Docket # PZ-2022-00234 V 2049 St. Andrews Circle Driveway Materials Variance Request BZA Hearing Officer Meeting December 13t", 2022 at 5:30 pm Introduction: Blue Door Builders is building a new home for Andy and Melissa LeBlanc at this property in the Crooked Stick Subdivision. This is a high -end custom home that will enhance this wonderful neighborhood with another unique home. It has an east coast vibe from the architecture down to the driveway. Much thought has been put into every decision and material selection to make sure they are not cutting corners or building something that won't last. Statement of Variance Request: We are requesting a variance for the standard driveway materials to allow us to use a mixture of concrete, pavers, and natural stone. This drive will fit into this neighborhood and give it more character and charm. Without this variance we will be restricted to standard concrete since that is what the original plot plan showed from the survey company. This survey was done by the homeowners to place the house on the lot before any driveway materials or landscaping choices were considered. Statement of Support: The design and execution of this home has been intentional, especially regarding the intent to replicate an east coast appearance. If we are restricted to using standard concrete for the' driveway and motor court, it will look more like a production house and less like custom home. The materials and design we have chosen will soften the space and create that east coast feel that will be more aesthetically pleasing and match the architecture choices, whereas a plain slab of concrete will resemble a basketball court in their front yard. We feel this fits into this part of Crooked Stick as well as the other Crooked Stick neighborhoods around the golf course. There are many other homes with this same paver mixture and even a few that have gravel drives. When speaking to the different staff members in imultiple departments it has become apparent there is precedent to allow this request of material change to move forward. There are many examples on St. Andrews Circle as well as St. Andrews Lane'that have these same driveway materials. We have also determined there are many examples of this in the neighborhood that were not made to go through this variance process and received their C of 0 without issue. We ask that you grant this variance so we can make this the home of the LeBlanc's dreams, down to the driveway. By granting this variance it will not have any negative impact on the surrounding properties. It will be a compliment to the neighborhood which has many similar materials already being used. The main portion of the drive is on private property and should not effect the neighbors. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: By changing the driveway materials to combine concrete next to the house, adding paver boarders and accents, and decorative gravel in between will enhance the overall project and create more curb appeal to this home. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: If we are held to the strict application of the LIDO we will have a hard time getting this home to look aesthetically pleasing in the front. The front yard motor court will look more like a basketball court than a decorative center piece which will look very out of place and become more of an eyesore than a high end driveway. It was good to talk with you earlier, appreciate your patience with all of us in DOCS while final issues with your project are ironed out. Let me start right in on the issue of parking pavement standards. The zoning ordinance applies equally to residential and business zoned property, including the required paving material of asphalt or concrete. The language is a little 'commercial heavy' but the parking standards for residential are a little less complicated, generally. I am not able to waive that standard and would support a variance of that standard in front of the hearing officer, which is looked at as a minor deviation from the rules. I can't give a 100% guarantee of success but normally, +95% of the time, if it's on the Hearing Officer agenda the hearings go quickly and variances are approved. I spoke with Christine and Adam about issuing a temporary Certificate of Occupancy to allow full move into the house. They are on -board with that after passing final inspection. I would request a brief written assurance about the connection construction underway, if you can perhaps respond with a short description of the construction in the works primarily what the connection will look like and level to which it will blend in and complement the house style, roof style and materials. That would also include the arrangement worked out with Engineering about the driveway apron and if that requires additional approval or can be signed off administratively. Christine and Adam are also on -board with leaving the existing pavement in place to help with construction staging, etc. The full C/O for the house will be issued when the following are completed: 1. Passing final building inspection 2. Granting of variance for driveway pavement 3. Three years ago when we amended and restated our covenants, it was our goal to try to adhere to the "intent" of the covenants without being overly restrictive preventing projects that actually increase property values and upgrade/update homes, despite being outside the confines of what was written in the covenants. With this said, a compromise that we have made in the cases since the ARC was more formalized, has been to request enhanced landscaping at the street border of the property to help screen street facing garages.
