Dear Mr. Crosby:
This office has reviewed your revised plans and comment letter dated August 2, 200 I. It appears that all
issues from our July 30, 200 I review have been addressed. Therefore, assuming there will be no other
revisions or additions to the last drawing submitted, this office is prepared to approve a minimum of 5-sets
of certified construction drawings for this project. This is also based upon the assumption that all Carmel
Utility issues have been resolved. Please remove the statement above the certification on Sheet C 100 prior
to submitting drawings for approval.
Please be advised that the following requirements remain to be satisfied prior to approval of the start of
construction:
I. Board of Public Works and Safety Approval Requirements:
. Water and Sanitary Sewer Availability - We are in receipt of your request. It will be placed on the
first available Board of Public Works and Safety agenda after all Plan CommissionIBZA
approvals have been obtained.
. Secondary Plat Approval - Required Performance Guarantees must be posted with this office prior
to the plat being submitted to the Board for approval.
2. Performance Guarantees
. Monuments and Markers
We have received the required certified Engineer's Estimate for 100% of the cost of labor and
materials for the above improvement. Post an individual Performance Guarantee in the amount of
the Engineer's Estimate ($1.410.00). A three-year, 10% Maintenance Guarantee will be required
upon release of the Performance Guarantee ($141.00). Please be advised that
Cashier'slCertified/Official Checks may be posted as Performance Guarantees. However, if
checks are utilized, the checks should be made payable to "The City of Carmel !!!
(Developer/Owner)". Please use or and not and. This should assist you when the Performance is
released and the check is returned.
3. Consent to Encroach Agreement:
A Consent to Encroach Agreement will be required for this project. There is a sidewalk and pavement
behind the building that encroaches upon a Drainage, Utility and Sewer Easement. This department
prepares this agreement, utilizing information provided by the petitioner. The Agreement must be
reviewed, stamped and approved by our City Attorney, signed and notarized by the petitioner and
approved by the Board of Public Works and Safety. The Agreement cannot be presented to the Board
for approval until the Secondary Plat has been approved and recorded, as recording information is
required on the Agreement. The Agreement must be recorded after approval by the Board. Please

Dear John,
The construction plans and secondary plat have been revised according to the July 18, 2001 T AC
comments and are enclosed for your review. Supplemental information has also been submitted to you by
Mark Monroe of the Rees Law Firm since the initial plans were filed. The revisions and information
relating to the comments are as follows:
Department of Community Services ADLS
1. Two applications were filed July 6, 2001 for the ADLS petitions. One application is for the
development on Lot 4 and the other application is for the center identification multi-tenant building
complex signs.
2. The proposed building does not exist elsewhere so we are unable to provide pictures. We will provide
building material samples for presentation at the Plan Commission meeting.
3. A narrative for the project was filed July 6, 2001.
4. The light spillage is less than .1 foot-candles at the west property line. Please verify this on the lighting
plan previously provided.
5. The wall sign criteria was filed July 6, 2001.
6. The mansard roof on the west side of the building will adequately screen the roof top mechanical
equipment. We have filed, with your office, a site line study that verifies this.
7. As indicated on the application, the exterior building materials are brick, glass, and EIFS.
8. Additional copies of the building elevations and ground sign drawings were filed July 6, 2001.
Additional copies ofthe construction drawings and secondary plat are enclosed.
Department of Community Services Secondary Plat
1. The plat legend has been revised showing the monument information requested.
2. The monuments at the site perimeter have been added.
3. The private street has been extended into the parking lot.
4. The path has been added from the parking lot to the main walking path along the creek.
5. The sign location plan has been revised to be consistent with the architectural sign drawings.
6. The extent of the future development is indicated on the plan, however, we are unable to indicate the
building location or parking lot layout.
City Engineer
1. The site is annexed but most ofthe infrastructure on this site is private.
2. The streets and storm sewer for this project are intended to be private. The sewer and water are only
service connections.
3. A request for sewer and water availability is attached.
4. The connection fees will be paid by the developer prior to the start of construction.
5. Upon approval of the plans, five sets will be sent to the Engineer's Office. The Carmel utility
comments are listed below.
6. A consent to encroach form will be applied for if needed.
7. Water and sanitary sewers have been located.
8. Carmel Utilities requested that the water meter be inside the building, that the line size be shown and
that a gate valve be shown at the main. These items have been added to the development plan.
9. Please send a copy of the irrigation requirements.

