Hey Ben,
The design for the subdivision shows that there is a swale in the backyard, roughly where you plan to
extend the back of the addition. My main concern is this drainage area. If you plan to build it on
posts and not have a full foundation for it and allow water to flow underneath should it need to, this
makes things easier on my end. If you plan to bring the siding all the way down to the ground and
not allow water to flow underneath, then you would need to make accommodation for drainage
along the backside. You would just need to match what is currently there, just push it along the
backside of the building. The plan approved would need to show this in order to obtain approval.
You would be obtaining a Consent to Encroach from our department as this is going inside the
drainage easement. For that to be approved, you would just need to add to the site plan some
arrows showing the intended drainage routing around the addition and a statement on there saying
you would match existing drainage. Otherwise, I don’t see an issue with this being approved.

Hi Jarrod,
Reaching out to you, per guidance and information below.
For this client, at 2647 Highmount Ct, in Carmel we are looking to build a screened in porch on a
deck structure.
For the deck, we will only be installing 2 or 3 posts in concrete, approximately 12-13’ feet away from
the home.
With this deck/porch, we will not be changing anything with the drainage at the rear of the home
(and will not be going into the tree preservation easement).

This is the first time im working through some time of variance for a permit, so hoping to get
continued guidance from you. What can I provide (other than our full construction documents) to
help with getting approved to build this deck/porch for this client?

Hi, Ben –
Due to the special zoning of the neighborhood, R-1/Residence – ROSO III, you are exempt from the
rear yard building setbacks that the city would typically enforce through the zoning ordinance (as
well as from the maximum lot coverage requirements). So, you will not need any variance approvals
from the Board of Zoning Appeals (BZA). However, there is a platted 20-ft rear yard setback on the
subdivision plat. For encroachment approvals into that platted setback, you will need approval from
the Yorktown Woods Homeowners Association.
The platted rear building setback line also contains a 10-ft ft wide drainage and utility easement.

Regarding the proposed encroachment into the 10-ft wide drainage and utility easement, that will
need Consent to Encroach approvals from the Board of Public Works & Safety (BPW), via the Carmel
Engineering Dept. The Consent to Encroach Application can be created and submitted on the online
application portal. I was able to seek preliminary input from the Carmel Engineering Dept. about
your proposal, and they would be supportive of the encroachment if you can provide the cross
section of the drainage that you propose on the backside of the addition and if you will not go into
the tree preservation easement. For further discussion on that, please contact Jarrod Huff in that
department.
After you gain all these approvals, then you can create and submit a residential room addition
permit on the online application portal. (Christina, please let me know if I have missed anything.)

Hi Angelina,
Variance applications are very new to me, so I am unsure what steps to be taken.
Attached is the plot plan for the property, I have also attached renderings from the screened porch
that the client is asking us to build.
I have not had any updated renderings to adjust the size of the screened in porch.
Client, Susan Sottong, will be asking for someone from the city to come to their home.
I want to make beneficial use of everyones time, so I am very open to a phone call or face to face
meeting, if it helps in any way.

I see that you just submitted a variance application for a screened in porch. Did you have a prefiling
meeting with anyone at the city yet about the BZA variance process? And, can you please e-mail me
your proposed site plan, so I can see what variance(s) you need specifically from the UDO (unified
