covenants) is N.QI.on the Plat. To be effective, it must be recorded with the plat. TWO - Tree preservation covenants
need to followed. THREE - No landscape plans have been submitted, but for example, there are landscape mounds
drawn and labeled on the site development plan. A landscape plan is required.

and issues.
Hazel Dell Corner, Lot 4 - Have comments and will have letter done Friday or Monday. Significant issues: One - .d.i.d..nQt
receive copies of plans. Please have Paul send me a set. TWO - Greenbelt on North perimeter should not occupy same
space as utility easements, and must be planted with required bufferyard plant materials. THREE - will ask for additional
trees and shrubs to match other properties in the development.
Tom Wood Volkswagon - spoke with Tom Engle of Barnes & Thornberg and he will be dropping of enlarged (readable)
plans so I can review them. Comment letter after I do review.

I will not be able to attend the TAC meeting on Wednesday due to a meeting I have to attend in Greenfield. I would like for
you to pass on the following to the Petioners:
Hilton Garden Inn--------------Please advise them that they will be assinged a Pennsylvania Street address since the
Building faces Pennsylvania and Main access is off of Pennsylvania Street.
J.C. Sipe Jewlers-------tell them to make sure that they put their address numbers either above the front door or on the
Monument signage, so it can be easily seen from the street by Police and Fire personnel.

Village of West Clay Section 3001-A Block J-----"'I have spoken with Keith lash on this. I had a question on where the
access point was to Block 5 and 6. For addressing purposes, I need to know what street these will be off of. He had
mentioned to me that there was going to be a private drive between blocks 5 and 6. I told him that I we don't address off of
private drives. J told him to talk to you and Laurence abouth this at the TAC meeting. Please let me know what you both
decided on this. Right now there is no way to address these two blocks of town homes the way they are. After looking at
the project none of the buildings have accessibility from the main streets. It looks to me like the front of the buildings are all
off of the"Private streets". From a Public Safety standpoint, I would prefer they submit four additional street names, so
those townhomes can be addressed. After looking at the drawings I see no way to get to those buildings unless you turn
off onto what they want to call"private streets" The only other altenative would be for them to put some type of address
block on the rear of the buildings that back up to the main streets in that area, with the span of addresses in the building
along with the street name on it as well.
For Example for block 2: 2255-2285 ( This is what the address block could look like on rear of
GLEBE STREET Building.)
Just let me know what your expertise in this situation would be...Hopefully you and Laurance could put your heads together
and give me an idea. Thanks
Hazel Dell Comer Lot 4---- This is going to be a small strip mall, I have talked to Cort(1 believe)
on this issue. Have them make sure the Physical address is on the building or on the Monument sign if they have one.
They have been advised to use Suite letters for tenants occupying the individual spaces.
East 96th St Auto Park---Tow Wood Volkswagen.....Make sure the address is physically on the building or Monument
sign for Public Safety reasons.
Thats all I can think of at this time. Sorry about not attending, but if you would please mention these, especially the Village
of West Clay issue....lt would be greatly appreciated.

While this property is in the District's service area, it is in an area where sewage disposal is provided by individual onsite
septic systems. We have no information on the nature of the variance being requested, so we cannot comment further as
to whether the work may effect any nearby interceptor sewers in the vicinity of 106th Street and Crooked Stick Lane.
East 96th Street Auto Park, Lots 1 & 3 (Tom Wood Volkswagen)
The District is aware of the petitioner's plans but the property is served by Carmel Utilities. If any related site work
extends into the travel lanes of 96th Street, Holey Moley should be notified so that the District can locate its 16" force
main appropriately in order to prevent damage which would likely cause a major sewage spill.

process.

Enclosed please find our formal application for the development of Block '1', as shown on the
attached, into forty one (41), owner-occupied, town homes. The builder, Ryland Homes of
Indiana, proposes a product akin to the City's own City Center, and what has been developed as
Firehouse Square at the comers of Ohio and New Jersey Streets in downtown Indianapolis. Our
submission to you consists of a Secondary Plat (labeled "Replat of Block '1') and Construction
Plans, to be heard, pending your approval, at the July T AC meeting. The purpose of this letter is
to address the "big-picture" issues that may arise aside from the technical T AC review.
1. Permitted Use
The current WestClay PUD ordinance defines certain real estate in the Village Center as
"commercial blocks". Note that these blocks are referred to as Blocks E, F, G and H on the
Primary Plat, however, were recorded, on the Secondary Plats, as Blocks D, E, F and J. The
subject block is '1' per the recorded plat.
Section 9.3 of the ordinance states that "...commercial blocks in the Primary Area delineated on
the Development Plan may, notwithstanding any such designation, be utilized for any use
permitted under Sections 5 and 6." Section 5 contains the following statement:
5.1 Primary Area. The following uses are permitted in the Primary Area or parts thereof,
subject to the applicable Development Standards.
A. The following residential uses:
( 1) detached dwellings
(2) attached dwellinJ!s
( 3 ) apartments
Therefore, the development of town homes on Block '1' is permitted within the existing
ordinance. The number of units obviously count against the total permitted units in the project.

2. The Plating Process
Block 'J' has been recorded as part of the Secondary Plat labeled "Section 3001-A, Village
Center Part 2". The purpose of the re-plat is to define the boundaries of each of the nine
buildings, with each building area being further defined into forty one individual dwelling units
once the party walls are in place and field surveyed. This process is not unlike the way the other
town homes in the Village have been platted.
3. Infastructure Issues
The utility master plans for the Village have provided for service to development within each
block via the extension of utility lines currently stubbed along and around each block. Water,
sanitary and storm sewers will each be extended into each of the commercial blocks, without the
need for upsizing of any lines or damage to streets surrounding the blocks, by connecting onto
existing stub lines previously built. The curb of the four streets surrounding Block 'J' will be
modified at the four points of vehicular access into the block.
4. Building: Permits
Upon securing all approvals from your department and the other T AC members, it will be our
intent to apply for a building permit for the first building only. This will enable Ryland Homes to
use the building at the northeast comer of the block for model purposes.
