Good Afternoon,
We are in the process of vacating an 8’ utility easement and a 50’ setback for the developing property, located on the
southeast corner of Old Meridian and Main. Attached to this email is an aerial showing the general location of the 8’
utility easement on-site. I’ve also attached a PDF of the plat showing the exact location of the easement. With this being
a general utility easement, we are needing to obtain written confirmation from each utility indicating that they are ok
with us vacating the easement. If you could provide a written response letting us know for TriCo Regional Sewer, we
would greatly appreciate it. Please let me know if you have any questions or if any additional information is needed.

I apologize I miss read that. I do not see a problem with that I believe spectrum facilities are within the public ROW there
and as long as that is not going away spectrum should be fine.

Thanks for the quick response. I just want to confirm that we are located on the southeast corner, not southwest as
noted in your response. I’ve noted on your map the approximate location. It appears you don’t have anything in this
area, and the easement along the rear of Rize/BruBurger parcel would remain, which appears to encompass your
facilities heading south. If you could confirm that you are ok with this vacation, it would be appreciated.

While I don’t know what we’re asking them to do, I’m not sure this replat is needed. These are currently
2 separate parcels. The tract 3 parcel owned by the city is considered dedicated permanent right of way
(see the images from GIS below). This replat would combine them into a single “Lot A”. Why would we
want that? I think we’d have to get BPW and Council approval to vacate the right of way before this
replat could even happen. It seems like the crucial portion of this replat may be vacating the platted
easements and setbacks from the R.A. Franke’s subdivision that impact these parcels. If that is the
primary objective, I think there is a separate process to vacate plats and/or easements.
Also, FWIW, I noticed that our copy of Instrument 2005078887 was missing the full legal description for
Tract 3, so I looked it up in the county records and found the missing info:
This appears to match what is shown for the city’s parcel on their replat.

Good Morning Angie,
We would agree that those deeds conveyed ownership to the City of Carmel. However, on the PDF
labeled 2005078887, Page 1, Tract 3 description – it references that the tract is part of Lot 1 in R.A.
Franke’s Subdivision. We believe that Lot 1 currently has two (2) ownerships. In order to make the
two ownerships separate parcels, that lot would had to have been replatted. Because that did not
happen, we believe that our replat shows the correct boundary for Lot A having two ownerships.
We will be coming back in with another replat that dedicates ROW, City of Carmel owned parcel(s),
and Edward Rose owned parcels (to clean up this area). I’m guessing probably in late August/early
September.

I have attached a map depicting how this plat would be processed in our office. Our office would
create two parcels, one owned by the City of Carmel and one owned by JR Farmer Finance SC LLC. Is
the intention to have “Lot A” encroach into the roundabout? I see that this is a “Preliminary Plat”

We think this may be a question for the GIS mapper at the City of Carmel. In GIS if you look at the
deed it indicates that the area that was circled is a portion of Lot 1, indicating that there is another
portion associated with the parcel you have located. We believe the City may have tried to clean up
the GIS map and not show all of the lines between parcels owned by the City of Carmel?
We are confident that Lot 1 is the configuration we show for the Replat that was submitted. Let me

Good Afternoon,
We are in the process of vacating an 8’ utility easement and a 50’ setback for the developing property, located on the
southeast corner of Old Meridian and Main. Attached to this email is an aerial showing the general location of the 8’
utility easement on-site. I’ve also attached a PDF of the plat showing the exact location of the easement. With this being
a general utility easement, we are needing to obtain written confirmation from each utility indicating that they are ok
with us vacating the easement. If you could provide a written response letting us know for Citizens, we would greatly
appreciate it. Please let me know if you have any questions or if any additional information is needed.
