We have revised the plans to eliminate the areas requiring curb. b. We have revised the plans to modify the entrance for Bldgs #3 and #4 per our discussion. c. We have comments from Scott and will be resubmitting the revised plan. d. We are in the process of discussing the potential modification to Autumn Drive with the City Engineer's Office. e. Curb is required in all drive and access areas, revise plans accordingly. Narrow entrances for Buildings # 3 and #4 per our discussions at TAC. Provide additional landscaping in R/W if necessary. c. United States Army Corps of Engineers ("SW ANCC") No. 99-1178. The Court ruled by a 5 to 4 margin that the use, or potential use, of isolated, non-navigable, intrastate waters by migratory birds is not sufficient to trigger protection under the Clean Water Act. Since 1986, the Corps of Engineers had used Migratory Birds and their presumed connection to interstate commerce to regulate isolated, intrastate, non-navigable waters, including wetlands. At the turn of the 20th century, it is estimated that Indiana had more than 5.5 million acres of wetland. Current estimates place Indiana's wetlands at less than 1 million acres. Isolated wetlands comprise 60% to 80% of Indiana's remaining wetlands. The SWANCC decision effectively removes these isolated waters (wetlands) from regulation under Section 404 of the clean water act. On the surface this appears to free from regulation as much as 800,000 acres of isolated waters/wetlands in Indiana. However, early communications with the Corps of Engineers and U.S. Environmental Protection Agency indicate jurisdictional limits may be extended to include waters not previously considered "adjacent" and alternative. Commerce Clause connections such as forestry or agricultl.1.reto recapture many isola.te<\ wetl~ds. The coming months will be a dynamic and potentially volatile period for wetland regulation. Interpretation of SW ANCC by the Corps and EP A, subsequent Court decisions and/or potential legislation at the state or federal level, will determine which wetlands/waters will be regulated. There are inaccuracies in the Plant Schedules for the landscape plans, including the number of Sugar Maples and the number of White Fir trees on the plan. 2. There are too many Sugar Maples (31) on the plan for species diversity reasons. An alternative species should be chosen for at least 10 Sugar Maples. If the 10 Maples along Autumn Drive were switched to a combination of other species already on the plant schedule; Cimmaron Ash, Kentucky Coffee Tree, and 'Greenspire' Linden, that would be acceptable. 3. It appears drainage, utility, and sewer easements fall within the areas labeled as "Wetland - not to be disturbed". There should be no utility easements of any kind in the non-disturb areas of the wetlands. Even though construction may not occur within the boundaries of wetlands, they can be affected by surrounding construction activities and runoff. Typical consequences of development around wetlands include reduced shading, increase in water temperature, reduced capacity for pollutant filtering, and increased instability and erosion. All of these can have a disastrous effect on a "wetland" ecosystem. Any activities that produce an impact upon wetlands, including discharge into a wetland area, require prior approval from the appropriate regulatory agency. Copies of any such required approvals need to be submitted to this office as well. 4. During the TAC meeting May 16,2001, I raised questions about drainage into the wetlands. Jeff Kendall of Building Permits, and John South of Hamilton County Soil and Water Conservation, also had questions on wetlands issues, including capacity, drainage, and the involvement of state oversight agencies. You said that information would be included with the construction plans. These questions must be addressed. On sheet 80 I, the area between buildings 6 and 8 is listed as a wetlands area. In section 2F there is no mention of wetlands, and yet the plans show clearly that the parking lot/driveways of building 6, along with buildings 7 and 8, drain directly into the wetland area. Section 2H states there are no areas that storm water may enter groundwater through infiltration. As previously said, the plans show differently. Please explain these discrepancies, and provide calculations to show adequate capacity in the wetlands for the amount of storm water being discharged into the area. 5. On the specifications sheet, Section 4 under Earthwork details the protection of trees that are to remain. Tree protection fencing needs to be installed prior to any earthwork, or tree removal with heavy equipment. This fencing needs to remain in place throughout the construction process. Tree protection fencing needs to be shown on the landscape plans. Detai12/LI03 shows a maximum distance for installation of the tree protection fencing, but does not show a minimum distance. This detail needs to be amended to clearly show an adequate minimum root protection zone. Root disturbance and soil compaction are the leading causes of tree death and decline following construction activities.
