D-2634-22 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 5, SECTION 8-47(a) OF THE CARMEL CITY CODE. Synopsis: Ordinance codifies no parking zones on Woodside Hollow Drive and Soundview Place. WHEREAS, pursuant to Indiana Code 9-21-1-3(a)(1), the City of Carmel, Indiana (the “City”) within the reasonable exercise of its police power, may by ordinance regulate vehicular parking; WHEREAS, the City has previously regulated vehicular parking within its corporate limits, such regulations being codified, in part, in City Code Section 8-47(a); WHEREAS, on November 7, 2016, the Common Council adopted Ordinance Z-618-16, which established the Woodside at West Clay Planned Unit Development District (“Woodside PUD”); WHEREAS, due to the reduced width of the rights-of-way within the Woodside PUD, Z-618-16 included a requirement that parking be limited to one side of the street within the development; WHEREAS, in order to cite parking violations within the Woodside PUD, it is necessary to codify the parking restrictions set forth in Z-618-16 into Carmel City Code Section 8-47(a); and WHEREAS, the Common Council of the City of Carmel, Indiana, now finds that it is in the interest of public safety and welfare to codify no parking zones within the Woodside PUD. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The following subsections of Carmel City Code Section 8-47(a) is hereby added and shall read as follows: “(70) On the west side of Woodside Hollow Drive. (71) On Soundview Place as follows: a) on the south side of Soundview Place east from the southern intersection of Soundview Place and Woodside Hollow Drive for a distance of 302 feet. b) on the east side of Soundview Place north from a point 302 feet east of the southern intersection of Soundview Place and Woodside Hollow Drive for a distance of 332 feet. c) on the north side of Soundview Place east from the northern intersection of Soundview Place and Woodside Hollow Drive for a distance of 302 feet.” Section 4. The remaining provisions of Carmel City Code Sections 8-47 are not affected by this Ordinance and shall remain in full force and effect. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance, such repeal to have prospective effect only. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred, or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued, and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 7. The Carmel Street Department is directed to promptly add the appropriate signage to fulfill the mandates contained in this Ordinance upon its passage. Section 8. This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor and such publication as required by law.
