HomeMy WebLinkAboutNarrative Statement_ Addendum 12-20-22Narrative Statement addendum Carmel Plan Commission Commercial Committee Rosie’s Gardens, change of zoning petition 10402 North College Avenue On December 13, 2022, the Carmel Plan Commission held a public hearing for a rezone petition for Rosie’s Gardens at 10402 North College Avenue. After questions and supportive comments from Commission members, we also received verbal support from two of our neighbors. The Commission recommended that our petition be forwarded to the Commercial Committee. After discussions with staff member Rachel Keesling, we have agreed to withdraw our request for removal from the entire Home Place Overlay District. At this time, we are seeking removal from only the Business District Sub-Area. We believe we meet the spirit and intent of the overlay district. However, Rosie’s is a unique use. Our expansion plans include replacing our existing store with a new one and expanding the on-site parking. As these plans are further refined, we anticipate seeking variances from the Board of Zoning Appeals. A Variance of Use will be requested to permit Indoor Storage and/or Warehousing and Outdoor Storage and/or Warehousing, uses prohibited by the Overlay District. These uses are essential to the business operation. In addition, we foresee the need to seek a development standards variance for a front yard setback reduction for the new parking lot. Lastly, we have agreed to prohibit certain land uses on our site that would otherwise be permitted in the B-3 zoning district. These uses appear in Exhibit C of our draft ordinance. We look forward to further dialogue with the Committee and are eager to move forward with our expansion plans to better serve the Carmel community.
