RE: Variance Request Lot 21 Crossfields Subdivision, Petitioner Mr. James Frye
Dear BZA Chair,
This letter is written in response to Mr. James Frye's request to seek a BZA variance to build an
unattached garage on Lot 21 in the Crossfields Subdivision. As a resident of the Crossfields Subdivision
and resident that lives two homes from Mr. Frye, we respectfully request this variance be denied. There
are several reasons we make this request.
This project as proposed does not fit with the aesthetic of the Crossfields Subdivision and Carmel itself
nor in our opinion allowed by the Crossfields HOA covenants. The size of the project as noted in Mr.
Frye's proposal far exceeds Carmel standards and is not proportional relative to the size of homes in the
Crossfields. Note there are two lots in the Crossfields that have an additional detached garages and per
the Hamilton County GIS website were built in 2004 (Lot 94) and 2005 (Lot 85) and are approximately
37'x24' and 675 sf respective. Both appear to be completed before the Crossfields was annexed in the
City of Carmel.
The area that Mr. Fyre proposes to build the detached garage is located on the back of his lot where it is
adjacent to West Park. This section of West Park is the woods on the northeast corner. In the
December 13, 2016 Carmel Clay Parks & Recreation West Park Master Plan Figure 2-11 depicts
Development Suitability. It appears that our lots are directly adjacent to an area depicted as Severe
Restrictions. If the project is allowed to go forward, we respectfully request the BZA require a hydrology
study to determine adequate drainage and water runoff to city sewers and done in such a manner that
will not negatively impact lots in its proximity.
It is important to note that Mr. Frye did seek HOA approval; however, there was no mention that the
project did not meet code and would require a variance. This has been a late development and while
the HOA Board informed the lot owners, they did not appear to further adjudicate this matter. In an
email dated November 22, 2022 from the HOA Board Secretary to me, that the HOA Board will do the
following "as far as future situations the current board has already decided that no detached garages
will be allowed and we will strictly follow our covenants and restrictions."
In closing we feel that we are amicable neighbors with Mr. Frye and his family and are not opposed to
building a garage addition to his home that fits with the HOA covenants and matches the aesthetic of
the Crossfields Subdivision and the City of Carmel.
