We have not received notification from Carmel Utilities that the water and sanitary sewer mains have been tested with
satisfactory results. Once that occurs, connection fees may be paid and sewer permits issued.

Please find enclosed the mylar and two paper copies of the Secondary Plat for The Townhomes at City
Center for your departments signature. This plat has been revised per you request with two outstanding
issues. The first is the Source of Title, Hamilton Title is working on recording the deed and will have the
deed recorded and will provide copies to me with the instrument number that will be added to the plat
prior to it being recorded. The second is the recording information for the Land Title Survey that was
prepared by American Consulting Engineers, this item will also be recorded prior to the recording of the
Secondary Plat.

1. Eliminate Tree Grates. To small for trees and bad location in middle of drive area.
2. Extend walk to Autumn between Buildings #5 and #6.
3. What is result of discussion with Kate re: specs for end of Autumn Drive? I will try to reach Kate.
4. Add landscape area adjacent to east and west end of parking area along right-of-way at buildings #3 and #4 per
our discussion.
5. Provide detail of building elevations.

Please find enclosed a copy of the revised Construction Plans and Secondary Plat for the above
referenced project. These items have been revised per your comment letter dated June 25th. I have
addressed each of your items individually with a numbering system consistent with your letter.
Construction Plans:
a. We have revised the plans to eliminate the areas requiring curb.
b. We have revised the plans to modify the entrance for Bldgs #3 and #4 per our discussion.
c. We have comments from Scott and will be resubmitting the revised plan.
d. We are in the process of discussing the potential modification to Autumn Drive with the City
Engineer's Office.
e. Ryland will be discussing this item with your department.
Secondary Plat:
1. We have added the concrete monuments to the perimeter corners of the plat.
2. We have added the docket numbers to the plat.
3. Please find enclosed a copy of the Covenants and Restrictions.

This letter is in response to your Secondary Plat and construction plan filing for the Townhomes at City Center. I
have reviewed the Secondary Plat application and construction plans. The following connnents need to be addressed
and plans updated accordingly:
Construction Plans:

Curb is required in all drive and access areas, revise plans accordingly.
Narrow entrances for Buildings # 3 and #4 per our discussions at TAC. Provide additional
landscaping in R/W if necessary.
c. Landscape Plan will need review by Scott Brewer. He was not at TAC.
d. Revise plans for Autumn Drive per your discussions with Kate Weese if necessary.
Be prepared to address building elevations as part of the administrative ADLS.

Comments on Secondary Plat:
1. Place concrete monuments at comers of Plat.
2. Add Docket Numbers for Primary and Secondary Plats.
3. Provide a copy of the covenants and restrictions
Please submit a revised Secondary Plat with the above-mentioned changes. Once these changes have been made and
connnents addressed, please produce a mylar copy for signature by this Department. Two paper copies of the plat
must be filed with the mylar prior to recording. Three paper copies and a mylar of the recorded plat must be
submitted following recording prior to the issuance of any building permits. Our approval of the secondary plat
(signature) will be forthcoming upon revision of the plans according to the items listed above.

Status of Isolated Wetlands in Question
On January 9, 2001, the U.S. Supreme Court rendered a decision in the Solid Waste
Agency of Northem Cook County v. United States Army Corps of Engineers
("SW ANCC") No. 99-1178. The Court ruled by a 5 to 4 margin that the use, or potential
use, of isolated, non-navigable, intrastate waters by migratory birds is not sufficient to
trigger protection under the Clean Water Act. Since 1986, the Corps of Engineers had
used Migratory Birds and their presumed connection to interstate commerce to regulate
isolated, intrastate, non-navigable waters, including wetlands.
At the turn of the 20th century, it is estimated that Indiana had more than 5.5 million
acres of wetland. Current estimates place Indiana's wetlands at less than 1 million
acres. Isolated wetlands comprise 60% to 80% of Indiana's remaining wetlands. The
SWANCC decision effectively removes these isolated waters (wetlands) from regulation
under Section 404 of the clean water act.
On the surface this appears to free from regulation as much as 800,000 acres of
isolated waters/wetlands in Indiana. However, early communications with the Corps of
Engineers and U.S. Environmental Protection Agency indicate jurisdictional limits may
be extended to include waters not previously considered "adjacent" and alternative.

phYSical, chemical or bIolOgical degradatton of any waters of the State." dlana Code
defines Waters of the State in part as, ''the accumulation of watei~ surface and?
'underground, natural and artificial. .. that are wholly or partially within, flow through or';
. border upon' Indiana" (IC 13-11-2-265), (~et it is unclear whether isolated wetlands
legally fall within this definition. Regardless, Indiana's water quality law is an absolute
with no attendant permit system for wetlands. Environmental groups have threatened
third party lawsuits to compel the State to enforce the existing water law. In the absence
of a permit program, no project could be performed that impacted a water of the State
without violating state law.
The coming months will be a dynamic and potentially volatile period for wetland
regulation. Interpretation of SW ANCC by the Corps and EP A, subsequent Court
decisions and/or potential legislation at the state or federal level, will determine which
wetlands/waters will be regulated.

