Throughout the years we have been under the impression Woodland Springs along with the area east of Keystone was zoned only for residential use. We have also been reminded, over the years, Woodland Springs is regulated by a Declaration of Covenants outlining acceptable and unacceptable actions and uses of the properties located in Woodland Springs. Our understanding has been that the covenants apply to the land. Article 6 of the Covenants and Restrictions for Woodland Springs state all lots should be used exclusively for residential purposes and the occupancy for single family use. Using the property at 44 Horseshoe Lane to house up to 9 unrelated individuals for a fee would violate the covenant requiring the property be used exclusively for single family use. Housing those individuals for a fee would also appear the endeavor will be commercial business not allowed by the current zoning and the covenants. We are opposed to the variance because the property will be a commercial (business) housing a number of unrelated individuals operating in an area that is not currently zoned for that purpose and the property will be used in violation of the covenants governing the use of said property. We also oppose the variance because we feel granting the variance will expose the residents of Woodland Springs and all other residential neighborhoods east of Keystone to attempts by other individuals or businesses to gain the same treatment for proposed commercial uses in their residential neighborhoods. Approving this variance will reward the Petitioner for proceeding with the use of a property that they knew, or should have known, was not zoned for commercial use and also was restricted for such use by the Woodland Springs Declaration of Covenants.
