I have since been in to talk to a few people and just wanted to send some pics from the two streets where we are working. There are no sidewalks in this neighborhood. There are multiple locations with paver approaches and even one gravel drive. The one three doors down from our project was put in a few weeks ago. The last picture is of a house next to another one I build a few years back that is very similar to what they are wanting to do. No variances were obtained to do this project at 11004 Crooked Stick Lane. I spoke to our landscape architect who also said he has never in his career been told that gravel is the same as concrete and asphalt. I feel like there has to be a better explanation than we just have to use brushed concrete between the right of way and the private property line as well as this gravel issue. Any thoughts? It was good to talk with you earlier, appreciate your paence with all of us in DOCS while final issues with your project are ironed out. Let me start right in on the issue of parking pavement standards. The zoning ordinance applies equally to residenal and business zoned property, including the required paving material of asphalt or concrete. The language is a lile ‘commercial heavy’ but the parking standards for residenal are a lile less complicated, generally. I am not able to waive that standard and would support a variance of that standard in front of the hearing officer, which is looked at as a minor deviaon from the rules. I can’t give a 100% guarantee of success but normally, +95% of the me, if it ’s on the Hearing Officer agenda the hearings go quickly and variances are approved. I spoke with Chrisne and Adam about issuing a temporary Cerficate of Occupancy to allow full move into the house. They are on-board with that aer passing final inspecon. I would request a brief wrien assurance about the connecon construcon underway, if you can perhaps respond with a short descripon of the construcon in the works primarily what the connecon will look like and level to which it will blend in and complement the house style, roof style and materials. That would also include the arrangement worked out with Engineering about the driveway apron and if that requires addional approval or can be signed off administravely. Chrisne and Adam are also on-board with leaving the exisng pavement in place to help with construcon staging, etc. The full C/O for the house will be issued when the following are completed: 1. Passing final building inspecon 2. Granng of variance for driveway pavement 3. Compleon of physical connecon between main house and accessory building, which of course includes passing final inspecon 4. Restoraon of yard aer removal of pavement 5. Issuance of c/o for pool. There is a high comfort level with staff and me on all the above. If you have addional quesons or I can assist further in anyway, please email or call anyme. I won't go into all the detail but I left a plot plan with your office and they took some notes to give you on the issues we are having with getting a C of O, and drive material selections. I was given codes from the UDO which talk about parking lots and not drives? Unfortunately this is all super time sensitive and I hope you can work with me to get some sort of resolution that the inspectors will be ok with so my homeowners can move into there house a few weeks from now. Thanks for subming this to the commiee. The HOA Covenants restrict the construcon of a street facing garage, however as you know there is significant precedent for this occurring historically. Three years ago when we amended and restated our covenants, it was our goal to try to adhere to the “intent” of the covenants without being overly restricve prevenng projects that actually increase property values and upgrade/update homes, despite being outside the confines of what was wrien in the covenants. With this said, a compromise that we have made in the cases since the ARC was more formalized, has been to request enhanced landscaping at the street border of the property to help screen street facing garages. This can be bushy trees, shrubbery, etc. that from the street catches your eyes vs. immediately focusing on the garage. If this compromise works for you, we are prepared to offer you this condional approval for your project.