Dear Keith:
After reviewing the landscape and construction plans received June 5, 2001, my
comments are as follows:
1. There are inaccuracies in the Plant Schedules for the landscape plans, including
the number of Sugar Maples and the number of White Fir trees on the plan.
2. There are too many Sugar Maples (31) on the plan for species diversity reasons.
An alternative species should be chosen for at least 10 Sugar Maples. If the 10
Maples along Autumn Drive were switched to a combination of other species
already on the plant schedule; Cimmaron Ash, Kentucky Coffee Tree, and
'Greenspire' Linden, that would be acceptable.
3. It appears drainage, utility, and sewer easements fall within the areas labeled as
"Wetland - not to be disturbed". There should be no utility easements of any
kind in the non-disturb areas of the wetlands. Even though construction may not
occur within the boundaries of wetlands, they can be affected by surrounding
construction activities and runoff. Typical consequences of development around
wetlands include reduced shading, increase in water temperature, reduced
capacity for pollutant filtering, and increased instability and erosion. All of these
can have a disastrous effect on a "wetland" ecosystem. Any activities that
produce an impact upon wetlands, including discharge into a wetland area, require
prior approval from the appropriate regulatory agency. Copies of any such
required approvals need to be submitted to this office as well.
4. During the TAC meeting May 16,2001, I raised questions about drainage into the
wetlands. Jeff Kendall of Building Permits, and John South of Hamilton County
Soil and Water Conservation, also had questions on wetlands issues, including
capacity, drainage, and the involvement of state oversight agencies. You said that
information would be included with the construction plans. This information does

not appear to be on plans sent to this office, nor on plans sent to the City
Engineer's Office. These questions must be addressed.
On sheet 80 I, the area between buildings 6 and 8 is listed as a wetlands area. In
section 2F there is no mention of wetlands, and yet the plans show clearly that the
parking lot/driveways of building 6, along with buildings 7 and 8, drain directly
into the wetland area. Section 2H states there are no areas that storm water may
enter groundwater through infiltration. As previously said, the plans show
differently. Please explain these discrepancies, and provide calculations to show
adequate capacity in the wetlands for the amount of storm water being discharged
into the area.
5. On the specifications sheet, Section 4 under Earthwork details the protection of
trees that are to remain. Tree protection fencing needs to be installed prior to any
earthwork, or tree removal with heavy equipment. This fencing needs to remain
in place throughout the construction process. Tree protection fencing needs to be
shown on the landscape plans. Detai12/LI03 shows a maximum distance for
installation of the tree protection fencing, but does not show a minimum distance.
This detail needs to be amended to clearly show an adequate minimum root
protection zone. Root disturbance and soil compaction are the leading causes of
tree death and decline following construction activities.
Please make these changes, and provide addition information in writing and by amended

4. REQUIREMENTS FOR APPROVAL OF INFRASTRUCTURE CONSTRUCTION:

5. STANDARD REQUIREMENTS TO INITIATE THE BUILDING PERMIT PROCESS:
No individual building sewer pennit, which is a requirement for a building pennit, will be issued until:
. Sanitary Sewer mains constmcted and acceptable air/mandrel tests completed.
. Water mains constmcted, pressure tested, chlorinated and satisfactory 1'1 and 2'.-1 day test results
obtained.
. Storm drainage installed.

6. IDEM PERMITS:
IDEM Per1l1its for watcr and for sanitary sewers are requircd for this project. This office will not
approvc the 330 lAC 3-2 Construction Permit for this pr~iect prior to BPWS approval of water and
sanitary sewer availability. Additionally, please submit approved copies of the following:

7. T.AC. REVIEW/DRAWINGS SUBMITTED FOR APPROY AL:
We request all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing rellecting requested revisions. Final drawings will not be approved for
constmction until all issues have been resolved. All Cannel Utility issues must also bc rcsolved. The
design engineer must certify all drawings submitted for final approval. This office will require a
minimum of five-sets of approved drawings after all issues have been resolved. The drawings will be
approved and signed by the City Engineer and the Director Carmel Utilities. The Developer/Owner
will receive one-set which must be maintained on the construction site at all times. Cannel Utilities
will reccive two-sets. Our Public Works Inspector will receive one-set and the final set will bc
maintained in the Department of Engineering. If more than five sets are requested to be approved, the
additional sets must be submilled with the required five-sets.
8. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues.

Please provide individual, detailed Engineer's Estimates for 100% of the cost of labor and materials for
the construction/installation of the above items. Individual Performance Guarantees, in the amount of
the Engineer's Estimates, will be required to be posted. These may be in the form of Pcrfonhance
Bonds, Irrevocable Letters of Credit or Certified Checks. If Certified Checks are utilized as
Performance Guarantees, the check or checks should be made payable to "The City of Cur me/ or (not
utili) the J)eveloper/Owner". This will make the retum of the check to the bank easier when the
performance is released. Three-year Maintenance Guarantees will be required upon release of the
Performance Guarantees.
PROJECT COMMENTS
II. We reserve the option to provide additional review comments when detailed construction plans are
submitted for this project. .
12. We will want to see curb cut/driveway details and methods indicated on construction plans.
13. Are there drainage cales available?
14. Is it possible to provide relief from the broad expanse of asphalt associated with the driveways
contiguous to Autumn Drive for Blocks C and D?
15. Identify areas of wetlands and place appropriate noles (Not to be disturbed, etc).
16. It appears that access casements will be required as follows:
. From Block B to Block A
. From Block F to Block E
. From Block G to Block H
17. Please correct the following street names:
. 3rd Avenue should be 3rd Avenue S.W.
. 126111 Street should be City Center Drive.
18. Are there to be sidewalks eonstmcted on the south side of Autumn Drive? Ifpossible, we request that
sidewalks be included in the plans for this development.
19. We arc aware that there are vacations of right of way processes under way. However, we request that
existing and proposed right of way lines be identified and dimensioned.
The abovc comments arc based upon the Engineering Department's initial review. Please provide our
office with a follow-up leiteI' and revised plans, indicating all revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of allmodificatiolls Imide on
the plans being re-submilted for review, particularly if any such changes are considered "new" or fall
outside of our initial review.
