Carmel , IN 46032 RE: 44 Horseshoe Lane, Carmel, IN 46033 Dear Sir/Madam, I am writing this letter to express my strong opposition of the zoning request for the variance of use for 44 Horseshoe Lane, Carmel, IN 46033. This property is in a neighborhood of single-family residences, maintained under the covenants established by the Woodland Springs HOA. The covenants per Section 6.1 Residential Use of Units all lots should be used for residential purpose. The properties only use is a single housekeeping unit. A “resident” may operate a home-based business in accordance with Section 6.1 (b), however this property is not owner occupied. The legal definition of an apartment is a part of a house occupied by a person, while the rest is occupied by another or others. This single-family residence is going to be occupied as an apartment with 9 separate living areas that will have a daily cost associated with each occupant. In this instance the applicant is calling this a group home. A group home accepting payment for services offered at the residence is engaging in a commercial activity. This is not what this property is zoned for or allowed under the covenants of the Woodland Springs HOA. The negative impact on the values of our property will be seen by home owners in this area if this variance of use is approved. Please consider the long-term negative effect this could have on both Woodland Springs, and the City of Carmel if this variance is approved. Thank you, Josh & Dana Coulter
