DEPARTMENT REPORT
MONDAY, NOVEMBER 28, 2022
(V) Panda Residence, Lot Cover Variance.
The applicant seeks the following development standards variance approval for a pool & hardscape:
7. Docket No. PZ-2022-00232 V Silvara PUD Ordinance Z-652-20 Section 6.1 - Maximum 35% lot
cover allowed, 52% requested. The site is located at 521 Mendenhall Dr. (Jackson’s Grant on Williams
Creek Subdivision Lot 308). The site is zoned Silvara PUD/Planned Unit Development and is partially in
the SFHA/Special Flood Hazard Area. Filed by Sammi Schutt of PJE Lawn Care & Landscaping LLC, on
behalf of Nikhil & Megha Panda, owners.
General Info & Analysis:
The Petitioner seeks approval to improve their property with landscaping and hardscaping, including a
swimming pool, firepit, outdoor grill island, cascading waterfall, and bridge. A variance for exceeding lot
coverage is requested. Please see the Petitioner’s info packet for more detail on the variance request.
Lot Coverage: The Silvara PUD Ordinance allows for a maximum 35% lot cover, and 52% is requested. This is
an increase of 17%.
The Carmel Engineering Dept. has no concerns with the lot cover variance. The same goes for the Hamilton
County Surveyor’s Office.
The Petitioner addressed all but one planning/zoning review comment – to please submit a copy of the approval
letter/email from the Homeowners Association (HOA). The Planning Dept. supports the variance request,
with the condition listed in the Recommendation below .
Findings of Fact:

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of PZ-2022-00232 V with the
condition of providing a copy of the approval letter/email from the HOA, and with adoption of the Findings of
Fact submitted by the Petitioner.
