This will appear on your December 5th agenda. Resolution CC-12-05-22-10: Carmel Clay Comprehensive Plan Update Amending Council Resolution CC-04-18-22-01 The applicant seeks to update and reformat the Carmel Clay Comprehensive Plan. Filed by the Department of Community Services on behalf of the Carmel Plan Commission. Returning from the Plan Commission: On Tuesday, November 15th, the Plan Commission disapproved the amended Comprehensive Plan which was adopted by City Council on October 3rd. Although the term “disapproved” sounds overly negative, the Plan Commission agreed with all the Council’s amendments except for one. The one suggested revision is as follows: • Page 18: Revise Objective 1.3.7: Protect single-family neighborhoods from dissimilar adjacent uses with respect to scale of buildings, building materials, lighting, noise and other incompatible impacts. (See also Resolution Exhibit A) • Rationale: The Plan Commission agreed with the intent of the new Objective 1.3.7; however, they did not agree that specific building materials affected the compatibility of adjacent uses to one another. Options for Council Action: Pursuant to Indiana Code, the City Council has two options to act upon the Plan Commission’s disapproval. The options are to: 1. Approve the Plan Commission’s suggested amendment by adopting the attached Council Resolution as proposed. OR 2. Confirm the Council’s October 3rd action to amend and adopt the Comprehensive Plan. This action would require amendment of the attached Council Resolution as follows: a. Line 4: Replace “amending” with “confirming” b. Line 7: Replace “amends” with “confirms” c. Line 32: Replace “amends” with “confirms” d. Lines 33-34: Replace “illustrated and attached in Exhibit A, revising Objective 1.3.7, on page 18” with “amended and approved by Resolution CC-04-18-22-01” e. The Plan was prepared in accordance with I.C 36-7-4-501, and certified by the Plan 20 Commission (Docket No. PZ-2021-00177 CP) on Tuesday, March 15, 2022; 21 22 WHEREAS, I.C. 36-7-4-501 provides that the Plan Commission shall be provided sixty 23 (60) days to consider amendments to the Plan made by the Council; 24 25 WHEREAS, the Carmel Advisory Plan Commission voted to disapprove the Council’s 26 amendments to the Plan on Tuesday, November 15, 2022, with one suggested revision; 27 28 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of 29 Carmel, Indiana, that: 30 31 Section One: The Common Council hereby amends the Carmel Comprehensive Plan as 32 illustrated and attached in Exhibit A, revising Objective 1.3.7, on page 18. 33 34 Section Two: This Resolution shall be in full force and effect from the date of passage, 35 and its publication, as provided by law. Objective 1.3.4: Support opportunities that allow more residents to be located within a short walk or bike ride to many daily needs. This can be done by allowing more walkable and diverse housing options to be built near existing amenity centers, and allowing small scale amenities to develop near some residential areas. Objective 1.3.5: Commercial uses will fit within the character of their surroundings by their form, use, and design, and are described in this plan’s Typical Corridors Development Pattern (page 37). Buildings should be designed to be flexible to help ensure that a use can change over the lifetime of the building while protecting the established character in particularly sensitive areas. Objective 1.3.6: Promote housing options to support aging in place. Objective 1.3.7: Protect single-family neighborhoods from dissimilar adjacent uses with respect to scale of buildings, building materials, lighting, noise and other incompatible impacts. Commercial uses can coexist in sensitive residential areas, provided appropriate form and character.
