LOT 2, identified on the Secondary Plat included as Exhibit B, contained within the following
described real estate:
Part of the North Half of the Southeast Quarter of Section 8, Township 17 North, Range 4 East in
Hamilton County, Indiana, described as follows:
Commencing at the southwest comer of said half-quarter section; thence on an assumed bearing of
South 89 degrees 36 minutes 04 seconds East along the south line of said half-quarter section a
distance of 1100.00 feet to the Beginning Point; thence North 00 degrees 26 minutes 25 seconds East
parallel with the west line of said half-quarter section a distance of 1320.86 feet to the north line of
said half-quarter section; thence South 39 degrees 21 minutes 57 seconds East along said north line
a distance of 1584.59 feet to the northeast comer of said half-quarter section; thence South 00
degrees 18 minutes 52 seconds West along the east line of said half-quarter section a distance of

Explanation of Request
C.P. Morgan and lC. Hart will co-develop a 42.94 acre site, located at 9900 Gray Road,
Carmel, Indiana. This site is located in the northeast quadrant of Gray Road and 96th Street, just
north of Bottamiller Enterprises. The development will be a mixed use development with
approximately 13.6 acres of apartments to the north and 8.5 acres of office development to the south.
The balance of the real estate to the west will remain woods and lake.
The real estate was zoned S-1 Residence. On the 22nd day of January, 2001, zoning of the
real estate was changed to R5 pursuant to Zoning Ordinance Z-358. Office use is a special use
within the R5 classification and, as such, to permit the office development, the Board of Zoning
Appeals granted a special use on the 26th day of February, 2001, under Docket No. SU-5-01.
Thereafter, on the 20th day of March, 2001, the primary plat was approved under Docket
No. 8-01-PP, and the final development plan was approved under Docket No. 9-01-DP. Furtherto
these approvals, a secondary plat will soon be recorded. A copy of the secondary plat is attached
as Exhibit B (the "Secondary Plat").
C.P. Morgan will construct an office building, for its corporate headquarters, on what is
identified on the Secondary Plat as Lot 2. In connection with the final development plan, C.P.
Morgan obtained approval of the office building, the renderings and elevations of which are included
in the file under Docket No. 9-0 I-DP. Since this approval, C.P. Morgan has decided to reduce the
height of the building and alter the exterior of the building, as illustrated by the rendering and
elevations included as Exhibit D.
