Here is a brief description of our situation.
We applied for a permit to build a deck with a screened in porch for the Sottongs. Suzy has sent your HOA some of our
plan and renderings.
The Planning department would not approve the permit, as applied.
We applied for a variance through the BAZ (Board of Zoning Appeals). Due to the special zoning of the neighborhood,
R‐1/Residence‐ ROSO III, we are exempt from building setbacks, typically enforced through zoning
ordinance. However, we would still need approval from the Engineering department to encroach on the drainage
easement. We would be approved for our permit, if our construction is approved by the engineering department. This
information came from Angela Conn. We are also restricted from going/building into the treeline preservation.
Jared Huff from the Engineering department has conditionally approved our construction, because we are not building
a foundation or slab in the encroachment area. Since we are building an elevated deck, we will be setting 3 posts in the
ground, which will not interfere with current drainage.
We are conditionally approved from the Board of works and Public safety, via the Carmel Engineering department.
If your neighborhood approves the architectural improvement, as proposed to the Sottongs, we will get an approved
permit from the City of Carmel.

we have their ok so far as HOA approves. will that work for you as a start?

Suzy, please give me the contact number for the people with the city of Carmel that youve been dealing with on a
permit. Im really not sure on this at the moment. I dont believe that you can build a permanent structure beyond the
building setback line. I do believe that there are some exceptions but not really sure if this is in that category. Jeff

hello Jeff
would you be able to amend your approval. I have to prove to dept of public works and dept of planning that I have
HOA approval. you have given conditional approval with the statement the structure will not extend rearward past
set back line. I didn't realize we only have 9 feet from the back of our house until the easement starts according to the
city although everyone else on this side has built patios beyond that point. ours will be no different it will not be a slab
rather elevated on 4 sonet tubes like the others but it will be enclosed. I have conditional approval from the city if I
have HOA approval.

I would vote to approve with the following conditions:

‐The structure does not extend rearward past the building setback line, utility and drainage easement, and beyond the
sides of the home.
‐Any required permits be obtained from the City of Carmel.
‐Like materials and colors to existing home be used as proposed.
The structure looks very nice.
Since Suzy is a ARB member, I suggest that at least one additional board member attached to this email give their
thoughts.

Hello
Attached is a request from me. We would like to remove a portion of our current paver patio and replace it
with a perm structure with shingled roof, screens and 32 cement board to match our existing materials and
color.
The new structure would be 11 x 13 approx which is about 2 feet deeper than the current paver patio but
still well within our lot and would not interfere with drainage tile that extends along the back.
We are working with Surroundings in the Design Center on Rangeline Road, they are pulling permits for us
currently.

Picture of proposed structure
Plot plan for 2647 Highmount Court
Once I have approval and permits, we will receive architects plans.
