1. This Item has appeared on the May 17 agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than Thursday, June 1. Published notice is
required within the Indianapolis Star. Note: the placement of a public hearing sign on the property is also
required by the BZA Rules of Procedure, Article VI, Section 6 (see attached pdt).
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, June 23,
2006. Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley
no later than NOON. Friday, June 16, 2006. Failure to submit Informational Packets by this time will result in
the automatic tabling of the petition to the July agenda of the BZA.
5. This Item will appear on the June 26, 2006 agenda of the Board of Zoning Appeals under Public
Hearings.

350 E. 96TH STREET
Petitioner requests a variance of development standards from the following Sections of the Carmel
Zoning Ordinance:
Section 25.01.02B.1. Variance of the 25 foot maximum height requirement for Accessory
Buildings to allow the maximum height of the proposed parking garage
to be 37 feet, excluding light standards and stairtowers.
(Note: The height above grade at the north fayade will be 25 feet 9
inches +/-, excluding light standards and stairtowers. There is a 10' +
grade change north to south.)
Section 25.01.02B.3.a.i.(a) Variance of the 25 foot minimum setback requirement behind the Front
Line of the Building to allow the proposed parking garage to setback in
front of the Front Line of the Building.
Section 25.01.02.B.3.b.i.(a) - Variance of the minimum side yard requirement of 5 feet for accessory
buildings to allow a minimum side setback of approximately 4.85 feet
from the west property line for a portion of the new parking garage.
Section 25.01.02.B.7.b Variance of the 30% maximum Side Yard Maximum Lot Coverage
requirements for Accessory Buildings to allow the proposed parking
garage to be located in the Side Yard and to occupy more than 30% of
the Side Yard.

LIMITED WARRANTY DEED
THIS INDENTURE WITNESSETH, That PARKWOOD JOINT
VENTURE II, an Indiana general partnership (-Grantor-), CONVEYS
AND WARRANTS to INDIANA INSURANCE COMPANY, an Indiana
corporation (-Grantee-), for the sum of Ten Dollars ($10.00)
and other good and valuable consideration, the receipt of which
is hereby acknowledged, certain real estate located in Hamilton
County, Indiana, as more specifically described in the attached
Exhibit A (the -Real Estate-), subject to those matters more
specifically described on Exhibit B, which exhibits are
attached hereto.
The warranty of title by Grantor is limited to a warranty
against the acts of Grantor and those claiming by, through or
under Grantor, and not otherwise, and such warranty is subject
to the exceptions to title set forth above.
This conveyance is made by Grantor and accepted by
Grantee subject to the following restriction: Grantee shall
not construct any improvements (other than surface parking and
fence~upon that portion of the Real Estate described in
Exhibit C attached hereto and incorporated herein (the -No
Build Easement Area-). Such No Build Easement Area shall be
for the benefit of Grantor, its sucessors and assigns and for
the benefit of Parkwood Joint Venture, its successors and
assigns, as the owner of property having a common border with
the Real Estate. In the event Grantee violates the restriction
imposed in the No Build Easement Area, Grantor, its successors
or assigns or the owner of the property which as of date of
execution of this Deed had a common border with the Real Estate
may pursue any and all available remedies, either at law or in
equity.
IN WITNESS WHEREOF, Grantor has caused this Limited
Warranty Deed to be executed this 1st day of December, 1992.

LIMITED WARRANTY DEED
THIS INDENTURE WITNESSETH, That PARKWOOD JOINT VENTURE,
an Indiana general partnership (-Grantor-), CONVEYS AND
WARRANTS to INDIANA INSURANCE COMPANY, an Indiana corporation
(-Grantee"), for the sum of Ten Dollars ($10.00) and other good
and valuable consideration, the receipt of which is hereby
acknowledged, certain real estate located in Hamilton County,
Indiana, as more specifically described in the attached
Exhibit A (the "Real Estate"), subject to those matters more
specifically described on Exhibit a, which exhibits are
attached hereto. .
The warranty of title by Grantor is limited to a warranty
against the acts of Grantor and those claiming by, through or
under Grantor, and not otherwise, and such warranty is subject
to the exceptions to title set forth above.
This conveyance is made by Grantor and accepted by
Grantee subject to the following restriction: Grantee shall
not construct any improvements (other than surface parking and
fence) upon that portion of the Real Estate described in
Exhibit C attached hereto and incorporated herein (the "No
Build Easement Area"). Such No Build Easement Area shall be
for the benefit of Grantor, its sucessors and assigns and for
the benefit of Parkwood Joint Venture, its successors and
assigns, as the owner of property having a common border with
the Real Estate. In the event Grantee violates the restriction
imposed in the No Build Easement Area, Grantor, its successors
or assigns or the owner of the property which as of date of
execution of this Deed had a common border with the Real Estate
may pursue any and all available remedies, either at law or in
equity.

4. Subject to certain deed restrictions contained in the
first deed of conveyances of each lot recited as follows:
-At no time shall any part of the said land be used ...
occupied for the manufacture, brewing, distilling or sale
of spirituous or malt liquors, nor shall the said lot or
any part thereof or any building erected thereon at
anytime thereafter, be used or occupied as a bone-boiling
establishment, tannery, slaughterhouse, glue, soap,
candle, starch or gun-powder manufactory, or for any
offensive or dangerous purpose .... that no signs for
advertising purposes shall be erected or placed theron.
That all buildings erected thereon shall be placed and
set back not less than 2S feet from the street line;
provided that steps, windows, porticos and other
projections appurtenant thereto may be within said
distance. That there shall not be erected on any portion
of said premises any dwelling costing less than ....
$6000.00. That there shall be no violation of the usual
nuisance clauses, and the said party of the first part,
subject to the above covenants and agreements on the part
of the said party of the second part, heirs and assigns
covenant that it will warrant specially the land and
premises hereby granted and conveyed and that it will
execute such further assurances of said land and premises
