Re: BZA Docket Nos. PZ-2022-00197 V, -00198 V, & -00199 V: Hinkebein Backyard Variances
Dear Mr. & Mrs. Hinkebein:
At the meeting held on Monday, October 24, 2022, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) requests filed by you for the property located
at 510 2nd Ave NE:
APPROVED with Conditions: Hinkebein Backyard Variances approvals:
1. PZ-2022-00197 V - Maximum 45% lot cover allowed, 70% granted,
2. PZ-2022-00198 V - Minimum 5’ setbacks required, 1’ setback granted in front yard (south),
3. PZ-2022-00199 V - Maximum 42” tall fence in front yard allowed, 6’4” granted. And, minimum 1’
fence setback from sidewalk granted, 3-6” setback granted, and with
Conditions: 1). Pay into the Stormwater Fund, 2.) Provide DOCS with a copy of the recorded Pedestrian
Access Easement, and 3.) Maintain visibility within the Vision Clearance area of the alley and Small St.
as discussed at the public hearing.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is October 24,
2025.
