CARMEL ADVISORY BOARD OF ZONING APPEALS

Petitioner: Keith and Mary Hinkebein
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the improvements are all on private property and nothing
hazardous is being constructed/installed.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because it is an improvement to the existing property. Therefore,
it will raise the value of adjacent properties.
3. The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because the bar/kitchen area and fireplace cannot be
constructed on a permeable surface. Also, the remaining outdoor living space will be semi-
permeable pavers so that outdoor furniture can be placed throughout the area.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. _PZ-2022-00197 V_ is granted, subject to any conditions stated in the minutes of
this Board, which are incorporated herein by reference and made a part hereof.

1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the improvements are all on private property and nothing
hazardous is being constructed/installed.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because it is an improvement to the existing property. Therefore,
it will raise the value of adjacent properties.
3. The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because if the variance setback is not approved, then the
backyard space is not big enough to complete the project. The kitchen/bar area needs to be pushed
out closer to the sidewalk to allow enough space to get around the bar area. By not pushing this
out closer to our property line, we would be very crowded in the area coming down the stairs from
the porch and entering the grilling area.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. _PZ-2022-00198 V_ is granted, subject to any conditions stated in the minutes of
this Board, which are incorporated herein by reference and made a part hereof.

hazardous is being constructed/installed.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because it is an improvement to the existing property. Therefore,
it will raise the value of adjacent properties.
3. The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because if the fence variance setback is not approved, then
the backyard space is not big enough to complete the project and will significantly cut down on
usable space. Also, if the fence is not at least the height specified on the plans, then our privacy
would be compromised.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. _PZ-2022-00199 V_ is granted, subject to any conditions stated in the minutes of
this Board, which are incorporated herein by reference and made a part hereof.
