1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
A varied setback for the accessory building/barn will not impact area properties, the actual separation distance
between the locations of the primary residence and the accessory building minimizes the visual impact of the
setback relationship between the two buildings and the variance will allow for construction outside of extensive
floodway on the property.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The proposed accessory building location and setback on this very large parcel places the proposed accessory
building away from the street right-of-way and adjacent dwellings and out of the floodway within a wooded area of
the parcel without impact to the use and value of adjacent property.
3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical
difficulties in the use of the property because:
The parcel is extremely impacted by floodway and floodplain/fringe such that other setback-compliant areas on
the parcel are closer to adjacent dwellings whereas the proposed location is isolated from adjacent dwellings.
DECISION
It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
t'`Z-202.2 -00Ig1 V is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
