HomeMy WebLinkAboutZ-677-22;_PZ-2022-00167_Z;_1st_Ave_SE_C2_Rezone_Ordinance_as_Certified_(002) 10/07/2022 Ordinance Z-677-22 1 Sponsor: Councilor Rider ORDINANCE Z-677-22 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA ___________________________________________________ Rezoning 4 parcels located along 1st Avenue SE to the C2/Mixed Use District Synopsis: This ordinance rezones 4 parcels located along the west side of 1st Avenue SE, between 1st Street SE and Supply Street to the C2/Mixed Use District for the purpose of facilitating redevelopment. WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted a unified development ordinance, the terms of which are applicable to the geographic area consisting of the incorporated area of the City of Carmel, Indiana, which unified development ordinance has been codified in Chapter 10 of the Carmel City Code; and WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the map that is part of the unified development ordinance; and WHEREAS, the Carmel Advisory Plan Commission, on Thursday, October 6, 2022, voted to favorably recommend Docket No. PZ 2022-00167 Z, rezoning the Parcels illustrated and described in Exhibit A, which is incorporated herein (the “Real Property”). NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, that: Section I: That the Official Zoning Map accompanying and made part of the Unified Development Ordinance is hereby changed to designate the Real Property Parcels from the B5 Business, R2 Residential and R3 Residential Districts within the Old Town Overlay Character Subarea to the C2/Mixed Use District. Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III: This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
