"'~Petitioner-seeks a favorable recommendation for the establishment of the Home Place
District Overlay Zone. The area affected is generally known as Home Place.
Filed by the Department of Community Services for the Home Place Task Force.
The adoption of this ordinance will establish the Home Place Overlay District on the Official
Zoning Map. There are no changes to the ordinance adopted by the Council on April 1, 2002.
This ordinance exclusively adopts the area to be designated.
The Carmel/Clay Plan Commission forwards this ordinance to the Common Council with a
unanimous (14-0) Favorable Recommendation (see attached certification).
The Department recommends that the Council adopt this Ordinance upon receiving a
recommendation from the committee.
As previously noted the Annexation and Land Use Committee has discussed this matter
and the Council adopted the text at their April 1, 2002 meeting. With that
understanding the Department requests the Council take final action on the Ordinance
at this meeting.

ORDINANCE NO. Z-380-02
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Establishing the Home Place Overlay District Classification
WHEREAS, the CarmeVClay Plan Commission has favorably recommended the rezoning
of the real property, the description of which is attached hereto as Exhibit A, and which is illustrated
in Exhibit B also attached hereto.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property as being within the Home Place Overlay District.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section Ill: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.

BOUNDARY DESCRIPTION
Home Place Overlay District
Part of the East half of Section 2, Township 17 North, Range 3 East; Part of the East Half of Section 11, Township 17
North, Range 3 East; Part of the West half of Section 1, Township 17 North, Range 3 East; and Part of the West half of
Section 12, Township 17 North, Range 3 East, in Hamilton County, Indiana, more particularly described as follows:
The Home Place District Overlay Zone is generally bounded by the following streets; to the west by Pennsylvania Street,
to the north by East 1 16th Street, to the east by the Monon Greenway, and to the south by 1-465.
The Home Place District is comprised of the following sub-districts as shown on the Home Place District Boundaries
Map, Exhibit B:
A Home Place Business District, which is primarily comprised of the properties located near the
intersection of East I06th Street and North College Avenue.
B West Home Place Commercial Corridor (High Intensity and Low Intensity), which is comprised of
properties on the East side of Pennsylvania Street from East 103rd Street to East 1 16th Street.

Dear Members:
The Carmel/Clay Plan Commission offers you the following report on the application (Docket No. 135-Olb Z) of
the City of Carmel Department of Community Services petitioning the Commission for a favorable recommendation
to rezone property commonly known as Old Town Carmel:
The CarmeI/Clay Plan Commission's recommendation on the petition of the applicant is FAVORABLE.
At its regularly scheduled meeting of March 19, 2002, the Carmel/Clay Plan Commission voted fourteen (14) in
Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-
380-02 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4-
608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the
Commission. Ninety days from the date of this Certification is Wednesday, June 19,2002.
