DEPARTMENT REPORT

(V) McKenney Garage Size Variance.
The applicant seeks the following development standards variance approval:
6. Docket No. PZ-2022-00231 V UDO Section 5.02(B)(3) The combined square footage of the
ground floor area of a garage and/or accessory building shall not exceed 75% of the ground floor area
of the principal building, 85% requested. The site is located at 4814 Briarwood Trl. (Briarwood
Subdivision Lot 6). It is zoned S1/Residence. Filed by Jeff Rothbard of SilverCreek Construction, applicant,
on behalf of Joshua & Justine McKenney, owners.
General Info & Analysis:
The Petitioner seeks approval to construct an approximate 26’ x 26’ detached garage that will be located in the
back yard area, near the end of the driveway. It will not encroach into any easements or setbacks. It will be
made of brick and fiberglass shingles. Please see the Petitioner’s info packet for more detail on the variance
requests.
Floor Area: The combined square footage of the ground floor area of garages and/or accessory buildings shall
not exceed 75% of the ground floor area of the principal building, and 88% is requested. This is a variance of
13%.
Homeowners Association approval has been granted.
The Petitioner addressed all but one planning/zoning review comment, relating to compliance with the
Transportation Plan. A sidewalk along the street frontage (or payment into the Non-Reverting Thoroughfare
Fund) might be required per UDO section 1.07. The Planning Dept. supports the variance request, with the
condition listed in the Recommendation below.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of PZ-2022-00231 V with the
condition of coming to an agreement with the Carmel Engineering Dept. about the sidewalk requirement, and
with adoption of the Findings of Fact submitted by the Petitioner.