Soil Conservation Service
1. The seeding has been expanded to cover the entire lot.
Landscaping
1. Screening has been added at the north end of lot 4 adjacent to the common area as requested.
2. The species ofthe trees and shrubs have been changed to be more consistent with the approved Osco
landscaping plan as requested.
3. Landscaping at the proposed ground signs has been added.

This office has reviewed the plans submitted for this project. We apologize for the delay and offer the
following comments:
General Information
1. The project site is located within current City of Cannel Corporate Limits.
2. Jurisdictions:
. Streets and Right of Way (Hazel Dell ParkwaylEast 13151 Street) - City of Cannel
. Water, Sanitary Sewer, Storm Sewer - City of Carmel
. Mitchner Ditch - Hamilton County Surveyor's Office
3. Board of Public Works and Safety Approval Requirements:
. Water and Sanitary Sewer Availability (Connection).
. Any permanent improvement, including irrigation systems, to be installed in public right of way or
dedicated easements will require a Consent to Encroach Agreement between the City and the
Owner or Owners. Ifan irrigation system is planned, additional Water Availability will be
required from the Board.
I am enclosing a schedule of Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use the Engineering Department deadlines for submission to the Board.
Any submission to the Board requires prior final approval by the Carmel Clay Plan Commission
ancVor the Board of Zoning Appeals and completion of review by the Technical Advisory
Committee. All written requests to be placed on the Board's agenda must include the appropriate
Docket Numbers and the date (or dates) of approval by the Plan Commission amVor BZA.
4. Water and Sanitary Sewer Connection Fees:
. Connection Fees are based upon the average user factor tables from Section 9-35 (water) and 9-
200 (sanitary) of our Utility Ordinance. The Connection Fees are $1,310.00 per E.D. U. for water
and $795.00 per E.D. U. for sanitary sewers. The Equivalent User Contribution Multiplier for
Retail projects is 1.0 E.D.U. per 1,000 square feet. Since this appears to be a multiple tenant type
building, the Retail Classification will be utilized to calculate Connection Fees. I am enclosing
copies of our Average User Factors for Water and Sanitary Sewers and our current Fee Schedule.
Note: Any deviation from the Connection Fee calculations listed in our Ordinance will require
Carmel Utilities alltl Board of Public Works ancl Safety approvals. Such reque!>ts mu!>1 be
accompanied by proof of a minimum of one years worth of actual water usage, recapped by
total gal/OIls per month, and must include the name, location, size ancVor number of seats of the
faci/i~r being utilized as a base for calculation of fees.

5. T.A.C. ReviewlDrawings submitted for approval:
We request that all comments and comment letters generated by tItis office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Cannel Utility issues must also be resolved. The
design engineer must certify all drawings submitted for final approval. Tltis office will require a
minimum of five-sets of approved drawings after all issues have been resolved. TIle drawings will be
stamped approved and signed by both tIle City Engineer and Director Cannel Utilities. The
Developer/Owner will receive one-set which is to be maintained on tIle construction site at all times.
Carmel Utilities will receive two-sets. Our Public Works Inspector will receive one-set and one-set
will be maintained in tIle Department of Engineering. If more fuan five-sets are requested to be
approved, the additional sets must be submitted willi tIle five-sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of
way or easements will require a Consent to Encroach Agreement between tIle OwnerlDeveloper and
the City of Cannel. This agreement requires review and approval by our Law Department and Board
of Public Works and Safety approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
and sanitary sewer locates.
8. Cannel Utilities will provide a separate review oftItis project for water and sanitary sewer issues.
9. I am including copies of the following items with tItis correspondence:
. Department of Engineering Commercial Project Approval Procedures.
. Departmcnt of Engineering Subdivision Requirements.
. Performance Release Procedure
. Permit Data, Contacts, etc.

