It looks as if all of the Engineering Dept. issues have been completed/resolved. Bill Akers is
still working on the addresses. I am still attempting to get word from our Planning & Zoning
office as to the exact status of the Secondary Plat. I am hoping that Matt Griffin will let me
know soon on that. I was wondering, though, if you had come up with any information on it,
and on the issue we discussed with it regarding the notation of common areas around all of the
buildings, from your end?

Your copies of the plans are ready to be picked up in the'DOCS will-call box. Note: in the essence of time I hand
corrected the graphic planting detail notes (trees must be planted with root ftares at finish grade - not 4" above it)
so the detail is the same as it was a year ago. I didn't notice the change when the 1 st copy came in without the
detail in December, or when these were dropped off in March.

Eric,
When I describe a "separately platted lot" I define that as a piece of land, on which a structure sits,
where the property owner owns everything both inside the structure, and outside of the structure. No
part of that area outside of the four walls of the structure is commonly owned amongst a group of
owners. If you are stating that this is the case with these homes, then they should not be referred to as
condominiums. Also, the plat should then be changed and the designation of the outside land on each
lot should not be noted as "common area," as it is not commonly owned. Also, I am guessing that there
are easements that run on some of these lots. (utility and/or drainage; and possibly right of way)
Those, I believe, need to be shown on the plat. Each lot needs to be given a specific lot number. You
have them designated as "units" on the copy I have, and that is normally a term used in multi-family
projects like apartment or condominium buildings. They should be termed as lot, and not unit. (In this
way, it is basically like a single-family subdivision.)
Hopefully we are all clear on what is being done, then. I appreciate your assistance in helping to
resolve the situation.

I think you are correct in that each owner purchases a separately platted lot, which will be the
case with this platted development. However, that's not to say that other owners will not have
access to areas outside of each unit on that lot for both ingress/egress access (i.e. driving
across the front of someone else's garage to exit the development) and for the association to
provide maintenance. I would view it no differently than someone who purchases a single-
family home with an easement on it for some type of utility. The home owner would have

ownership of the property and the land, but the utility owner would have legal rights to access
the property and use it to maintain their utility. I believe the reason a townhome can be
classified as a town home is that the owner owns from the ground all the way up to the air.
There is no stacked ownership with other owners above or below, which is the reason a platted
lot can be conveyed via a fee-simple title.
There will not be common ownership of the areas immediately surrounding the buildings, but
there will be the ability for the association to access these areas if necessary. This was actually
at the request of your engineering department to allow the City access all the way to the faces
of the buildings for landscaping. I really think we are all on the same page here.
I have not received any correspondence from Matt Griffin regarding the copy of the plat I sent
over quite some time ago. I will follow up with him again.

homes, and not condominiums. True town homes differ by both construction specifications in
certain areas, and by the fact that each owner purchases a separately platted lot, in which his
property extends outside of the four walls of his/her home. In these cases, there may be
separately designated common areas, that are outside of the land areas owned by each
property owner, that may fall under some form of common ownership, or where
upkeep/maintenance of the areas is paid for out of neighborhood association annual fees. (For

Dear Mr. Hoyt:
This letter is in response to your e-mail dated February 23, 2006, regarding the Monon
and Main project. Attached is a Watermain Distribution Plan for your reference. Very
little has changed from the plan I sent to you back in November.
In your e-mail you referenced Fire Department Connections for the buildings. The
developer is proceeding with approvals from the state without internal fire suppression
systems. It is my understanding that this is able to be accomplished by the use of fire
walls between the units. Since the units are town homes. the same owner owns from
basement to rooftop. This allows for fire walls to be constructed between units and
owners. If you wish to discuss this with the developer, please call Brian Keene with G&L
DevelopmenllGunstra Builders at 765-448-1169.
. Your e-mail also references a Knox Box. The buildings do not have any internal
common area or a clubhouse. The developer would be willing to install a Knox Box if it
is still required.
I hope the above addresses your concerns and we look forward to receiving final

