential Rental requirements in 2022. Please see City Council resolution CC-02-07-22-01. o) Please make sure to list out the true practical difficulties and hardships associated with having to comply with the zoning ordinance. 2 p) Please note that if approved, the Special Exception is only valid for one year, per UDO Section 5.72. q) Please submit items 14, 16, and 17 required from page 11 of the Special Exception Handout. r) Sidewalks along the streets are required per UDO section 1.07.
