Docket No.PZ-2022-00045 DP/ADLS:Jackson's Grant Village Section 2 The applicant seeks site plan and design approval for 52 townhomes and an amenity building on 8.83 acres. The site is located at the NW corner of 116th Street and Springmill Road. It is zoned Jackson's Grant Village Planned Unit Development(PUD)(Ordinance Z-653-20).Filed by Douglas Wagner with Republic Development LLC. Petitioners: Doug Wagner,Republic Development;John McKenzie,Builder • Passed out handouts, Explained the handout which provided answers to Staffs questions,questions from the public hearing,and updates and questions answered from the last Committee meeting • Question 1: Can a window be added to the rear of the building to break up wall?We added two small 18" windows on the second floor to the master bedroom to help breakup the bedroom wall space. • Question 2: Can some additional brick be added on the second floor balconies and second floor rear elevations? There are no supporting walls under these areas,and we already exceed masonry requirements in the PUD. We won't do the thin brick on the rear elevations. • Question 3:Please consider more variation in the details between units such as shape of windows, details around windows and entryway details. We have provided color representations of the various elevations in the packet • Question 4:Provide elevations for 4-, 5-unit buildings. Color elevations are in our packet. • Question 5: Will there be mailbox kiosks?No kiosks unless required by US Postmaster.Individual mailboxes will be in the rear of the townhomes. • Question 6: 1 shade and 1 ornamental tree for every 2 townhomes is required. We have revised our landscape plan to reflect this. Last meeting,we were asked if additional landscaping can be added to the side of the units facing the street. We are committing to adding a minimum of 7, 18-24"shrubs to the street size of an attached unit. We have provided maps with location of these units with the additional shrubs. Street trees will also be provided throughout this development. • Question 7:Add a tree near each back corner of each townhome building and in between any driveways where room allows. We are committed to have trees on each corner,as now shown on our landscaping plan.The areas between the driveways won't be large enough to support a tree.If space allows it,the homeowner can add one. • Can Staff explain their comment about the lighting?Alexia Lopez: The PUD has certain lighting standards.The light bulb isn't visible(they are shielded)so it doesn't shine bright.Doug Wagner: Handed out the lighting info. Carrie: Can we use a different bulb or lower wattage?Would opaque(frosted)glass help?John McKenzie: We understand the intent of the lighting language in PUD.We can use a recessed type lighting in the porch.Josh: Double check on light bulbs used for the rear elevation so it also meets the PUD requirement. • The PUD requires 210 parking spaces. We will provide 283. This does not include the on-street parking or the two driveway spaces for the single-family homes. We will put'no parking' signs in the alley. • The Plan Commission(PC)commented in having a flat roof design for the amenity clubhouse.There's a concern over having the townhome units looking down into a one-story flat roof building is not desirable. • Larry Moon,who gave the presentation in front the PC was not aware of the tree preservation area(TPA) violations occurring in Jackson's Grant(JG). We have our own grounds committee made up of JG homeowners. They sent letters to 8 homeowners with the worst of the violations. Email blasts were sent to all of JG homeowners of these violations. Communications with 3 of the homeowners have been responsive and we have been working closely with the Urban Forester(Daren Mindham)and City Legal Dept.to renotify the other 5 homeowners. The homeowner of the worst violation said they would take care of their TPA violations in 2 weeks, 1 Residential Committee Minutes 8-2-22 but they haven't done anything yet.We will install TPA signs in the rears of the JG properties along this area. Department Report: Alexia Lopez: • The Petitioner has responded to all our outstanding comments. Staff recommends favorable recommendation back ii to the full PC. II Committee Comments: Christine: Is there enough room still to add a bed along that wall in the master bedroom?Doug Wagner:Alexia(Staff) did the math and there will be enough room. Alexia Lopez: The room is 12-ft wide,a king size bed is 6-7-ft,and the windows are 1 'V2 ft wide. Josh: I drove through a newly constructed neighborhood and this Committee asked for a full wrap masonry.They ended up with full brick in the rear and stone in the front.I want to make sure we get what we are asking for.Doug Wagner: We will have all brick and no stone.Alexia Lopez: That PUD did ask for full masonry but did not specify what type. Josh: Street trees are great,but I requested to add more trees where room allows to provide shade along the ally drives. Doug Wagner: We anticipate small areas between the driveways along the ally drive. They might not be large enough to support a tree.We would prefer to not commit any additional trees in this area but rely on the homeowners to add trees in their landscape plan if space is available. May have conflicts with the utilities in these areas. Josh: From experience,TPA signs are usually taken down by the nearby homeowner.If I was going to do this,I would put a single semi-permanent red stake in the TPA that borders the JG residential rear yards.I would recommend everyone who buys a property to inform them what the red stake represents.According to the current aerial views,I believe you only have 2 offensive violators left out of the initial 8. The worst offender has clearly built hardscaped structures and cut down trees in the TPA. This homeowner has not done anything to become in compliance and is clearly telling his neighbors he won't do anything. I do not want to agree to another set of rules now, if the HOA cannot enforce the existing ones.I would like to have all the hardscape structures within the TPA removed and set up a program with the Urban Forester to reinstate this TPA. Christine: Can you combine what Josh is proposing and combine it with what the HOA wants to do?(Sending letters,place a sign,fixing the issue and sending them a bill).Doug Wagner: Our letter stated,we are putting up signs,and if they decided to not comply,we would add a woven-wire fence around their rear yard property so they cannot mow,remove trees,and build structures in the TPA. The letter to the homeowner with all the hardscape improvements(worst violator),stated we would remove the hardscape structures,charge them for the removal,and if they didn't pay,we would put a lean on their property. Sue: Are all these TPA commitments transferring to the HOA once the 5 board members are turned over?Doug Wagner: Yes,and we have an amenities and grounds committees already set up and involved in the HOA.Josh: Do you think you are able to rectify the problem with the new HOA?Doug Wagner: Grounds committee wants this taken care of.There are liabilities if someone is injured within the TPA area.Josh: How are you going to establish this TPA?Doug Wagner:New HOA board members will be aware of the TPA,and it will be marked with signs,and fencing if needed.I am optimistic on achieving results. Our Grounds Committee looks at it as a problem and not a burden.I'll continue to work with them.Alexia Lopez: The Urban Forester will stay on top of this issue.If the JG homeowners don't resolve it,Code Enforcement will go after them.Doug Wagner: We want a letter from the City in what needs to be done to our worst offender.Josh: A very aggressive letter from Urban Forester to Republic with very specific requirements about everything going back to its natural state.Doug Wagner: I recommend it goes to the JG HOA and not Republic, since JG owns this property(TPA). Sue: Have we agreed on the color pallets for the townhomes?John McKenzie: We are committing to this pallet,refers to renderings.Doug Wagner: There's language in PUD about streetscape diversity.No unit within a building shall have the same combination of building material,elevation,and color pallet.John McKenzie will predetermine the colors of each building within a unit.John has added the 4-unit and 5-unit color pallet to our packet.
