Comments below are for consideration with regards to the Crossfields Lot 21 detached garage - The Frye Residence.
As the zoning committee may or may not know, the Crossfields HOA Board was negligent in their duty and the
responsibilities in carrying out our their actions as Board members. The Board clearly did not follow the governing
document of the Crossfields HOA. Their legally unsupported decisions and actions have allowed the current detached
garage request to be brought to your attention.
The Board violated the governing document by bringing to a vote a request for one particular detached garage - The
Frye Residence. The governing document specifically states that detached garages are prohibited. And that the Board
has the power to change the governing document with respect to this matter, detached garages, but only by getting the
proper votes of residents to amend the document for detached garages to be permitted in general. This obviously did
not occur. There are no detached garages in Crossfields (perhaps 1 exception) and no overwhelming desire of residents
to allow detached garages on properties throughout Crossfields. So an ill-guided vote was brought up for one particular
garage. There were not enough positive votes. So to compound the matter and make it worse, the HOA Board
reconvened a 2nd vote on this matter to allow the proper votes to be attained. Furthermore, the Board was negligent
and the Crossfields residents ill-informed on what the actual size of the detached garage would be - resulting in violation
of local zoning ordinances, which brings us to this matter today. Embarrasing, isn't it?
This detached garage should NOT be allowed to be built in Crossfields without the Crossfields Homeowners approving
the change to the governing document encompassing all homeowners. The Crossfields HOA Board needs to rectify their
prior improper actions and correctly address this matter. The garage in its current form violates local zoning ordinances
and was improperly pushed thru by a HOA Board that was negligent and ill-guided.