lhenk you for your mailing that I received on March 7''', 2006. I have a concern regarding the
Information that you provided and what was stated at the January 2005 Technical Advisory
Committee meeting, In the earlier meeting in August 2004 I asked the question of the petitioner ~
the buildings were to have a fire sprinkler system. Mthal time the answer was very vague and
possibly not yet known. Our office's concern dealt with the location and quantity of fire hydrants in
this project, an ingress I egress issue which we felt was Inadequate and whether commercial
Iresldentlal mix use was considered. On the January 2005 meeting I again raised the question
regarding an ingress Issue and was told by a representative of the petitioner that the buildings
were going to using a fire sprinkler system. I then asked for a meeting to discuss the locations of
fire department connections. Later In the meeting I asked if the was a mixed use residential I
retail and Inquired If a restaurant might be involved. I was told by the petitioner this would be
possible but only along Main St. lhis was the last correspondence I have had concerning this
project.
The Informational letter you sent me Is In conflict with what was presented to TAC in January
2005.
If there is no longer the possibility of retail, then Ihls needs to be passed on to all that attended
the January TAC Meeting, as it might change there comments.
I will need to review the drawing that you sent me and will retum a comment letter to you as soon
as possible.
For your convenience I have endosed copies of my TAC comment letters and TAC minules for
the appropriate meeting dates.

Comes now Monon & Main, Development Plan! ADLS and Rezone. We are amending this
project from a straight Rezone to a Planned Unit Development, (PUD). The applicant seeks to
rezone approximately 4 acres from B-lI and B-3/Business classifications within the Old Town
Character Sub-area to B-3/Business within the Old Town Main Street Sub-area and create a live-
work development. The site is located at 320 West Main Street. This project will be a
combination of Townhomes & Condominium Units that will be livelwork units designed to
permit flexibility of residential on two floors with one floor as a live/work or low intense retail.

I sent you a letter, no comments on the Rezone. I will need drainage calcs
and an outlet permit when you get to that point.
We do have an onsite detention system.
No comments with Rezone. I do have concerns about metering, our
equipment location, and easements.
This ",ill be Condos and Townhomes so a one gang-meter per building set.
No comments on Rezone, we will wait to comment.
We can send a new set of revised plans to you and D. Groves.
Erosion Control Plan needs more detailing. Storm water quality what do
you intend? The underground detention basin is not considered a water
quality practice. This will be a challenge for you. The Green Islands, Bio-
detention areas, and Porous pavements are possibilities as well as, lots of
trees. Suggest you put some thought to that.
I have walked the site. I need a copy of the PUD and a Tree Preservation
Plan. I have made some suggestions about changing the driveways making
them more interior drives to save on the green space on the perimeter. The
Landscape Plan should be on an engineered plan. I will get you a letter.
We have several comments I will a hi-lite a few. The main street is
classified as a Residential Parkway with a fifty feet (50') right-of-way
requirement. There is a planned rOlmdabout at 4th Avenue SW and Main.
We are looking at a seventy feet (70') radius circle centered on that
intersection. Will this be platted?
No it is condos.
City anticipates improving Main Street across the frontage of this
development These improvements may include, two westbound traffic
lanes, a-cellld-cell, tapers at the Main Street entrance, and on-street
parking. The City expects the developer to participate in these
improvements. We would like to get together with you to determine the
best way to meet these improvements.

Take the Ryland and Centex products it is the same concept. These are
residential not commercial, not like the Amli with retail but to look the
same.
These are three stories? I would like to see more hydrant locations.

It appears a total of eight structures are to be removed. No earth moving may take place
until the proper Demolition Pennits have been obtained from the Building & Code
Enforcement office I" floor, City Hall. Are there any abandoned wells, septic tanks,

The method of draft stopping must be included in the submitted construction plans.
Ducts penetrating the ceiling of fire-resistive floor/ceiling or floor/ceiling assemblies shall be
equipped with flIe dampers in accordance with Section 715.5, mc (675 lAC 13-2.4).
Duct penetrations offire barrier walls shall be protected by fire dampers in accordance with
Section 715.5, mc (675 lAC 13-2.4).
Draft stops shall be installed in accordance with Section 716.4 mc (675 lAC 13-2.4).
Smoke detectors sball be provided and installed in Groups R-2, R-3, R-4, and 1-1 in
accordance with section 907.2.10.1.2, mc (675 lAC 13-2.4).
All ground floor dwelling units shall be adaptable for accessibility in accordance with

What will the approximate square footage be, from the smallest to the largest? What is the
estimated cost of construction? Will any parts of any of the buildings be used for commercial

regarding addressing for all units. A Pre-submittal Meeting will be required. No Building Permit
will be issued before the Pre-submittal Meeting. Contact Sarah Lillard at
