I’ve issued the Board of Zoning Appeals (BZA) Docket Number for this item. It is the following:
(A) Appeal, Director’s Acceptance of Buckingham Multifamily Project Application: Docket No. PZ-2022-00225 A.
The Petitioner seeks to appeal the Carmel Dept. of Community Services Director’s decision to accept and docket the DP/ADLS
application for the Buckingham Multifamily Carmel Midtown project (Docket No. PZ-2022-00202 DP/ADLS) proposed for a
portion of the former AT&T site located at 210 3rd Ave SW. The site is zoned C2/Mixed Use. Filed by Charles Demler.

Filing Dates & Deadlines - Petitioner, please note the following:
1. This item does not need to be on any meeting agenda of the Technical Advisory Committee (TAC).
2. All Mailed, Posted, and Published Public Notice needs to occur by Tues., Nov. 8 (but may occur earlier).
Due to the site’s area zip code, the published notice (legal ad) is required within The Current in Carmel*; please contact
them at least 14 days prior to that in order for them to publish it on time (317-489-4444 or legals@youarecurrent.com).
The mailing of letters to adjoining property owners & placement of public hearing sign on the subject property is also
required by the BZA Rules of Procedure, Article VI, Section 6 (see Application and see Calendar).
Make sure the public notice meeting time in the newspaper, on the sign, and in letters to neighbors reads 6:00 PM and that

the location on the legal ad and mailings read: Carmel City Hall, 2 Flr Council Chambers, 1 Civic Sq, Carmel, IN 46032.
And, the location on the sign can just read Carmel City Hall. (Please refer to the Handout for a template of wording to use
for the legal ad and the mailings.)
3. The Filing Fee, as well as 3 paper copies + 1 digital copy of the BZA Info Packet, must be delivered to BZA administrative
assistant Joe Shestak no later than Noon, Fri., Nov. 18. The filing fee should be delivered to Joe, or the fee can be called in
and paid via credit card (with a small processing fee). Failure to submit the Fee and Info Packets by this time will result in
the automatic tabling of the petition.
Please include the following in your BZA Info Packet:
a) Short memo/letter introducing the appeal/request

b) Statement of Request (short paragraph explaining what you are asking for)
c) Statement of Support (paragraphs explaining reasons supporting your appeal request)
d) Location Map
e) Reductions of all plans (site plan, aerial photo of site, building exterior architecture, etc. on 8.5”x11” or 11”x17” size).
f) Page 8 of Handout – Findings of Fact sheet (question sheet filled out, statements completed)
g) Any other pertinent information for the Board to explain this request.
4. The Proof of Notice needs to be received by this Department no later than Noon, Wed., Nov. 23. Failure to submit Proof
of Notice by this time will result in the tabling of the petition.
5. This item will appear on the Mon., Nov. 28 agenda of the Board of Zoning Appeals regular meeting under Public Hearings,
at 6:00 PM. (This will be an In-Person meeting.)
6. Either the Petitioner or someone representing the Petitioner must attend the meeting to present the item to be heard. If
no one appears, it will be tabled.
7. Please refer to your application’s instruction sheet for more detail.
Preliminary Review Comments - Petitioner, please respond in writing to the following by Noon, Fri., Oct. 18:
a) Please make checks payable to City of Carmel if you are paying via check.
b) Provide a copy of the Official List of Adjacent Property Owners from the Hamilton County Auditor’s Office. (Make sure to
check ‘Carmel BZA’ on their form.)
c) *The Current in Carmel only prints on Tuesdays, and their filing deadline is usually 14 days prior to their printing date.
Please submit your Microsoft Word file of the legal ad to them by Fri., Oct. 28 so that it prints on time. Their contact info is
317-489-4444 or legals@youarecurrent.com. (Please refer to the Handout for a Template of wording to use for the legal ad
and the mailings.)
d) The mailings/notices to the neighbors should be done by first class mail with Certificate of Mailing (not Certified
Mail). (Please provide us with the certificate of mailings for the file on or before noon, Wed., Nov. 18.)
e) Please provide the filled out & notarized Placement of Public Notice Sign Placement Affidavit form (found in Handout) once
the sign is placed.
f) Please provide the filled out & notarized Petitioner’s Affidavit of Notice of Public Hearing form (found in Handout).
g) Please provide the filled-out Notice of the Public Hearing form/template (found in Handout).
h) Please provide proof of notice, such as Publisher’s Affidavit from the newspaper, once you receive them.
i) Additional review comments (if any) will be issued through ProjectDox, our online plan review software.