BONDING REQUIREMENTS

We understand this is to be a "tenant space" type building and several different typcs of businesses
may be located in the building. Until more dctailed information is forthcoming, the above calculation
seems to be the appropriate classification to use.

14. It appears the ground signs planned for this facility are to be installed in dedicated eascments. As
explained previously, this will require a consent to encroach agreement.
The above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up lctter and revised plans, indicating all revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of all modifications made on
the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our
initial review.

I will not be able to attend the TAC meeting on Wednesday due to a meeting I have to attend in Greenfield. I would like for
you to pass on the following to the Petioners:
Hilton Garden Inn--------------Please advise them that they will be assinged a Pennsylvania Street address since the
Building faces Pennsylvania and Main access is off of Pennsylvania Street.
J.C. Sipe Jewlers---------tell them to make sure that they put their address numbers either above the front door or on the
Monument sign age, so it can be easily seen from the street by Police and Fire personnel.
Macaroni Grill------ Same as above
Village of West Clay Section 3001-A Block J------- I have spoken with Keith lash on this. I had a question on where the
access point was to Block 5 and 6. For addressing purposes, I need to know what street these will be off of. He had
mentioned to me that there was going to be a private drive between blocks 5 and 6. I told him that I we don't address off of
private drives. I told him to talk to you and Laurence abouth this at the TAC meeting. Please let me know what you both
decided on this. Right now there is no way to address these two blocks of town homes the way they are. After looking at
the project none of the buildings have accessibility from the main streets. It looks to me like the front of the buildings are all
off of the"Private streets". From a Public Safety standpoint, I would prefer they submit four additional street names, so
those townhomes can be addressed. After looking at the drawings I see no way to get to those buildings unless you turn
off onto what they want to call"private streets" The only other altenative would be for them to put some type of address
block on the rear of the buildings that back up to the main streets in that area, with the span of addresses in the building
along with the street name on it as well.
For Example for block 2: 2255-2285 ( This is what the address block could look like on rear of
GLEBE STREET Building.)
Just let me know what your expertise in this situation would be...Hopefully you and Laurance could put your heads together
and give me an idea. Thanks
Hazel Dell Corner Lot 4---- This is going to be a small strip mall, I have talked to Cort(1 believe)
on this issue. Have them make sure the Physical address is on the building or on the Monument sign if they have one.
They have been advised to use Suite letters for tenants occupying the individual spaces.
East 96th St Auto Park----Tow Wood Volkswagen-----Make sure the address is physically on the building or Monument
sign for Public Safety reasons.
Thats all I can think of at this time. Sorry about not attending, but if you would please mention these, especially the Village
of West Clay issue....It would be greatly appreciated.

All signage will require approval by the Plan Commission. Additional detail of the building signage
needs to be provided. In addition, all signs (including proposed ground signs) will require BZA
approval of developmental standards variances as well as being reviewed as part of the special use
approval process. I think we would be looking for some consistent theme for signs on the building
(color, size, lighting, etc.).
Explore increasing the height of the building at the west side to reduce visibility of roof and roof top
mounted equipment.
What material is the exterior of the building made of?
The application is not complete. Additional sets of plan and exhibits are needed for all three
applications (ADLS, SP and SU)o Don't bring in new documents when you submit the informational
booklet. The intent is that we have all the information in the file that you will be presenting to the
commission at the time a docket number is issued.

Provide a site plan identifying the location of the proposed signs, rights-of-way, etc. Will they be
located in easements? Be more specific than "one sign at each entrance to Hazel Dell Comer
subdivision." Which sign is at which entrance?
The sign in the application illustrates "Hazel Dell Commens". Do you mean "Commons" or should it
not be "Comer". The other sign illustrates "Signage". It should be consistent with the other and
illustrate "Hazel Dell Comer". The Department will not support a request to have a single tenant
located on the sign.
Again, all signs (including these) will require BZA approval of developmental standards variances as
the Property is zoned B-3.
What material is the exterior of the sign and how are they illuminated?
