Re: BZA Docket No. PZ -2022-00231 V: McKenny Garage Size Variance.
Dear Mr. Rothbard:
At the meeting held on Monday, November 28, 2022, the Carmel Board of Zoning Appeals Hearing Officer took
the following action regarding the Development Standards Variance (V) request filed by you for the property
located at 4814 Briarwood Trail.
APPROVED wi th Conditions: McKenney Garage Size Variance - Development Standards Variance approval
for:
• PZ-2022-00231 V: The combined square footage of the ground floor area of a garage and/or accessory
building shall not exceed 75% of the ground floor area of the principal building, 85% granted.
• Conditions: Coming to an agreement with the Carmel Engineering Dept. about the sidewalk requirement
(such as the homeowner will pay for (or install) sidewalk along their street frontage if/when the city ever
installs sidewalks in the neighborhood), and relocating the storm water line to the satisfaction of the Carmel
Engineering Dept.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is November 28,
2025.
Please include a copy of this letter with any permit application.
