D-2646-22 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 2, SECTION 8-8 OF THE CARMEL CITY CODE Synopsis: Ordinance amending the setting of street signs standards. WHEREAS, the City of Carmel (the “City”) previously established standards for street signs within the City’s corporate limits under Carmel City Code Section 8-8; and WHEREAS, the Indiana Manual on Uniform Traffic Control Devises provides guidance on the placement and installation of street signs; and WHEREAS, the Common Council of the City of Carmel, Indiana, deems it prudent and efficient to provide the City of Carmel Engineer the authority to set, in accordance with the sign guidelines set forth in the Indiana Manual for Uniform Traffic Control Devices (“IMUTCD”), street sign standard to ensure uniformity of signs within the City and consistency with the changing language of the IMUTCD. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Carmel City Code Section 8-8 is hereby amended as follows: “§ 8-8 Street Sign Standards. (a) It is declared a requirement by all persons, corporations, organizations, or other legal entities dedicating streets with street signs to the City, or building streets with street signs for the City, or otherwise maintaining streets and street signs for the City to follow street sign standards set, in accordance with the applicable sign guidelines under the Indiana Manual for Uniform Traffic Control Devices, by the City Engineer. (b) The City Engineer shall approve the signs, posts and brackets of all signs which are placed on City Streets. In the event a developer or other person dedicates a road or street to the City, all signs for same shall comply with this section. The City shall maintain and replace said signs, as necessary, after they have been dedicated to and accepted by the City.” Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance, such repeal to have prospective effect only. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred, or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. If any portion of this Ordinance is for any reason declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 5. The remaining portions of Carmel City Code Section 8-8 are not affected by this Ordinance upon its passage. Section 6. This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor and such publication as required by law.
